TIEL.PHON.781-10 .~ , . / I ~ -----..v .., RESOLUTION NO. ~ A RESOLUTION OF THE CITY OF SEAL BEACH DESIGNA- TING OFFICES AND POSITIONS OF SAID CITY, DEFD~ING THE DUTIES INCIDENT THERETO, FIXING THE SALARIES THEREFORE AND TDIiE OF PAYMENT THEREOF. WHEREAS, it is deemed advisable and to the best interest of the City of Seal Deach that the compensation paid and to be paid to all employees of the City, except those employees and officers whose compensation shall be fixed by ordinances as provided by law shall in the future be fixed a'1d deteImined by resolution rather than by ordinances; and, 11/HEREAS, the City Council has passed an ordinance providing for the same. NOW, THEREFORE, the City Council of the City of Seal Beach resolves as follows l Section 1. That the City Council from time to time shall adopt nece~sary resolutions fixing the rate of compensation to be paid to the several employees of the City in Place of adopting an ordinance for such purpose except as to those employees whose compensation must be fixed by ordinances as provided by the Statutes and Laws of the Sta~e of California. Section 2. Upon the effective date of Ordinance No. 350 entitled "AN ORDINANCE OF THE CITY OF SEAL BEACH PROVIDING THAT THE CITY COliNCn. MAY CREATE OFFICES AND POSITIONS, DEFINE THE DU'l'IFS TIICIDENT THERETO AND FIX S THEREFORE AND TIME ,oF PAYMENT BY RESOLUTION; REPEIlEING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING FOR THE PUBLICATION HEREOF, II adopted by the City Council at their meeting of February 1i, 1948, the officers- and employees of the City of Seal Beach except those whose compensation must be fixed by ordinances as provided by the Statutes and Laws of the State of Cali- fomia shall receive as compensation the following amounts set opposite their respective positions or such other compensation as the City Council may, from time to time, fix by resolution: - 1 - ,. In addition to the povrers and duties generalJ.y attached 9 to the respective positions listed in Section 2 hereof, the following shall be 10 respectively included: 11 (a) POLICE DEPARTMENT: The Department of Police of said City 12 shall be under the direction and control of a Chief of Police appointed by the 13 City CouncJ.l and shall hold such office at the pleasure of said Council. It 14 shall be the duty of the Chief of Police to prosecute, before the City Court, 15 16 all bre..lches and violations of or the non-compliance with any ordinance of said City which shall come to his Imowledge. The Chief of Police, in addition to 17 such duties, shall collect all City Licenses, excepting Contractor's Licenses, 18 and shall deposit said amount so collected in the office of the City Treasurer 19 monthly, and shall perform all duties required by Law and Statutes of the State 20 of California. He shall appoint, subject to the approval and conlinnation of 21 the City Council, a captain of Police and Police Sergeant and may appoint, sub- 22 jest to the approval and confinnation of the City Council, addit:iPnalPolice 23 Officers who shall perfonn such other services as the GeIB:'al Laws of the State, 24 Ordinances, Resolutions and Motions of the City Council may from time to time 25 require. (c) MAINTENANCE DEPARTMENT: The Maintenance Foreman shall super- vise all street and construction work in and about the City. the collection and disposal of all garbage and refuse. the operation of the water and sewer plants and systems. and shall direct all laborers engaged in occupations in connection therewith; reserving. hOlvever. to the City Council the right to designate the number of laboK to be employed and said Maintenance Foreman shall perform such other duties as may be prescribed by the City Council. (d) CITY ATTORNEY: The City Attorney shall advise the City Authorities and Officials of said City in all legal matters pertaining to the business of saJ.d City. to frame all ordinances and resolutions required by the City Council and shall perform such other legal services as said City Council ms:y require from time to time. provided. that in addition to the salary of the City Atto!'lley he shall receive such additional compensation fill' the prosecution and defense of all actions on behalf' of the City in Court and for other matters of a special nature as ~ be allowed by the City Council. He shall be authorized to make 5 sworn statements in the matter of tax withheld as required by the United States 6 Treasury Department a.'1d shall act as the agent for the City in insurance matters 7 (f) DEPUTY CITY ASSESSOR, TAX COLLECTOR, WATER SUPERJlITENDENT 8 STENOGRAPHER AND AFFn.IATED OFFICES: The Deputy City Assessor, Tax Collector, 9 Water Snperintendent Stenographer and Affiliated Offices shall perform the same , 10 duties as the City Assessor, Tax Collector, Water SoJ.perintendent and Affiliated 11 Offices under his direction and such other and further duties as may from tlll1S 12 to time be provided for by resolution or ordinance. He shall keep ledger and 13 warrant records for the City Clerk, keep withholding tax records, compensation 14 insurance employee records and prepare demands for the purchasing agent. 15 16 -<' (g) CITY ENGINEER" BUILDJlIG, SEWER, ELECTRICAL AND l'LUEINGalli D~SPECTOR AND PURCHASING AGENT: The City Engineer, Building, Sewer, Electrical 17 and Plumbing Inspector and Purchasing Agent shall perform such duties as from 18 19 time to time shall be provided for by resolution or ordinances. He shall collec ",~-'f~ a:ny and all Contractor's Licenses, due the City and pay the same into the office 20 of the City Treasurer monthly~ He shall make all purchases of supplies, materia s 21 and equipment by or on behalf' of said City of Seal Beach in an amount not to 22 exceed TWO HUNDRED DOLLARS ($200.00), except upon the authorization of the City 23 CounciJ.; he shall check and approve all demands for the payment of the same 24 and no purchase shall be made in an amount in excess of ONE THOUSAND DOLLARS 25 ($1,000.00) without advertJ.sing for bids as provided by law. The Purchasing 26 Agent shall keep an accurate account of all supplies and materials on hand and 27 render an annual account or inventory of the same at the Cbse of the fiscal year. 28 All inspection fees collected by the said Inspector shall be paid monthly into 29 the office of the City Treasurer. Resolution Number . . , 1 (h) CITY JUOOE: The City Judge shall be Judge of the City Court 2 and shall have the power to perform the duties of a ~iagistrate. He lIlIliY' administ r :5 4 and certify oaths of affirmation and take and certify aCknowledgments. A Justice of the Peace may, at the same time, hold the office of City Judge. 5 (i) LIFE GUARDS: The Captain of Life Guards shall supervise all 6 Life Guards employed by the City and shall act as a Life Guard for said City 7 in activities as are usually perfonned by Life Guards.
