Secretary presented an overall Staff Report on the proJect The appl1cants
are before the Comm1ss1on to present add1t1onal 1nformat1on on quest10ns
ra1sed by the Plann1ng Comm1ss1on dur1ng preV10us meet1ngs on the proJect
Stanley Gordon Attorney represent1ng the appl1cant stated that he and
representat1ves from 7-11 would attempt to respond to the Comm1ss1on s quest10ns
a Type of del1very veh1cles Each use would have del1ver1es by
tractor-tra1ler trucks W1nchells would have one (1) del1very per
week 7-11 would have one (1) tractor tra1ler del1very per week
as well as smaller truck deliver1es

e A traff1c survey was conducted 1n Newport Beach at Balhba and 20th
Street before the construct1on of a 7-11 and after construct1on was
completed

Mr Cov1ngton asked about the traff1c survey methodology Mr W1111ams repl1ed to
the quest10n stat1ng that the traff1c survey 1nvolved one (1) 15 m1nute count on
one (1) daY' only Mr Covington asked about the locat1on of the three (3) 7-Eleven
stores 1n relat1onsh1p to schools Mr Wil11ams sa1d that one was at the edge of
a football f1eld one was / block away and he d1dn t remember hQW close the

and wine Mr W1111ams repl1ed that all three stores d1d infact sell beer and W1ne
Mrs Le1bert spoke 1n favor of the proJect based on zon1ng and the proJect s
compl1ance w1th the Ord1nance Mr Covington asked about traff1c volumes on the
streets near the schools who had subm1tted letters 1n favor of 7-Eleven Mr
W1111ams d~d not have that information ava1lable Mr R1pperdan asked about
school ch1ldren s patronage of the stores dur1ng school hours Mr W1111ams stated
that the operations w111 cooperate w1th the school to send ch!l4ren~the s~hool

assumed contents were adequate Mr Cov1ngton asked about the responses to the
letters sent to the commun1ty leaders Mr Wil11ams stated he rece1ved two (2)
responses from the f1ve (5) sent Mr Knapp again ~suggested that the people 1n
the area be surveyed 1n a door to door survey Mr W1111ams responded to Mr
Cov1ngton s quest10n stat1ng that he contacted the people who were most vocal at
the previous meetings Extens1ve d1scussion followed on dollar volume and the
percentage of sales dur1ng the three (3) sh1fts at the 7-Eleven store Mr W1111ams
1n response to a quest10n stated that most clean1ng and restock1ng of shelves takes
place dur1ng the Grave-yard sh1ft
Mr Cov1ngton asked for 1nformatjon on the econom1C 1mpact of no 24 hour serV1ce
and no beer and W1ne Mr Cook quest10ned the use based on a sect10n of the Land
Use Element of the General Plan dealing with commun1ty enhancement Secretary
stated that the Staff Report shmuld be upheld and responded to a quest10n by the
Comm1ss1on stating that the General Plan 1S general 1n nature and the Zon1ng
Ord1nance 1S more legally val1d than the General Plan as the Ord1nance 1S more
specific
Mr Cov1ngton moved to cont1nue the matter to the February 7th meet1ng 1n order
to obta1n add1t1onal 1nformat1on on quest10n #7 of Resolut1on 1178 Staff was
directed to confer with the C1ty Attorney as to the 1mplicat1ons of the Statements
on page two (2) of the Land Use Element seconded by Mr Cook After a d1scuss1on
a call for the quest10n was made

A request for determ1nat1on on a park1ng plan for a duplex was cons1dered by the
Plann1ng Comm1ss1on on January 3 1979 The matter was cont1nued to g1ve the
architect an opportun1ty to evaluate other parking des1gns James Pul11am
arch1tect stated that he rev1ewed other park1ng des1gns but none were pract1cal
The appl1cant was d1rected to apply for a Var1ance 1f they w1shed formal
cons1derat1on of the or1g1nal park1ng des1gn

Secertary presented a report suggesting that the landscapmg requ1rements in
all non-res1dent1al zones De 1ncreased to 10/ of the s1te plus one (1) tree
for each f1ve park1ng stalls equally distr1buted 1n the park1ng area The
Commiss1on favored the concept Staff will adv~rt1ze the matter for Publ1c

Secretary presented a Staff Report w1th a suggest10n that the amateur rad10
antenna he1ght prOV1S1ons be amended to allow a 40 (atjresting he1ght) antenna
MaJor Tom 712 Balboa spoke in favor of the proposed change Extens1ve
discuss10n followed on antenna he1ghts number of hams 1n the C1ty electron1c
1nterference f1lter1ng perce1ved problems in other communit1es and antenna

he1ghts in other commun1t1es Cov1ngton suggested that the prov1sions be
amended to 11m1t the overall height to 60 and to return the antenna to
rest1ng he1ght at least once 1n each 24 hour per10d The matter was cont1nued
and Staff was directed to survey surround1ng c1t1es to determ1ne the1r he1ght
regulations

REPORT FROM SECRETARY
L .!?].s~sion of Draft S1gn Ordinance
Secretary stated that the Draft S1gn Ord1nance represented all poss1ble s1gn
prov1s10ns that a C1ty may adopt The Comm1ss1on has the opportun1ty to change
mod1fy or delete any of the prov1s1ons All comments have not been rece1ved
from the C1ty Departnents and C1ty Attorney at th1s t1me and so the changes
suggested could further bemmod1f1ed in the future Secretary suggested a
number of add1t1ons and changes The Commiss1on d1scussed a number of prov1sions
offer1ng changes

Secretary requested the Commiss1on to carefully reV1ew the draft 1nsert changes
and subm1t the1r cop1es of the draft to Staff for 1ncorporat1on 1nto a 1st
draft reV1S1on for future d1scuss1on
Cook asked Staff to prov1de 1nformat1on on the probable number of architectural
review board cases per week

Cook also asked Staff to present the sl1de show on arch1tectural 1tems to the
Plann1ng~Comm1ss10n so the CommlSS10n would have the same 1nformat10n that was
presented to C1ty Counc11 The Comm1SS10n asked for a status report on the
Hellman property There have been no new developments to date and so far
representat1ves of Lusk Company have not returned the Plann1ng D1recto~s calls
as to the1r future development of the property

Marina Palace S1te - The developer has encountered problems ohta1n1ng a comm1tment
as to the cost of Haynes Steam Plant Road Southern Cal1forn1a Edison owner
of Haynes Steam Plant Road 1S planning to close the road due to liab111ty
Should the developer come to terms with Southern{Cal1forn1a Ed1son on Haynes
Road Staff w111 inform the developer of Staff concerns w1th park1ng layout
and the need for a load1ng zone
