A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL

OITY STREETS FOR THE FISCAL YEAR ENDING JUNE 30,1940,
AS ~UIRED BY Sl!I:TION 197 OF THE STREETS AND HIGH-
WAYS CODE.
The City Couno11 of the City of Seal BeaCh, California, resolve :
WHEREAS, pursuant to the prov1s1ons of Section 195 of the
Streets and Highways Code, the Director of Public Works of the State
of Cal1fornia, under date of Februa1"1 21,1937, has approved for im-
provement as a STREET OF MAJOR IMPORTAECE in said City-Bay BoulevarCL
Northeasterly from California State Highw~ Route No.183 to the City
L:lmits- also known as Westm:tnister Avenue-; and,
lIHEREAS, the City Council has heretofor.~ ad:opted a budget
for the flsoal year ending June 30, 1939, fOI" the expenditure of sai
monies for the 1mprovement of said STREET, as more fully set forth i
the Pro,jeot Statement therefor, dated De 0 ember 17th, 1937, and there
has aocumnlated in said fund for the flsoal year ending J~ne 30,1938
the sum of $1,047.94 and for the fisoal year ending June 30, 1939, the
further sum of $1,049.09 or a total of $2,09rz.03t and the total esti ,ate
mated cost of said Project will. exceed last namea. amount; and,
WHEREAS, it 18 est1m~ed that the revenue available for th
fiscal year ending June 30, 1940, for said Projeot, is the further s
of $1060.00, which said City Counoil desires to budget for the oost
of said :Improvement; and,

NOW, THEREFORE, BZ IT RESOLVED by sald City Counc1l; as
follows:
Sectlon 1. That under the provisions of Section 197 of the
Streets and,Hishw~~,Code of the State of Cal1fornla, there ls here
oreated in the City Treasury a Special Fund to be known as the "Spec al
Gas Tax Improvement J'ldrdll for the f18cal year ending June 30, 1940;
and, that all moneys .reoeived by the City trom the State of Cal1forn a
under the prov1lionl of laid Streets and H1gh.ways Code fOI" the aoqui 1-
t10n of real property or tD.eresta therein for, or the construotion,
maintenanoe or improvement of Itreets or highw~a other than State
High.waya shall be pald into said fund.
Section 2. That all moneys in aaid fund shall be expended
clus1vely for the purposes authorized by and subjeot to all the pro-
vlsions of Article 5, Chapter I, D1vis1on I of said Stre&ts and High.
w~s Code, and shall be applied to the oost of improvement of said
Bay Boulevard al set forth in said Project Statement heretofore refe _
ed to, together with ~ additional funds contributed by said City 0
the County of orange.
Seotion 3. That the City Clerk shall certity to the adopti
of this Resolution by the C1ty Oouncil of said City of Seal Beaoh,
it shall thereupon take effect.
