'.Q t. co RESOLUTION NO.409 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, ACCEPTING THE BID OF THE SHEPHERD TRACTOR AND E'~UIPMENT COI,IPANY FOR FURNo- ISHIm SAID CITY \lITH A CATERPILLAR DIESEL TRACK- LAYER TRACTOR AND CERTAIN OTHER EQUlIPf,l1!:NT. \VHEREAS, the City Counci~ of the City of Seal Beach, California, has authorized and direoted the City Clerk of said City to adver-' tise for bids for the furnishing to said City of a Tracklayer Tractor020 to 35 H.P.),l1ft buoket(~ to t Cu.Yd.),bulldozer, and scarifier, all bids to specify size of eqU1~ent and to be subject to a trade in allowanoe for a "Caterpillar 301" owned by the City; and, said City Council reserved the right to reject any and all bids and to waive any irregularity in a bid; and, w.a~EAS, the said City Council d~d at a regular meeting thereof, held on the 4th day of January, 1940, proceed to publicly open the bids reoe1ved in accordance with the advertisement therefor for ohecking and consideration, and have duly considered such bids and determined the same in accordance with the needs of said City with referenoe to the type of equipment to be purchased, and concluded that the lowest and best bid for furnishing said City with said equipment has been made by the Shepherd Tractor & Equi:pment Com- pany of Los Angeles, California, for the total sum of i4949.3U, plus sales tax; and, , . . Now, Therefore, the City Council of the City of Seal Beaoh, Cali- fornia, does hereby resolve; as follows: Section 1: That the lowest and best bid filed by a responsible bidder for furnishing said 01ty the Caterpillar Diesel Tracklayer Tractor and equipment desoribed as above, is that of the Shepherd Traotor . Equipment Company of Los Angeles, California, for the total sum of $4949.3U, plus sales tax; that all other bids be re- jected and that any informality or irregularity in the aocepted bid, be waived, ~nd the contraot for furnishing such equipment be given to such suocessful bidder. Section 2: That the Mayor and Clty Clerk be authorized and directed to sign a oontract for the purchase of said equipment or to aooept delivery thereof for and on behalf of said City.
