SUMMARY OF REQUEST:
Introduce Ordinance Number 1566, An Ordinance of the City of Seal Beach, California
Amending Municipal Code Section 8.05.015 Applicability to Private Roads and Section
8.15.010 No Parking Areas, Regarding Surfside Colony. Instruct staff to schedule for
second reading and adoption at next regular City Council meeting.
BACKGROUND:
The ordinance recommended for introduction this evening is proposed to address
concerns of the Orange County Fire Authority, the Seal Beach Police Department, and
Surfside Colony regarding the lack of parking enforcement relative to the parking of
vehicles between the ''white lines" within the Colony on their private roadways where
stopping, standing or parking of a vehicle would constitute a hazard.
Due to the extremely narrow roadways within Surfside Colony the necessity for both the
Fire Authority and Police Department to have the proper authority to strongly enforce the
parking regulations for vehicles that encroach into the "clear area" of the roadways is
extremely important, and the current regulations of the City do not adequately address
this matter.

The proposed Municipal Code amendment has been reviewed by the City Attorney's
office and is acceptable.

deleted m Its enbrely and replaced WIth a new Title 8 Vehtcles and Traffic, Chapter 8 OS

A. The CIty COODCtl fmds and declares that the follOWIng are
pnvatelyowned and mamtamed roads that are not generally held open for
use of the pubhc for purposes of velllcular travel but, by reason of thetr
proXII1I1ty to or connecbon With hIghways, the mterests of the reslClents
resldmg along the roads and the motonng public wtll best be served by the
appllcabon of the Vehicle Code and thIS btle to such roads:--
1. Surf sIde Avenue; PaCIfic Avenue, Sea Way; Phtlllps
Street and all lanes and parkmg areas wlthm the boundanes of the property
of the Surf SIde Colony

2. All named roads, lanes and parlang areas Wlthtn the
boundanes of the property of the Rossmoor Busmess Center
B. The cIty shall enforce traffic laws on the roads listed m
paragraph A and such roads shall be subject to all the proVISIonS of thIS
btle and the VehIcle Code The cIty shall not be deemed to assume any
responslbtllty or liabilIty for the mamtenance or care of such roads."

to add a new sub-secbon F to read as follows

phrase of thiS ordmance or any part thereof IS for any reason held to be mvaltd, such
mvallChty shall not affectlhe valldtty of the renwnmg parbOIlS of tlus onhnance or any part
hereof The CIty CounCIl of the CIty of Seal Beach hereby declares that It would have
passed each sectIOn, subsecbon, SUbdIVISIon, paragraph, sentence, clause or phrase hereof,
