BACKGROUND: The City Council considered this matter on January 14, 2008 and introduced the subject ordinance. It is now appropriate to adopt the subject ordinance. FISCAL IMPACT: None. RECOMMENDATION: Waive further reading and Adopt Ordinance No. 1566, An Ordinance of the City of Seal Beach, California Amending Municipal Code Section 8.05.015 Applicability to Private Roads and Section 8.15.010 No Parking Areas, Regarding Surfside Colony. Tide 8 Vehicles and Traffic, Chapter 8.05 General Provisions, Section 8.05.015 Applicability to Private Roads, of the Seal Beach Municipal Code is deleted in its entirety and replaced with a new Title 8 Vehicles and Traffic, Chapter 8.05 General Provisions, Section 8.05.015 Applicability to Private Roads, to read as follows: "18.05.015 Applicability to PrIvate Roads A. The city council finds and declares that the following are privately owned and maintained roads that are not generally held open for use of the public for purposes of vehicular travel but, by reason of their proximity to or connection with highways, the interests of the residents residing along the roads and the motoring public will best be served by the application of the Vehicle Code and this title to such roads: 1. SUlfside Avenue; Pacific Avenue; Sea Way; Phillips Street and all lanes and parking areas within the boundaries of the property of the Surfside Colony. e 2. All named roads, lanes and parking areas within the boundaries of the property of the Rossmoor Business Center. B. The city shall enforce traffic laws on the roads listed in paragraph A and such roads shall be subject to all the provisions of this tide and the Vchicle Code. The city shall not be deemed to assume any responsibility or liability for the maintenance or care of such roads." SECTION 2. Tide 8 Vehicles and Traffic, Chapter 8.15 Stopping, Standing and Parking, Section 8.15.010 No Parking Areas, of the Seal Beach Municipal Code is amended to add a new sub-section F to read as follows: "F. In the Surfside Colony in any area between the white lines where stopping, standing or parking of the vehicle would constitute a hazard," SECTION 3. If any section, subsection, subdivision, paragraph, sentence, clause or phrase of this ordinance or any part the=f is for any reason held to be invalid, such invalidity shall not affect the validity of the remaining portions of this ordinance or any part hereof. The City Council of the City of Seal Beach hereby deelares that it would have passed each section, subsection, subdivision. paragraph, sentence, clause or phrase hereof, irrespective of the fact that anyone or more sections, subsections, subdivisions, paragraphs, sentences. clauses or phrases be declared invalid.
