AGENDA APPROVAL By Motion of the Planning Commission, this is the time to: (a) Notify the public of any changes to the Agenda; (b) Re-arrange the order of the Agenda; and/or (c) Provide an opportunity for any member of the Planning Commission, staff, or public to request an item be removed from the Consent Calendar for separate action. IV. ORAL COMMUNICATIONS At this time, members of the public may address the Planning Commission regarding any items within the subject matter jurisdiction of the Planning Commission, provided that the Planning Commission may undertake no action or discussion unless otherwise authorized by law. RECEIVE AND FILE: "How Should California Grow?" - Western City Magazine. 4. Minor Plan Review 08-1 708 Taper Drive Applicant/Owner: Stephen & JoAnn Murphy 1 City of Seal Beach Planning Commission. Agenda of January 23, 2008 Request: To construct a new freestanding barbecue and counter structure within the required rear and side yard setback areas; and a new rock grotto, waterfall, and pool slide within the required rear yard setback. Recommendation: Approval, subject to conditions, and adoption of Resolution 08-1. 5. Minor Plan Review 08-2 923 Heron Circle Applicant/Owner: Scott and Sheri Olson Request: To construct a new freestanding barbecue and counter structure within the required rear and side yard setback areas. Recommendation: Approval, subject to conditions, and adoption of Resolution 08-2. VI. SCHEDULED MATTERS 6. Approve Planning Commission meeting minutes of January 9, 2008. 7. Mitigated Negative Declaration 07-1 General Plan Amendment 06-2 Zone Change 06-2 Planned Unit Development 06-1 Vesting Tentative Parcel Map No. 17082 1011 Seal Beach Boulevard (Seal Beach Townhomes) Applicant/Owner: Don Wilson Builders / JB Properties Request: Don Wilson Builders is requesting approval of Mitigated Negative Declaration 07-1; General Plan Amendment 06-2; Zone Change 06-2; Planned Unit Development 06-1, Vesting Tentative Tract Map No. 17082 to accomplish the following actions: o Adopt Mitigated Negative Declaration (MND) 07-1, 2 City of Seal Beach Planning Commission . Agenda of January 23, 2008 certifying that the MND has been prepared in accordance with the provisions of the California Environmental Quality Act (CEQA); o Amend the Land Use and Housing Elements of General Plan to designate a 4.49 acre property from Light Industry to Residential High Density; o Change the zoning designation on this parcel from Light Manufacturing (M-1) to Residential High Density (RHD), District II to be consistent with the General Plan revision; o Recommend approval of Vesting Tentative Tract Map No. 17082 to create two separate lots for development, and o Construct 87 new town home residences ranging in size from approximately 1 ,300 to 1,748 square feet. The meeting was held in the City Council Chambers and began with the Salute to the Flag.1 ROLL CALL Present: Vice-Chairperson Roberts, Commissioners Bello, DeLay, and Massa-Lavitt. Also Present: Department of Development Services Lee Whittenberg, Director of Development Services Jerry Olivera, Senior Planner Steve Flower, Assistant City Attorney Absent: Chairperson Deaton Mr. Whittenberg stated that Chairperson Deaton had notified Staff that she would not be in attendance at tonight's meeting and had requested to be excused. MOTION by Bello; SECOND by Massa-Lavitt to excuse Chairperson Deaton from the Planning Commission meeting of January 23, 2008. MOTION CARRIED: AYES: NOES: ABSENT: 4-0-1 Roberts, Bello, DeLay, and Massa-Lavitt None Deaton AGENDA APPROVAL Mr. Whittenberg indicated that the applicant for Item No. 8 for the Seal Beach Townhomes has requested that the public hearing be continued to the next scheduled meeting of February 6. 2008, so that this item may be heard before a full Commission. He then requested that the public hearing for Item 9, the Zoning Code Study Session, be opened and that it also be continued to the meeting of February 6, 2008, in order to prevent having to re-notice this item. MOTION by Massa-Lavitt; SECOND by DeLay to approve the Agenda as amended. MOTION CARRIED: AYES: NOES: ABSENT: 4-0-1 Roberts, Bello, DeLay, and Massa-Lavitt None Deaton ORAL COMMUNICATIONS Vice-Chairperson Roberts opened oral communications. Mark of Leisure World spoke in opposition to the proposed drive-through lanes at the new Longs Drugs pharmacy, and stated that Longs would not be able to provide the same selection of groceries as a standard grocery market. Request for Time Extension - Conditional Use Permit 06-7, 900 Ocean Avenue (Ruby's on the Pier). Staff Report Mr. Whittenberg stated that Ruby's has requested an extension of Conditional Use Permit 06-7 for 900 Ocean Avenue, as it is close to the expiration date and the applicant requires more time to prepare plans for submittal to the City. Public HearinQ Vice-Chairperson Roberts opened the public hearing. Mr. Whittenberg asked that any member of the public wishing to address the Commissioner on this item tonight come forward to speak. MOTION by DeLay; SECOND by Massa-Lavitt to continue Mitigated Negative Declaration 07-1, General Plan Amendment 06-2, Zone Change 06-2, Planned Unit Development 06-1, and Vesting Tentative Parcel Map No. 17082 to the scheduled meeting of February 6, 2008. He noted that this would entail providing a copy of the document to the Commissioners for their review prior to the beginning of the formal public hearings in mid-April.
