FT. OF BANQUET SPACE; 281 SQ. FT. BRIDAL SUITE; AND AN OUTDOOR COURTYARD, INCLUDING A SWIMMING POOL AND SPA, TO THE OLD RANCH COUNTRY CLUB AT 3901 LAMPSON AVENUE, SEAL BEACH. THE PLANNING COMMISSION OF THE CITY OF SEAL BEACH DOES HEREBY FIND AND RESOLVE: Section 1. On October 22, 2007, Steve C. Kim of EWAI Architects applied for Conditional Use Pennit (CUP) 07-16 with the Department of Development Services for the addition of approximately 5,067 sq. ft. of banquet space; 281 sq. ft. bridal suite; and an outdoor courtyard including a swimming pool and spa at 3901 Lampson Avenue, Seal Beach. Section 2. Pursuant to 14 California Code of Regulations 9 15305 and 9II(B) of the City's Local CEQA Guidelines, staff has deternlined as follows: the application for Conditional Use Pernlit 07-16 for an addition of approximately 5,067 sq. ft. of banquet space; 281 sq. ft. bridal suite; and an outdoor courtyard including a swimming pool and spa is categorically exempt from review pursuant to the California Environmental Quality Act pursuant to 14 Cali fornia Code of Regulations 91530 I (Existing Facilities), because the proposal involves a negligible expansion of an existing use; and pursuant to 915305 (Minor Alterations in Land Use Limitations), because the proposal invplves a minor alteration in land use limitation and does not involve either a property in excess of20% slope or a change in land use or density. Section 3. A duly noticed public hearing was scheduled before the Planning Commission on December 5, 2007, and continued to the regular meeting of January 9, 2008, to consider the application for Conditional Use Permit 07-16. Section 4. Based upon the facts contained in the record, including those stated in this resolution and pursuant to the City Code, the Planning Commission makes the following findings: (a) On October 22, 2007, Steve C. Kim of EWAI Architects applied for Conditional Use Permit (CUP) 07-16 with the Department of Development Services for the addition of a 3,400 sq. ft. banquet room; 200 sq. ft. bridal suite; 3,500 sq. ft. owner's suite; and an outdoor cOUliyard including a swimming pool and spa at 3901 Lampson Avenue, 10f5 Planning Commission Resolution 07-64 Conditional Use Permit 07-16 Old Ranch CountlJl Club Janum)l 8, 2008 Seal Beach. On December 19, 2007, revised plans were submitted that eliminated the owner's suite, added 1,667 sq. ft. of banquet space, and enlarged the bridal suite/lounge to 28] sq. ft. (b) The subject property has operated as a golf course and driving range since 1967. The City has granted the following discretionary approvals at this location: Plan Review 70-22 for an addition to the clubhouse building on August 4, 1971; CUP 92-14 for an after-the-fact approval of an on-sale bt:er license for Old Ranch Country Club on October 21, 1992; MPR 01-5 for the use of a temporary tent structure for temporary golf cart battery charging and storage during a remodel and expansion of the existing structure on April 18,2001. (c) The subject property currently contains a golf course, driving range, clubhouse and ballquet facilities. (d) The subject property is described as Orange County Assessor's Parcel Numbers 130-012-54, 55, 56 and is located along the north side of Lampson Avenue, east of Seal Beach Boulevard. (e) The sun'ounding land uses and zoning are as follows: SOUTH: EAST: Commercial uses within the General Commercial (C-2) zone; Los Alamitos Joint Forces Training Base. San Diego Freeway (1-405); Seal Beach Naval Weapons Station. Single-family and Multi-family residential development in the Residential Medium Density (RMD) and Residential Low Density (RLD) zones. Commercial uses within the General Commercial (C-2) zone; Single- family residential development within the Rossmoor community (unincorporated Orange County). NORTH: WEST: (f) As of Jal1Uary 3, 2008, Staff has received no comments, written or otherwise, in response to the hearing notices that were mailed and published for the proposed project CUP 07-16 Section 5. Based upon the facts contained in the record, including those stated in 94 of this resolution and pursuant to 9928-1900 through 28-1903; and 28-2503 of the City's Code, the Plal1l1ing Commission makes the following findings: (a) Conditional Use Permit 07-16 for the addition of approximately 5,067 sq. ft. of banquet space; 281 sq. ft. bridal suite; and an outdoor courtyard including a swimming pool and spa at 3901 Lampson Avenue, Seal Beach, is consistent with the provisions of the Land Use Element of the City's General Plan, which provides a Recreational Golf (R-G) zoning designation for the subject property and permits a golf courses, driving range, and other recreational uses by right, and a cocktail lounge, subject to the issuance of a conditional use pernlit. The use is also consistent with the remaining elements of the City's 20f5 Planning Commission Resolution 07-64 Conditional Use Permit 07-16 Old Ranch Counl1JI Club Jal1umy 8,2008 General Plan, as the policies of those elements are consistent with, and reflected in, the Land Use Element. Accordingly, the proposed use is consistent with the General Plan. (b) The building and property at 3901 Lampson A venue are adequate in size, shape, topography and location to meet the needs of the proposed use of the property. The property is approximately 154.19 acres in area, and wi 11 provide an adequate number of parking spaces (c) The building and property at 3901 Lampson Avenue, as conditioned, meets all criteria for golf courses, as set forth in the Code. (d) A golf course alld driving range have operated on the property since 1967 with no known history of complaints regarding impacts associated with the use. (e) Operation of the golf course, driving range, and accessory uses would be compatible with the surrounding uses and the community in general. Section 6. Based upon the foregoing, the Planning Commission hereby approves Conditional Use Pennit 07-16, subject to the following conditions: 1. CUP 07-16 is approved for an addition of approximately 5,067 sq. ft. of banquet space; 281 sq. ft. bridal suite/lounge; and an outdoor courtyard including swimming pool and spa. 2. All construction and development shall be in substalltial conformance to plans submitted as part of the application for CUP 07-16 dated October 22,2007, as wen as the revised floor plans submitted December 19,2007 3. The property shall maintain a minimum of 316 individual parking spaces at all times, per submitted plans, with a maximum of25% compact spaces, while open to members or the public. 4. Staff reserves the right to require valet services or other alternate means for parking if, in the future, Staff determines that required parking provided on-site is functionally inadequate for large events, or as deemed necessal-y. 5. The establishment shall comply with Chapter 7.15, "Noise" of the City of Seal Beach Municipal Code, as the regulations of that Chapter now exist or may hereafter be anlended. Should complaints be received regarding noise generated by the establishment, the Planning Commission reserves the right to schedule this permit for reconsideration and may require the applicant/business operator to mitigate the noise level to comply wi th the provisions of Chapter 7.15. 30f5 Planning Commission Resolution 07-64 Conditional Use Permit 07-16 Old Ranch Country Club Janumy 8, 2008 6. In the event that staff detemlines security problems exist on the site, the Conditions of this pennit may be amended, under the procedures of The Code of the City of Seal Beach, to require the provision of additional security measures. 7. Unless otherwise superseded by conditions of this Conditional Use Permit, all existing conditions of CUP 92-14 remain in full effect. 8. A modification ofthis Conditional Use Pennit shall be applied for when: a. The establishment proposes to change its type ofliquor license b. The establishment proposes to modify any of its current Conditions of Approval. c. There is a substantial change in the mode or character of operations of the establishment. 9. All lighting shall be designed and located so as to confine light rays to the premises through directional type lighting or shielding on wall or pole mounted lighting that prevents light spillover to adjacent properties. Lighting shall be maintained in such a way to minimize impacts to adjacent properties yet provide adequate security lighting. 10. Landscaping shall be provided within the site pursuant to Section 28-1902 of the Code of the City of Seal Beach. 11. Pemlanent watering facilities shall be maintained for all landscaped areas. 12. Landscaping shall be maintained in a neat, clean and healthy condition. This shall include proper pruning, mowing of lawns, weeding, removal of litter, fertilizing, replacement when necessary, and the regular watering of all plantings. 13. AU exterior areas ofthe property shall be kept fTee of trash, weeds, debris, and graffiti. 14. This Conditional Use Pennit shall become null and void unless exercised within I year of the date of final approval, or such extension of time as may be granted by the Planning Commission pursuant to a written request for extension submitted to the Department of Development Services a minimum of 90 days prior to such expiration date. 15. This Conditional Use Permit shall not become effective for any purpose unless/until a City "Acceptance of Conditions" form has been signed by the applicant in the presence of the Director of Development Services, or notarized and returned to the Planning Department; and until the 1 0 calendar-day appeal period has elapsed. 16. The applicant shall indenmify, defend alld hold hannless City, its officers, agents and employees (collectively "the City" hereinafter) from any and all claims and losses whatsoever occurring or resulting to any and all persons, finns, or corporations furnishing or supplying work, services, materials, or supplies in connection with the perfonnance of the use permitted hereby or the exercise of the rights granted herein, and any and all 40f5 Planning Commission Resolution 07-64 Conditional Use Permit 07-16 Old Ranch Cot/ntly Club Jam/my 8, 2008 claims, lawsuits or actions arising from the granting of or the exercise of the rights permitted by this Conditional Use Permit, and from any and all claims and losses occurring or resulting to any person, fiml, corporation or property for damage, injury or death arising out of or connected with the perfonnance of the use permitted hereby. Applicant's obligation to indemnify, defend and hold harmless the City as stated herein shall include, but not be limited to, paying all fees and costs incurred by legal counsel of the City's choice in representing the City in connection with any such claims, losses, lawsuits or actions, expert witness fees, and any award of damages, judgments, verdicts, court costs or attorneys' fees in any such lawsuit or action. l7. Failure to comply with any of these conditions may result 111 revocation of this Conditional Use Permit.
