A Resolution determining the unpaid assessments for the work done and improvement made on and along Main Street from Ooean Avenue to the Coast Boulevard, and the aggregate amount thereof; that bonds be issued upon the security thereof; prescribing the denomination of said bonds and providing for the issuanoe of the same in annual series. WHEREAS.' a warrant and assessment dated the 18th day of February. 1926 was issued for the work done and improvement made on and along Main Street from Ocean Avenue to the Coast Boulevard. an open public street in the Oity of Seal Beaoh, California, which 'llOrk and improvement is briefly des- cribed in Resolution of Intention No. 134 passed on the 4th day of June. 1925, and ordered done and made by Resolution No. 135. passed on the 2nd day of July. 1925. and was done and made by A. E. PRINK, under contract awarded to him on the 20th day of August, 1925; and, WHEREAS. on the 7th day of April. 1926. being after the full expiration of thirty (30) days from the date of the warrant. and no appeal having been taken as provided by the Improvement Aot of 1911. and said warrant and assessment being returned and recorded by the street Superintendent of the City of Seal Beach and after said return was reoorded the Street Superintendent made up and filed wit~'the Clerk of the City of Seal Beaoh, as the C+erk of the Board of Trustees thereof, a complete list of all unpaid assessments, and said Clerk thereupon gave notice of the filing of said list, and that eight o'clock P. M. of ThurSday, the 6th day of May, 1926 at the Council Chamber of the Board of Trustees of the City of Seal Beach was the time therein fixed by her when interested persons might appear before the City Counoil and show oause why bonds shall not be . .. . Resolution Number .......r-; 1 issued upon the security of the unpaid assessments shown on said list, by posting said notioe conspiouously near the Council Chamber door of the City of 8eal Beaoh, on the 7th day of April, 1926, and said notice remained there posted until the 6th day of May. 1926, and by pubihishing said notioe twice in the Seal Beach Post & Wave, a weekly newspaper published in the City of Seal Beach. to-wit. on the 8th day of April, 1926 and the 15th day of April. 1926, the first publioation of which was more than five full days before the time therein fixed for suoh hearing; and WHEREAS. the Board of Trustees of the City of Seal Beaoh was in session and duly convened at the time and place in the said notice specified and provided for hearing the objec- tions presented, and no interested or other person appearing to show cause or did show oause why bonds should not be issued upon the security of the unpaid assessments or objected thereto; IT IS, THEREFORE, NOW, BY THE BOARD OF TRUSTEES OF THE OITY OF SEAL BEACH DETERMINED. Second: Bonds shall be issued upon the security 1li of the unpaid assessments Shown on the list thereof, as herein 16 above determined, for the aggregate principal of the sum of un- 17 paid assessments, to-wit: $8447.46; payable to A: E. PRINK or , \ ~ bearer. and shall be payable in fifteen annual series on the 2nd 111 day of July of each year next suooeeding ten months after their 20 date, until the whole sum of the aggregate prinoipal thereof is 21 paid. Said bonds and eaoh of them shall bear interest at the rate 22 of 7% per annum from the 7th day of April, 1926, the date of the ~ filing with the Clerk of the Oity of Seal Beach of the Street 24. Superintendent's list of unpaid assessments, until the whole sum 25 of principal and interest is paid, the interest shall be paid 26 semi-annually by coupons on the 2nd day of January and July 27 respectively of each year after the date of the bonds; provided. II 28 that the first payment of interest shall not beoome due until the 211 2nd day of January. 1927. being six months before the maturity 30 of the first annual series of the bonds. 81 The bonds and interest shall be paid at the offioe 82 of the Treasurer of the City of Seal Beaoh in said Oi ty, County of - 5 - I I I .23 i......::...~. Resolution Number ~.~- 1 Orange, State of California, on the presentation of the proper ooupons and bonds out of the redemption fund, -and under no oiroumstances shall said bonds or interest thereon be paid out of any other fund. A redemption fund shaJ.l be kept by the Treasurer of the City of Seal Beaoh designated "Main 8treet Improvement from Ooean Avenue to th!3 Coast Boulevard Redemp~ion Fund", in whioh the Treasurer shall plaoe all sums reoeived~~om the oo11eotion of assessments made for the payment of the oost of the work and improvement upon whioh the bonds are issued, and the interest and penaities thereon. All of said bonds shall be dated the 6th day of May, 1926, and shall be numbered consec~tively from 1 to 30 inclusive. The form of the botli shall be substantially as provided by Seotion 6 of the "Improvement BODd,Aot of 1915", provided that the same shall contain the appropriate words and figures to make said bonds and the form thereof applioable to the denomination, annual series and purposes for which the bonds are to be issued as herein set forth. The bonds shall be signed by the Treasurer and Clerk of the City of Seal Beaoh. There shall be attached to each bond interest coupons representing the payments of semi-annual interest and made payable upon the prinoipal of the bonds to which they are attached; all of said bonds shall be signed by the Treasurer of the City of Seal Beach, but the Treasurer's signature may be engraved, printed or lithographed on the interest ooupons in place of the Treasurer's signature by hand. 17 18 19 20 21 22 24 25 26 27 28 29 so 31 32 - 6 - I I I The interest ooupons shall be oonseoutively numbered from 1 upward on eaoh bond; and the interest thereby represented shall be paid on the 2nd day of January and July suoceeding the 7th day of April, 1926; provided that the coupons representing the firs~ payment of interest shall become due the 2nd day of January, 1927, being six months before the maturity of the, first annual series of the bonds, and shall be for interest aooruing thereon from the 7th day of April, 1926 to said date. . Bonds numbered 1 and 2 shall constitute annual series NO.1, and shall fall due and be payable on the 2nd day of July, 1927, being the 2nd day of July next succeeding ten months from the 6th day of },(ay, 1926, the date of said bonds.
