DANGEROUS WEEDS GROWING UPON THE STREETS AND

WHEREAS, there a.re growing upon the streets or sidewa.lks
or upon private property within the City of Seal Beach, 'California.,

weeds which'bear seeds of win~ or downy nature, or attain such a

large growth as to become a fire menace when dry or which are other-

wise noxious or danger~us upon the streets or sidewalks in front of,

12 or upon, the property hereinafter described, which the Board of Trust-
13 ees and City Council of the City of Seal Beaoh do hereby deolare to
14 be a public nuisance,
RESOLVED, THEREFORE:
That the Board of Trustees and City Council of the City
17 of Seal Beaoh do hereby deolare all weeds growing upon the streets
18 or sidewalks in front of. or upon, the private property upon the
19 following str~ets within the City of Seal Beach to be a publio nui-
20 sanae. That the streets within said City of Seal Beach and the lots
21 and block numbers of the property on or in front of which nuisance
22 exists are as follows:

22 That the Street Superintendent of the City of Seal Beach, Cali-
23 fornia, shall cause to be conspicuously posted in front of the pro-
24 perty on which 01' in front of which such nuisance exists at not more
25 than 100 feet in distance apart, but not less than three in all, notio s
26 headed IINotice to Destroy Weeds II , such heading to be in words not less
27 than one inch in height and substantially in form prescribed by law;
28. That said notice shall be posted at least five days prior to the
29 time for hearing objections by the said Board of Trustees of the City
30 of Seal Beach; that Thursday, the 2nd day of April, 1931, at the hour
31 of 8:00 o'clock P. M. of said day is the day and hour and the council
32 chamber in the City Hall of the City of Seal Beach is the place fixed

1 any objection to the proposed removal of weeds may appear before the
2 Board of Trustees and show cause why said work should not be carried
3 out in accordance with this resolution.
4 That the proceedings for the aforesaid improvmnents shall be had
o and taken under and in accordance with an act of the legislature of
6 the State of California designated and known as "Act 5197", being an
7 act authorizing municipalities to declare noxious or dangerous weeds
8 growing upon the streets or iidewa1ks. or upon private property within

~ ~unicipalities, to be a public nuisance, creating a lien upon the
, .
10 property fronting upon such streets or sidewalks or upon which such
11 nuisance exists for the cost of abating the same, and approved May
12 26, 1915.
13 That subsequent to the said hearing the said B08.l'd of Trustees
14 shall or-del' the Street Superintendent to abate said nuisance by having
15 the weeds referred to ramoved in the manner provided by law, and the
16 cost th~reof shall be a lien upon the property fronting upon such
~ ,
17 streets or sidewalks or upon which such nuisance exists for the cost
18 of abating the same, which amount shall be added to the respective
19 asaessments for taxes against the respective lots and parcels of land
20 for municipal purposes and collected at the same time and in the same
, '
21 manner as ordinary municipal taxes are collected and sha~l be subject
22 to the same penalties and the same procedure under foreclosure in case
23 of delinquency as provided for ordinary municipal taxes.
24 The City Clerk shall cause this Resolution to be posted in at
25 least three publio places in the City of Seal Beach and it shall
26 ther~f.9re take effect.

28 gularly introduced and adopted by the Board of Trustees of the City of
29 Seal Beaoh at a regular meeting thereof held on the 19th day of March,

AFFIDAVIT OF POSTING NOTICE TO
DESTROY WEEDS
E. F. SLAYTON, being first duly sworn, deposes and says:
That he is the Street Superintendent of the City of Seal Beach,
a Munioipal Corporation of the Sixth Class duly organized under the
laws of the State of California; that he has caused to be conspicu-
ously posted in front of each parcel of real property upon which, or
9 in front of which, certain noxious or dangerous weeds were either
growing upon or in front of what certain real property in the City of
Seal Beach as declared by the Trustees and City Council of said City
in Resolution No. 181. adopted March 19, 1931, and as more particular
ly descDibed in said resolution on file in the office of the City Cle
of said City of Seal Beach, and referred to in the Notice to Destroy
15 Weeds hereto attached and made a part hereof, and that said Notices
were posted as required by said Resolution, and as required by law,
at least five days prior to the time ~et therein for hearing of ob-
jections to the abatement of such nuisance, and that posting of such
Notices was completed on or before March 27. 1931, all of which is
true as I verily believe.

Notice is hereby given that on the 19th day of March, 1931, the
Board of Trustees ana City Council of the City of Seal Beach, Cali-
fornia. passed a resolution, No. 181, declari~ that noxious or dan-
gerous weeds were growing upon or in front of the propertl in said
City of Seal Beach. and more particularly described in sa1d resolutio) ,
which is on file in the office of the City Clerk of said city, and .
that the same constitute a public nuisance which must be abated by
the removal of said noxious or da~erous weeds otherwise they will
be removed and the nuisance will be abated by the municipal authori til s,
in which case the cost of such removal shall be assessed upon the loti
and lands from which or in front of which such weeds are removed, and
such cost will constitute a lien upon such lots or lands until paid.
Reference is hereby made to 'said resolution for further particulars.
All property owners having any objections to the proposed remova:
of such weeds are hereby notif1ed to attend a meeting of the Trustees
and City Council of said City of Seal Beach, California. to be hald
Thursday, Apri~ 2, 19B!, when their objections will be heard and give)
