RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF SEAL BEACH, COUNIY OF ORANGE, STATE OF CALIFORNIA, DECLARING THEIR INTENTION TO IMPROVE OCEAN AVENUE IN THE SAID CITY, FROM FIRST STREET TO ELECTRIC AVElIlUE, AND ALSO A PORTION OF FOURTH STREET IN THE SAID CITY FROM OCEAN AVENUE TO THE FIRST ALLEY NORTH- EASTERLY THEREFROM. RESOLVED, by the Board of Trustees of the C~ty of Seal Beach, Oounty of Orange, State of California, as follows, to-wit: Section 1. That the public interest and convenience re- quire, and that it is the intention of the Board of Trustees of the said City to order the following work to be done and improvementt, to be made in said city, to-wit: First: That the roadway space of Ocean Avenue in the said City, from the Southwes~erly prolongation of the South- easterly line of First Street to the Southwesterly line of Eleotric Avenae, including all intersections of streets, bel graded and paved with a three and one half <3,) inch asphaltio , concrete base, and a one and one-half (It) inch asphaltic concrete (Topeka) wearing surface; excepting, however, from all of the above described work, suoh portion as has already been graded and paved with Portland oement concrete, all as particularly indicated on and in aocordance with the plan and profile hereinafter mentioned. Second: That conorete curb be constructed at certain plaoes along each line of the roadway of said Ocean Avenue, within the limits above defined, including ourb returns at oertain street interseotions within the said limits as par- tioularly indicated on and in accordance with the plan and profile hereinafter mentioned. Third: That ooncrete sidewalk be construoted at aer- tain places along each side of said Ooean Avenue, within the limits above defined, including the area within the adjaCent curb returns, and the prolongation of the side lines of the - 1 - 1 I 1 , 1 2 3 4 6 6 7 8 9 10 11 12 13 14 16 16 17 18 19 20 21 22 23 24 26 26 27 28 29 30 31 32 . . intersecting streets at certain street intersections within the said limits as particularly indicated on and in accordenoe with the plan and profile hereinafter mentioned. Excepting, however, from all of the above described work, suoh portion as is required by law to be kept in ord~ or repair by any person or company having railroad tracks thereon. Fourth: That a concrete curb be constructed along the Northwesterly line of the roadway of Fourth Street in the said City, from the Northeasterly line of the said Ocean Avenue to the Southwesterly line of the first alley North- easterly from the said Northeasterly line of Ocean Avenue, including a curb return at the Southwesterly corner of the intersection of the said Fourth Street with the said alley as particularly indicated on and in accordance with the plan and profile hereinafter mentioned. Fifth: That a concrete sidewalk fivs (5) feet in width be constructed along the Northwesterly side of the said Fourth Street within the limits above defined, as par- ticularly indicated on and in accordance with the plan and profile hereinafter mentioned. All of the above described work shall be done in accord- ance with Plans and Profiles No. 1 (New Series) , and No. 2 (New Series), on file in the office of the City Engineer of the said City,. and in further aocordance with Specifications No.1 (New Series), on file in the office of the City Clerk of the said City. The said Plans, Profiles and Specifications are hereby referred to for the full and detailed description., of the said proposed work or improvement, and are made a part hereof. The grade to which the work herein provided for shall be done, and the improvement made, shall be different from the official grade which has heretofore been formally estab- - 2 - I I I . 1 2 3 4 6 , . ~ , lished and such different or new grade shall be that shown on the plans and profiles therefore, hereinbefore mentioned, ~n file in the offioe of the said City Engineer, to which said plans and profiles reference is hereby made for the d4scription of such grade. 6 Seotion 2: That the said contemplated work or impro- 7 vement in the opinion of ,the said Board of Trustees, is of 8 more than local or ordinary publio benefit, and the said 9 Board of Trustees hereby declare that the district in the 10 said City of Seal Beach to be benefited by the said work or 11 12 13 14 16 16 17 18 19 20 21 22 23 24 26 26 27 28 29 30 31 32 improvement and to be assessed to pay the cost and expense thereof, is described as follows: All that portion of the said City of Seal Beach, in- cluded within the following described exterior boundary li88, to-wit: Beginning at the Northerly corner of Lot 18, Block 1, of Bay City, as shown on a Map thereof recorded in Book 3, page 19, Miscellaneous Maps, Records of Orange County, Cal- ifornia, and running thence Southeasterly in a direct line . to the Easterly corner of Lot 17 of said Block~;thence Southerly, in a direct line, to the Northerly corner of Lot 14, Block 2, of said Bay City; thence Southeasterly, in a direct line, to the easterly corner of Lot 13, Block 3, of said Bay City; thence Easterly, ~n a direct line, to the N~ therly corner of Lot 18, Block 4, of said Bay City; thence Southeasterly, in a di~eot line, to the Easterly corner of Lot 17, Block 4, of said Bay City; thenoe Easterly, in a direct line, to the Northerly corner of Lot 24, Block 5, of said Bay City; thence Southeasterly, in a direct line, to the Easterly corner of Lot 23, Block 11, of said Bay City; thence Easterly, in a direct line, to the Northerly corner of Lot 32, Block 12, of said Bay City; thence \ - 3 - I I, I . 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 26 26 27 28 29 30 31 32 : ~ .. Southeasterly, in a direct line, to the easterly corner of said Lot 32; thence Southerly, in a di~eot line, to the Northerly corner of Lot 29, said Block'12; thence South- easterly, in a di~eot line, to the Easterly corner of Lot 30, Block 13, of said Bay City; thence Southerly, in a di~ect line, to the Northerly corner of Lot 25 of said Block 13; thence Southeasterly, in a direct line, to the Easterly corner of Lot 26, Block l~, of said Bay Vity; thence Southerly, in a direct line, to the Northerly oor- ner of Lot 12, Block "A", Tract No.1, as shown on a map thereof recorded in Book 9, page 1, Miscellaneous Maps, Records of Orange County, California; thence Southeasterly, in a direct line, to the Easterly corner of said Lot.l2;, thence Southerly, in a direct line, to the most Northerly oorner of Lot 39, Blook "C" of said Tract No.1; thenoe in a general Easterly direction, following along the Southerly line of the Alley extending Easterly and Wes- terly through the center of said Block lfC", to the Northerly corner of Lot 17 of said Block "C"; thence Southeasterly, in a direct line, along the Southwesterly line of Electric . Avenue, to the Easterly corner of Lot 17, Bloc~ "F", of said Tract No.1; thence in a general Westerly and North- westerly direotion along a line parallel with and distant Southerly lQO feet, measured at right angles, from the Southerly line of Ocean Avenue, to an intersection with the Southwesterly prolongation of the Southeasterly line of First Street; thence Northeasterly, in a direct line, to the point of beginning; excepting therefrom any portion of any public street or alley which may be included within the above desoribed district. Section 3: Said Board of Trustees also determine and a~ notice is hereby given declar~that serial bond~ ~earing interest at the rate of - 4- - 1 I 2 3 4 5 6 7 8 9 10 11 12 13 14 I 15 ~ 16 17 18 19 20 21 22 23 24 25 26 127 28 29 30 31 32 .. .; ~ r seven (7%) per cent per annum shall be issued hereunder, to represent unpaid assessments, in the manner provided by the "Improvement Bond Act of 1915", the last installment of which bonds shall mature fourtee~ears from the seoond day of July next succeeding tien months from their date. Section ~: That Thursday, the 16th day of October, 192~, at the hour of S o'clock P. M. of said day, is the dIY and hour, and the Council Chamber in the City Hall of the City of Seal Beach is the place, fixed by the Board of Trustees when and where any and all persons having any objections to the proposed work or improvement may appear before the Board of Trustees and sh.. cause why said proposed improvement should not be oarried out in accordance with this resolution. Section ?: That the prooeedings for the aforesaid improvement shall be had and taken under and in accordanoe wit~ an act of the Legislature of the State of California, designated and known as the "Improvement Act of 1911", ap- proved April 7, 1911, and amendments thereto, except as hereinbefore stated. Section 6: The Superintendent of Streets shall cause to be conspioiously posted along the line of said contemplated work or improvement, and along all the open stree~s within the distriot liable to be assessed, notice of the passage of this resolution, in the manner and in the form required by law. Section 7: That the City Engineer shallm make a dia- gram of the property affected or benefited by the said pro- posed work or improvement, as hereinbefore described, and to be assessed to pay the oost and expenses thereof. " : Section 8: The City Clerk shall certify to the passage of this Resolution and shall cause the same to be published jlwtce in the Seal Beach Post and Wave, a weekly newspaper published and circulated in the City of Seal Beach, and hereby designated for that purpose by the Board of Trustees, there being no daily newspaper published in said City.
