MINUTES OF PLANNING COMMISSION MEETING OF DECEMBER 20, 1967 The Seal Beach Planning Commission met in regular session on Wednesday, December 20, 1967, 1n the Council Chamber at C1ty Hall. Present: Absent: Boeger, Crowley, Lann1ng, Murphy, Peters None The meet1ng was called to order by Chairman Boeger at 7:35 P.M. Chairman directed the Secretary to send a letter to Mr. Carnes expressing the Commiss10n's thanks for his presence, patience and advice furnished at the public hear1ng for rezoning 1n Leiqure World. Minutes of the meeting of December 6, 1967 were approved as presented. I. Pub11c Hear1ng - Roy A. Walker, V-38-67 Roy A. Walker, 138 12th St., requested a variance to allow a second floor and assoc1ated roof overhang to encroach 5 feet and 7 feet, respectively, into the required rear yard. Property is described as Lots 36 and 38, Block 12, Bay City Tract. No objections were received. Two 1mmediate neighbors expressed their approval as the new construction would be an improvement to the neighborhood. Similar var1ances have been allowed. Mr. C~owley moved to approve as presented. Seconded by Mrs. Lanning and passed unanimously. Resolut10n NO. 193. II. Continued Public Hearing - Ray Herbeck, V-35-67 Add1tional plans submitted showing the elevation of proposed carport to replace converted garage to l1ving quarters. Mr. Crowley moved to deny the var1ance based on the fact that no similar variance had been approved by the Commission, change in the front elevation would be detrimental to the ne1ghborhood, would give owner a privilege den1ed to others and does not meet conditions of State Planning Act. Seconded by Mrs. Lanning and passed unanimously. Resolution No. 194 III. Public Hear1ng - Amendment to Code "Mapped Streets" Proposed amendment to City Code, Chapter llA "Mapped Streets", cons1dered to continue to complete the general plan and to protect the city and citizens for future estab11shment of planned streets as well as set bU1lding lines to conform. After general discussion, Mrs. Lanning moved to recommend the adoption of subject amendment by the C1ty Council. Seconded by Mr..Peters seconded the mother and it passed unanimously. Resolution No. 195. IV. Other Business Mr. Dav1d Stangeland, represented by his attorney, requested an interpretation of the use restaurant or coffee shop serving beer. City Attorney determined that a restaurant or coffee shop with on-sale beer would not be a proper use in a C-l Zone. C-2 Zone is first area where alcoholic beverages are permitted. Mr. Peters moved to determine, if any ambiguity eX1stsp that the use restaurant and coffee shop does not include the sale of beer based on the 1mp11cation in the ordinance under C-2 Zone. Seconded by Mr. Murphy. . . . AYES: Boeger, Crowley. Murphy, Peters NOES: None ABSTAIN: Lanning Resolution No. 1960 Mro Mulqueeney presented a chart with proposed Land Use and Zoning Color Codeo Colors shown conform to statewide standards. Mro Murphy moved to adopt the colors as presented as the official Land Use and Zoning Color Code for the City of Seal Beach. Seconded by Mr. Peters and passed unanimouslyo Resolution Noo 1970 Mr. Boeger announced his resignation as Chairman effect1ve December 31, 1967. Mrso Lanning moved that Mr. Crowley be elected as Chairman for 1968. Seconded by Mr. Murphy 0 AYES: NOES: ABSTAIN: Boeger. Lanning, Murphy.
