MINUTES OF PLANNING COMMISSION MEETING OF NOVEMBER 15, 1967 The Seal Beach Planning Comm1ssion met 1n regular sesston on Wednesday, November l5, 1967, in the Council Chamber at City Hall. Present: Absent: Boeger, Crowley, Lanning, Murphy, Peters None Meeting was called to order by Chairman Boeger at 7:30 P.M. Minutes of the meetings of November l, 1967 and November 8, 1967, approved as presented. I. Pub11c Hearing - Gary Potter, V-34-67 Gary D. Potter, 5926 Atlantic Ave., Long Beach, requested a variance to perm1t construction of a two story duplex with detached garage which would encroach 10u into the required s1deyards and three feet into the required front yard on Lot 13 and Nly 13' of Lot 11, Block 216, Tract No. 10 (213 17th St.). Three ne1ghbors made oral protests and a petit10n was rece1ved from owners of 12 neighboring parcels protesting the front yard encroachment. Mr. Potter stated he thought the 9' front-yard setback met the. requirements and that he was asking for a variance for sideyard only. Mr. Murphy moved to continue the hearing to allow time to revise the plans to meet the front yard requirement. Seconded by Mrs. Lanning and passed unanimously. . II. Plan Review - Bank of America, PR-19-67 Bank of Amer1ca, 208 Main St., Seal Beach, represented by Edward Halsey, Manager, presented preliminary plans for exterior alterations and installation of an identification sign. Mr. Peters moved to approve the plans including the sign as submitted per Sketch #75-5278 dated 10-25-67. Seconded by Mr. Murphy and passed unanimously. Resolution No. 180. III. Plan Review - Bernsteins' of Long Beach, PR-20-67 Bernsteins' of Long Beach, 252 5th St., Seal Beach, presented plans to remodel existing buildings and roof a port10n of present open storage area. Mr. Crowley moved to approve the plans as submitted. Seconded by Mrs. Lanning and passed unanimously. Resolution No. 181. IV. Public Bearing - Clarificat10n of Zoning Ordinance for Ambulance Service The use "Ambulance Service" is not specifically stated in any zone in the ordinance. It is necessary for the Planning Commission to make a determination of the proper zone & controls. Th1s is instigated by a request for a business license. Discussion of necessary controls and parking requirements. Secretary directed to schedule a publ1c hear1ng for an amendment to the ordinance. V. Public Hearing - Proposed Amendment regarding Service Station Locations & Controls 4It General discussion of definition, parking requirements and proper location for automobile service stations. e e . Mrs. Lanning moved to delete the present def1nition of "service station" and add the following definition: "Automobile Service Station - A retail place of business engaged primarily in the sale of motor fuels and supplying only those incidental goods and services which are required in the day to day operation of automotive vehicles and the fulfilling of motorist needs." In addition, the Planning Commission recommends to the City Counc1l the adopt10n of this amendment. Seconded by Mr. Crowley and passed unanimously. Resolution No. l82. Mr. Murphy moved to recommend to the City Council the adoption of an amendment establishing the C-2 Zone as the proper zone for location of automobile service stations subject to the issuance of a conditional use permit with the following statement made a part of the amendment. "It is recognized that the proper location of automobile service stations warrants special consideration because of several important elements of design and operation that are unique and significant such as: total dependence on vehicular traffic. distinctive phys1cal appearance. unenclosed nature of activit1es and long hours of operation. Improper location of an automobile service station caD be detrimental to other uses in the area. In cons1dering a request for this use. the following criteria shall govern, in addition to general criteria listed under Section 2004: (1) Possible effect on vehicular and pedestr1an traff1c. (2) Compatibility with existing or planned uses in the surrounding area, particularly residential or public use. (3) The number of exist1ng automobile service stations in the area. Motion seconded by Mr. Peters and passed unanimously. Resolution No. 183. Mr. Murphy moved to recommend to the City Counc11 adoption of establish required off-street parking for the use "automobile as a minimum of 5 spaces plus 2 spaces for each service bay. Crowley and passed unanimously. Resolution No. l84. an amendment to service stations" Seconded by Mr. . VI. Pub11c Hearing - Proposed Amendment regarding "Drive-In Restaurants" "Drive-In Restaurants" are not specifically defined nor located in a zone except by inference in the present ordinance. After discussion the following definition was established: "Drive-In Restaurant - means a retail food service establishment in uhich all, or a portion of, said food service is to customers remaining in their automobile while on the prem1ses, or in which drive-in customers may park on premises, walk to an outside oriented food service facility and receive or consume food or beverages on the premises but outs1de of the food service building. This definit10n 1ncludes "Drive-Through Restaurants". Mr. Murphy moved to recommend to the City Counc1l the adoption of the above definition of Drive-In Restaurant and establish the C-2 Zone as the proper zone for this use subject to the issuance of a condit10nal use permit. The proposed amendment should include the following Sect10n 1100 (17)(d): (d) Drive-In Restaurant. It is recognized that the proper location of drive-in restaurants warrants special consideration because of several important elements of design and operation that are unique and significant such as: total dependence on vehicular traffic, distinct1ve physical appearance, unenclosed nature of activities and long hours of operat10n. Improper location of a drive-in restaurant can be detrimental to other uses in the area. In considering a request for this use, the following criteria shall govern. 1n addition to general criteria listed under Section 2004: . e e . (1) Possible effect on vehicular and pedestrian traffico (2) Compatibility with existing or planned uses 1n the surrounding area, particularly resident1al or publ1c useo (3) The number of exist1ng drive-1n restaurants in the area. In addit10n, the Plann1ng Comm1ssion shall determine the proper number of on-site parking spaces required for each site for which a conditional use permit is requested.
