DEPARTMENT OF HOUSING AND URBAN
DEVELOPMENT'S URBAN COUNTY PROGRAM
SUMMARY OF REQUEST:
Authorize the City Manager to execute a letter of Intent to participate with the
County of Orange for continued participation in the U.S. Department of Housing
and Urban Development's Urban County Program.
. BACKGROUND:
As a non-entitlement city (population less than 50,000), the City of Seal Beach
receives CDBG funding through a contractual agreement with the County of
Orange (the "Cooperation Agreement")'. The Orange County Community
Resources Department ("OCCR") applies to the federal Department of Housing
and Urban Development ("HUD") for Community Development Block Grant
("CDBG") funding, then divides the funding among its sub-recipients: the non-
entitlement cities; unincorporated areas; and, non-profit organizations eligible for
funding.
The City of Seal Beach has successfully participated in this program for many
years, with the most recently funded project being the restroom rehabilitation
program within Leisure World over the past 3 years at a total funding level of
approximately $600,000.
The formal agreement for this process is through the Cooperation Agreement
described above. The Cooperation Agreements are typically for a 3-year fiscal
year time period and a new agreement is necessary to be able to participate in
the Fiscal Years 2009-2011.

As noted in the transmittal letter from OCCR, the City must notify OCCR and the
HUD Regional office of its intent to participate in the program by May 25. Please
see Attachment 2. Staff recommends that the City Manager be authorized to
execute the requested "Urban County Requalification" letter as presented in
Attachment 1.
FISCAL IMPACT:
None. If the City receives grant funding in the future, the only cost to the City
would be Staff time in administering the projects and grant funds.
RECOMMENDATION:
Authorize the City Manager to execute a letter of Intent to participate with the
County of Orange for continued participation in the U.S. Department of Housing
and Urban Development's Urban County Program.

SUBJECT: City of Seal Beach Letter of Intent to Participate
County of Orange - Urban County Requalification

The City of Seal Beach City Council, at its May 12, 2008 meeting, authorized the
City Manager to execute this letter of intent to continue the City's participation in
the County of Orange - Urban County Program for Community Development
Block Grant funding. Consistent with Notice CPD-08-04 we are sending you and
the appropriate contact person at the Los Angeles Field Office, U.S. Department
of Housing and Urban Development, this letter stating the City's intent to
continue our participation in the Urban County Program. We will be executing an
Contract Amendment to continue our participation in the Urban County Program
at our May 27, 2008 City Council Meeting if the appropriate documentation is
received in a timely matter to allow for the review by our City Attorney and
placement on the City Council Agenda.

This letter is to inform you of two items:

As of April 8, 2008, the County Board of Supervisors approved a reorganization that changed the name of Housing and
Community Services (HCS) to OC Community Services a division of OC Community Resources.

On March 18, 2008, OC Community Services transmitted a letter to your attention addressing the County's requalification for
entitlement status as an Urban County program. This process requires renewing or amending our current Cooperation
Agreement with participating small cities and metropolitan cities for the next three (3) year period (FY 2009-11). The U,S.
Department of Housing and Urban Development (HUD) has not yet released the 2008 CPO Notice. but has instruded Urban
Counties to utilize the CPO 07-03 Notice (attached) to facilitate the requalification process until the 2008 CPO Notice is
approved and released by HUD.
If you are a Cooperating Small City or Metropolitan City and would like to participate in the Urban County program, renew your
participation in the Urban County program, or end your participation in the Urban County program, you must notify the County
and the HUe Field Office in writing on or before Ml!IY 25 2008 at the following location:

OC Community Services Is presently working with County Counsel to determine whether or not the County will be able to
amend the existing Cooperation Agreement or be required to draft a new agreement. The existing Cooperation Agreement
incorporated a provision that allowed automatic renewal of the agreement without going back to the County Board of
Supervisors, provided there were no substantial changes outlined in the 2008 Notice. HUD requires a legal opinion of approval
from the County as weD as a legal opinion from each Cooperating City. We have attached a copy of the City's current

Cooperation Agreement and ask that you have your legal counsel review and provide a legal opinion regarding amending the .
term of the current agreement to renew for an additional 3 years (FY 2009-11).
We are not anticipating any changes in the 2008 CPO Notice and will forward you either a new Cooperation Agreement or an
amendment of the existing Cooperation Agreement under a separate cover letter as soon an the 2008 CPD Notice is released.
Unfortunately HUD's timeline is very short for turn around of the agreements. We anticipate at this time requesting executed
amendments and/or new Cooperation Agreements with corresponding legal opinions to be returned to our office by early June.
Please send in writing your intention to participate or not participate in the Urban County program by May 25, 2008. Should you
