The meet1ng was opened at 7:35 P.M. by Cha1rman Knapp and V1ce Cha1rman MOrr1& led the Pledge of Alleg1ance to the Flag. Present: Absent: Dorr, Knapp, Morr1s, R1pperdan Lanning Mrs. Lanning's absence was excused because of illness. The m1nutes of the meet1ng of October 7, 1Q70, were approved as presented. 1. Pub11c Hear1ngs A. Bruce Roberts (Carl H. Irw1n), V-2l-70 Bruce Robertq, 1705 Bayou Way, Seal Beach, represented by Carl H. Irw1n, requested a var1ance to permit construct1on of a duplex at 1611 Seal Way w~th tandem park~ng and upper story rear yard encroachment up to 4 ft. of the rear lot 11ne. S1m11ar var~ances have been granted. Mr. Thompson, 1608 Ocean, and Mrs. Linnell, 1614 Ocean, protested that the residents do not uqe tandem parking and congest1on of the area is ~ncreased. D1Scuss10n held regarding proposing an amendment to the ord~nance a11ow1ng tandem park~ng. The Secretary pointed Outl that a period of t~me was necessary to f1nd if tandem park1ng 1S satisfactory prior to recommend~ng an amendment to the ordinance. Hearing closed. Mr. Morr~s moved to approve the var~ance request subject to the cond1t10n that s~deyard fences be held back 6 ft. from the rear property 11ne for vis10n clearance. Seconded by Miqs Dorr and passed unan1mous1y by the members present. Resolution No. 493. B. James & Carol Conrad, V-22-70 Mr. and Mrs. Conrad, 501 R1v1era Dr., Seal Beach, requested a var1ance to perm1t converS10n of the eX1st~ng garage into 1iv~ng quarters encroaching 3 feet into the front yard setback. A new garage fac1l~ty to be constructed meet1ng all m1nimum requ1rements. No protests were rece1ved. It is an unusual lot with ample open yard space rema1n~ng. In the same area and zone, 11ving quarters are allowed to encroach into the front yard when constructed over the ex~sting garage. Hear~ng closed. M1SS Dorr moved to approve the variance. Seconded by Mr. R1pperdan and passed unan~mous1y by the members present. Resolut10n No. 494. 2. Oral Commun1cat10ns Mr. Foster Cook, Mr. Ph11 Frazer, and Mr. Tom Bert requeqted to r1ght to speak on Item 7(A) of the agenda. 3. Written Commun1cat10ns A letter was received from Bert Roll regarding the study of the serVEe stat10n ordinance. Th1s will be held and included w1th the staff report at a future meeting. Twelve communcations were rece1ved concerning Item 7(a) of the agenda and w1l1 be presented with that item. . . / . e e 4. Unf1n1shed Bus1ness A. Cuthbert Jackson (B111 Gearhart), UV-5-70 Applicant appealed den~a1 of UV-5-70. Since reV1S10ns have been made in the plans the C1ty Attorney adv~sed the C1ty tounc~l to refer the case back to the P1ann1ng Comm1ss10n as an amended app11cat10n. Rev1sed app1~cat~on requests a Use Variance to perm1t an R-3 use in a C-2 zone and a variance from the max~mum hei~ht 11mitation. Twelve written commun1cat10ns favor1ng the request were rece1ved all 1nd1cat1ng the development was preferable to an empty lot and the "R" use ll7aS more compatible w~th the neighborhood and "C-2" use would be. Mr. Phelan, 1524 Mar1ne, spoke in favor of the request. Mr. Cook, Mr. Fraser and Mr. Berk spoke 1n opposit10n stating the bui1d~ng out of proportion for the area, congest~on would increase, he1ght var1ance could set a precedent, privacy in the Br~dgeport development would be lost and that 1t would l~mit future development of commerc1a1 areas. Mr. Strong, 223 4th, opposed the proposal because of n01se, parking and congest10n problems. Mr. Thompson, Clipper Way opposed the request. Mr. Gearhart stated he would rev~se the building he1ght to not exceed the max1mum of 35' and pointed out that all R-3 setback requirements,'parking and un1t S1zes had been met w1th the average apartment size 1,250 sq. ft. He also pointed out that a 35 ft. commerc~a1 building could be bU11t on this locat1on and be more detrimental to the area. Mr. B~ll Sm1th, the ad+acent property owner stated he d~d not oppose the residential use and asked quest10ns regard1ng the locat~on and he1ght of the fence. Mr. Jackson stated ~hat he felt concern for the 1mmediate ne~ghbors and the proposed building would not rob them of sun or seabreeze by 1tS 10cat10n; the parking to be provided as well as street parking on both sides of Marina Dr. should be suff1cient for the area. M1ss Dorr adv1sed that she had inspected the area and felt the balconies proposed would not be used enough to invade pr1vacy of the ne1ghbors, the 10cat10n would better handle 5 - 6 un1ts 1nstead of the 7 proposed, the streets would be able to handle traffic and the community st1l1 needed commercial development, otherwise thought the proposal appropriate. Mr. R1pperdan expressed concern over the park1ng arrangement, quest10ned the buttresses and balconies and expressed some concern over the dens1ty. He also asked about the location of support columns ~n the park1ng area. Mr. Knapp felt that care I'lust be taken in the use of "c" zoned property. Mr. Morr1s expressed h~s opinion that residential use 1n th1~ particular area more compat~b1e. Mr. Phelan pointed out that w1th the Seaport V111age adjacent to the area, local commerc1a1 shops at 5th & Marina, the Shopping Center and Main Street busine~ses, it would not be pract~ca1 to develop th1s small area as commerc1a1. Mr. R1pperdan aga1n spoke stating he did not object to the res1dentia1 use, but had reservations about some details. Mr. Gearhart advi~ed these were pre1~m~nary plans and the final plans could conform to any standards the Comm1ssion des~red. Mr. Morris moved to grant the Use Var1ance for R-3 use with a variance for a height of 42 ft. Mot10n fa1led for lack of a second. Mr. Knapp moved to approve the variance with the he1ght limited to 35 feet, and condit10ned upon revis~on of park1ng and columns. Seconded by Mr. Morr1s. Mr. Ripperdan asked how the revision would be approved or contro1ed. D1scussion followed. Motion w1thdrawn w1th the consent of the second. Mr. Knapp moved to approve UV-5-70 with the height l~mited to 35 ft., and subJect to Plan Review as well as aff1rmation by the C1ty Council. Seconded by Mr. Morr~s. Bernard Solomon, PR-50-70 Mr. Solomon requested an approval of a temporary sales off1ce to be used in conjunct1on w1th an approved condom1nium development in the Rossmoor Cent~r area. He d1sp1ayed a layout of the tra11er-type office wh1ch would be decorated inside and landscaped on sides and front, and have a scale s~ze model apartment. Mr. Knapp moved to approve the plan reV1ew w1th the cond1tion that 1andscap1ng be provided and for a period of one year from the date of f11ing of the subd1vis10n map. Seconded by Mr. R1pperdan and passed unan1mous1y by the members present. Resolution No. 496. B. Mr. & Mr~. E. S. Brady, PR-5l-70 Mr. & Mrs. Brady presented plans for the construct10n of a s1ng1e fam11y res1dence at 85-A Surfside. A letter from the Board of Directors of Surfside Colony, Ltd. dated September 22, 1970, was received indicating their approval of the plans. Miss Dorr moved to approve PR-51-70. Seconded by Mr. Morris and passed unan1mous1y by the members present. Resolution No. 497. 6. Secretary's Report Mr. Neprud adv1sed the Comm1SS10n of progres~ in study of serv1ce stat10n ~tandards and furnished a proposed letter to operators for the~r comments.
