MINUTES OF THE PLANNING COMMISSION MEETING OF NOVEMBER 1, 1972 The Planning Commission of the City of Seal Beach met in regular session in the Council Chambers at the City Administration Building. The meeting was opened at 7:30 p.m. by Chairman Ripperdano The Pledge of Allegiance was led by Commissioner Knapp. Present: Absent: Hammond, Lanning, Knapp, Ripperdan Dunn Mr. Dunn's absence was excused. The minutes of October 18, 1972. were approved as corrected. The Secretary reviewed the procedure for giving testimony during public hearings. l. Public Hearings A. John Palmer (Richard Moody), V-51-72 (continued) Request is for a single family residence in Surfside with an exterior side yard of one foot and parking to enter from Anderson St. Hearing opened. Richard Moody, 16325 So. Pacific Ave., Sunset Beach, was present representing the applicant. He stated that the lot was small and a corner lot which should not need the required exterior setback. Parking would be off:of Anderson St. so as to not obstruct egress for the rest of Surfside Colony. Mr. Moody objected to the engineering conditions relating to the paving of the extension of Anderson St. He maintains that minimal paving should be required with no curb, gutter or sidewa1ko Bill Bruten, B-61, Surfside, representing the Board of Directors of Surfside Colony, Ltd., spoke in favor of the request and in favor of minimal paving of Anderson Sto Secretary explained the code reasons for requiring a side yard setback, the reasons for requiring the fu11'improvements to all dedicated streets when improvements are proposedo Secretary pointed out that a utility type pole was located directly in front of the proposed parking access to the garages. Mr. Moody indicated that it was a fire alarm poke, now non- functional and he planned to ask the owners of the pole to remove it. Hearing closed. Knapp moved to deny V-5l-72 for the reasons that no hardship was shown for the one foot side yard and that the applicant would not agree to install full street improvements on a dedicated streeto Seconded by Mrs. Lanning and passed unanimously by members present. Resolution No. 695. The Secretary advised the applicant of his right of appeal. B. Jack & Jean Moiseiff, V-53-72 Request is for a balcony addition, replacement of a two car gar~ge with a three car carport (with less than required parking space width) and an addition above the carport to a nonconforming duplex in the R-3 Zoneo Hearing opened. Mr. Moiseiffll 7723 Elden Ave., Whittier, stated that the carport would be set back 9 feet on the first levelo Mrs. Globus, 1101 Seal Way, asked about the existingtfence between her property and the applicant's property. Secretary advised that the fence is a civil matter between the two property owners. Mr. Serban, 1103 Seal Way, objected to a carport because of the noise associated with carports. Mr./Moiseiff stated that the carport would remove one extra car from the street and that noise was due to cars in the alley regardless of the . . . e . type of parking provided. Public hearing closed. Mrs. Lanning moved to approve V-53-72 with the engineering and staff conditions, seconded by Mr. Ripperdan and passed unanimously by members present. Resolution Noo 696. C. H. A. Ericksen, V-54-72 Request is for a four unit apartment building with tandem parking in the R-3 zone. Public hearing opened. Mr. Ericksen, 127 6th St., stated that this proposal contained two less units than were normally constructed on a lot of this size and that the tandem parking was necessary in order to provide the required number of parking spaces. Hearing closed. Mrs. Hammond moved to approve V-54-72 subject to the engineering and staff conditions. Seconded by Mr. Knapp and passed unanimously by members present. Resolution No. 697. D. Consideration of Addition to the Interim OPEN SPACE/RECREATION ELEMENT Secretary suggested that the hearing on this subject be considered after Agenda Item 7 A. Chair so ordered. 2. Oral Communications Robert Deanstag, 4209 Candleberry, Seal Beach, asked about the criteria for Environmental Impact Statements. Secretary advised that this matter would be covered in the "Report from Secretary." 3. Written Communications D. M. Callis, 4506 University Ave., Riverside, requested an extension of time for Variance V-3l-72. His letter was read which asked for a one year extension on the time limit to begin work on the proposed construction. Variance was approved in February, 1972. Mr. Ripperdan moved that an extension be granted from February 2, 1973 to February 2, 1974. Seconded by Mr. Knapp. A YES: NOES: ABSTAIN: ABSENT: Ripperdan, Knapp, Hammond None Lanning Dunn Motion carried. Resolution No. 698. 4. Unfinished Business A. Continuation of Discussion of Subdivision Ordinance Mr. Little of the Engineering Department reviewed the changes and modifications that had been incorporated in the proposed subdivision ordinance. These included a park standard of 4.0 acres/lOOO population for new development, and credits for private recreational facilities for up to 50% of the costs of these improvements. Jay Covington, 4557 Candleberry, asked about the provision for subdivisions of 50 lots or less and questioned if this applied to 50 units also. Secretary indicated that this provision applies to 50 lots only. Chair requested staff to modify this provision to cover 50 units as well as 50 lots. This matter to be discussed further at the Planning Commission meeting of November 15. . . . e . B. Consideration of Addition to the Interim OPEN SPACE~RECREATION ELEMENT Secretary suggested that this matter held over to the Planning Commission meeting of November 15 and it be considered after considering the proposed subdivision ordinance. Chair so ordered. c. 7.85 acre Bixby Parcel, Continuation of Discussion of Highest and Best Use Secretary reviewed a report from the City Manager's office regarding the different types of available funding and bonding which could be used by Seal Beach for purchase of land for open space purposes. Members of audience commented on some local opinion in the College Park East area. Letter from the Naval Air Station, Los Alamitos, was read which clarified the position of the Navy regarding residential building near the runway ends and proposed future uses of the Air Station. In addition, reports of aircraft accidents in the area were reviewed by the secretary. Chair ordered this matter to be held over until November 15 and possibly the Planning Commission would make a decision regarding this property. 5. New Business A. Report on Success of Four Months of Restricted Parking in Portions of Coastal District Secretary presented a follow-up report on the first summer of restricted parking in the coastal district. Some minor procedural problems were pointed out. The consensus by the city staff and citizens was that the program was a success. Mrs. Lanning requested that a card be sent to Lois Arnold expressing sympathy and appreciation for her help over the years. 6. Report from Secretary Secretary stated that the City Council adopted an Environmental Evaluation Form by minute order during the last Council meeting. The form and procedure for processing them was explained as well as the procedure for the Environmental Impact Report evaluation. Secretary stated that Surfside Colony Board of Directors requested a joint meeting with the Planning Commission at the convenience of the Commission. Commission requested the joint meeting to be heJd on November 8th at 7:30 p.m. Meeting was adjourned at 10:05 p.m. until November 8, 1972, at 7:30 p.m. in the Council Chambers of the City Administration Building. ~~ Charles Antos Acting Recording Secretary
