Conditional Use Permit 8-87 12309 Seal Beach Boulevard Resolution No. 1488 . Ms. Walker stated that CUP 8-87 lS a request by Chang's Gourmet to lndeflnltely extend CUP 8-87 allowlng llve entertalnment and danclng at Chang's Gourmet Restaurant at 12309 Seal Beach Boulevard ln the Rossmoor Buslness Center. On August 5, 1987 the Plannlng Commlsslon adopted Resolutlon No. 1466 WhlCh approved CUP 8-87 subJect to elght condltllJns. Slnce the orlg1nal approval of CUP 8-87 the Department of Development Servlces has recelved no complalnts regardlng nOlse or dlsturbance stemmlng from the entertalnment permlt at Chang's Gourmet. Moreover, no comments have been recelved to date In response to the malled notlce of extenslon of CUP 8-87. Staff lnspected the restaurant ln conJunctlon wlth thlS CUP extelnSlon. All condltlons of approval have been met wlth the exceptlon of the postlng of the buslness regulatlons for entertalnment. Chang's Gourmet was prov lded wlth a copy of these regul atlons and they compl led by dlsplaYlng them promlnently. No Pollce Department report regardlng Chang's Gourmet had been requested because there have been no problems and because thlS lS the flrst tlme the Department of Development Servlces has gone through a re-lssuance of a CUP and an entertalnment llcense and lt was felt that the notlce to the surroundlng property owners would alert them sufflclently to comment at that pOlnt. The PubllC Hearlng was open and Sardon Karano - 12112 Baylet, Garden Grove, CA - Bar Manager at C~1g'S Gourmet spoke on beha f of Chang's Gourmet by statlng that the restaurant had dlsplayed the buslness regulatlons for entertall1ment. MOTION by Sharp; second by Rullo 10 approve Conditional Use Permlt 8-87 by the adoption of Resolution No. 1488 subject to the following conditions and with the addition of condition 18: 1. CUP 8-87 lS approved for llve entertalnment at Chang's Gourmet, 12309 Seal Beach Boulevard, and lS lssued to Chal Te Chang. 2. CUP 8-87 lS non-transferable. 3. Entertalnment shall be llmlted to the bar area and the tables lmmedlately adJacent, as outllned on the plans approved by the Plannlng Commlsslon under Resolutlon Number 1466. Conditional Use Permit 17-87 550 Pacific Coast Highway Resolution No. 1489 Ms. Walker stated that Davld Bonadonna applled for the transfer of an on-sale beer and Wlne llCense to be used ln conJunctlon wlth an eXlstlng restaurant by applYlng for CUP 17-87. The subJect of the request lS the Vllla Sorrento Restaurant, located at 550 Paclflc Coast Hlghway ln the Bay Clty Center. In January 1988, Davld Bonadonna purchased the V11la Sorrento Restaurant from DennlS and Rosemary Casey. Mr. Bonadonna lS proposlng to malntaln the restaurant as lS. Bll1 Stearns, Chlef of Seal Beach Pollce, has no reservatlons about permlttlng the operatlon to commence. Staff recommends that the Plannlng Commlsslon approve CUP 17-87, wlth condltlons, by adoptlng Resolutlon No. 1489. It was stated that staff had lnspected the Vllla Sorrento thlS evenlng (2/3/88) and found that Condltlon #11 had been corrected by the removal of the lllegal slgnage -- a banner slgn and some flashlng llghts. . . . CUP 17-87 lS approved for on-sale beer and Wlne at 550 Paclflc Coast Hlghway, and lS lssued to Davld Bonad onna. 2. CUP 17-87 shall be automatlcally termlnated lf the operatlon lS no longer malntalned as a "bona flde publlC eatlng place" as deflned by the state Department of Alcohol1C Beverage Control. 7. 9. All alcohollC beverages sold shall be served by hand wlthln the premlses. 10. The term of thlS permlt shall be twelve (12) months, after WhlCh tlme the Plannlng Commlsslon may extend the permlt lndeflnltely provlded that all condltlons of approval have been satlsfled, and no slgnlflcant pollce problems have occurred. Resolution 1490 Conditional Use Permit 18-87 901 Ocean Avenue Mr. Knlght stated that CUP 18-87 lS a request by Douglas A. Marls to transfer an on-sale general llquor llcense to hlm (as the new owner) of an eXlstlng restaurant (operatlng as Jack's By The Pler). In November 1986 the Plannlng Commlsslon adopted Resolutlon No. 1439 thereby approvlng on-sale beer and Wlne to Jack Haley, owner. In May 1987, the Plannlng Commlsslon adopted Resolutlons 1459 and 1460, approvlng Varlance 3-87 for structural modlflcatlons to the subJect property and Condltlonal Use Permlt 2-87 for an on-sale general llquor llcense at 901 Ocean. Mr. Kn1ght noted that the new owner proposes the hours of operatlon to be from 7:00 a.m. to 11:00 p.m., Sunday through Thursday, and from 7:00 a.m. to 12:00 p.m ., Frlday and Saturday. Blll Stearns, Chlef of Seal Beach Pollce, has no reservatlons about permlttlng the operatlon to commence. The PubllC Hearlng was opened and Doug Marls - 901 Ocean Avenue spoke on behalf of hlS new restaurant. He stated they were ready to commence buslness. He requested the Plannlng Commlsslon conslder hlS proposal to open hlS restaurant for breakfast by 6:00 a.m. lnstead of 7:00 a.m. as he thought hlS customers mlght llke an earller breakfast tlme. . Commlssloner Jessner asked lf thlS earl1er tlme would meet ABC regulatlons. Mr. Knlght sald you can start servlng alcohollc beverages at 6:00 a.m. ln the State of Callfornla. MOTION CARRIED 4 - 0 * * * Conditional Use Permit 19-87 12501 Seal Beach Boulevard Resolutlon No. 1491 Mr. Knlght stated that CUP 19-87 lS a request by the Glbbons Corporatlon to permlt a planned slgn program ln conJunctlon wlth a new multlple tenant offlce bUlldlng. The offlce bUlldlng lS located on a l.4-acre, lndependent parcel wlthln the Rossmoor Buslness Center near st. Cloud Drlve and Seal Beach Boulevard. The subJect property lS currently belng developed wlth an offlce bUlldlng of approxlmately 32,000 square feet. No maJor tenants have been ldentlfled to date. ThlS planned slgn program lS requlred for the offlce bUlldlng by Resolutlon No. 1427 and because Sectlon 28-1804(e) of the Code of the Clty of Seal Beach restrlcts tYPlcal commerclal slgning to one slgn per bUllding face. The planned slgn program provldes enough flexlbll1ty to allow the addltlonal slgns requlred by lndlvldual tenants and meet Clty obJectlves. Mr. Knlght sald further that there was some questlon as to how to treat thlS program Slnce the Slgn code could treat thlS as an lndependent commerclal center as It'S on an lndependent parcel. It was the lntent of the Plannlng Commlsslon to have one planned slgn program so that Rossmoor would always be cons1dered as a unlfled program rather than havlng varlOUS satel11tes under dlfferent types of slgn programs. Staff thlnks that thlS lS a good suggestlon and would recommend a flfth condltlon wlth wordlng such as II ... that thlS planned slgn program lS approved wlth belng lncorporated lnto the Rossmoor Center planned slgn program." Commlssloner Sharp asked why the slgn colors were llmlted to lvory, navy blue and black and aren't there other colors ln the slgns at Rossmoor Center? Mr. Knlght stated lt was staff's contentlon that the professlonal offlce lS trYlng to do somethlng dlfferent wlth ltS slgnlng than retall stores are. Whereas retall sales mlght try to attract your eye to a slgn, professlonal offlce slgnage lS malnly to ldentlfy a maJor tenant or a bUlldlng and that can be done wlth one or two colors. Staff was concerned about havlng a large array of colors on the monument slgn. On the maJor tenant slgn staff feels the color cholces should be llmlted to two to three, as the slgns would be lndlvldual1y llt letters. The PubllC Hearlng was opened and Brlan Glbbons, 1270 E. Garvey Avenue, Covlna, CA spoke on behalf of the Gibbons Corporation. He produced a drawlng of the bUlldlng and a dlsplay board showlng the bUlldlng' s flnlshes, colors etc. Mr. Glbbons explalned the way thelr slgn program has been deslgned. It lS wlth two areas of slgns: (1) a monument slgn that lS not on the bUlldlng but off to the corner of the bUlldlng. That slgn would always remaln the same. And (2) the other slgns are the maln tenant slgns (example: a bank or savlngs and loan company) and the lndlV1dual tenant slgns w111 go over each wlndow of the bUlldlng. The lndlvldual tenant slgns are deslgned to be held by slxteen lnch (16") alumlnum slgn bands bUllt dlrectly lnto the bUlldlng. The problem Glbbons' has w1th thlS partlcular type of slgn lS that the colors that have been selected by the Clty won't contrast very well wlth the bUlldlng's exterlor flnlsh color. What they propose lS whlte or stalnless steel. There wlll be several dlfferent tenant slgns but they would all have to malntaln one of those two colors. . ." . . . ThlS lS one Slgn to be placed on each of the four sldes of the bUlldlng at each of the upper level corners. He sald the colors they prefer are: blue, but not speclflcally navy blue, whlte, red, green and black. They'd plck one of those colors for thlS slgn - not a multltude of colors. MOTION by Sharp; second by Rullo to approve Condltlonal Use Permlt 19-87 subJect to several condltlons by the adoptlon of Resolutlon No. 1491: 1. Condltlonal Use Permlt lS hereby approved for a planned slgn program ln conJunctlon wlth an offlce bUlldlng at 12501 Seal Beach Boulevard. The locatlon and deslgn of all slgns shall conform to the gUldellnes stated ln Exhlblt A (attached) and the plans approved by the Plannlng Commlsslon. 3. MaJor tenant slgn colors shall be llmlted to blue, whlte, red, green or black. The use of one of these colors lS preferred. The lntroductlon of addltlonal color to a logo symbol shall be permltted only when essentlal to the readablllty of the symbol and shall be 11mlted to one contrastlng color, preferably gold or yellow. TYPlcal tenant slgn colors shall be whlte or stalnless steel. 2. 4. Notwlthstandlng thlS approval,slgn copy and permlttlng procedures shall be as outllned ln Artlcle 18 of Chapter 28 of the Code of the Clty of Seal Beach. 5. Zoning Text Amendment 1-88 Satelllte D1Sh Regulatlons Mr. Knlght stated that ln June 1985 the Clty Councll enacted ZTA 2-85 establlshlng regulatlons for lnstalllng satell1te dlSh antennae ln the Clty of Seal Beach. A number of complalnts have been flled wlth the Department of Development Servlces regardlng satelllte d1shes. At thelr December 21, 1987 meetlng, the Clty Councll dlrected staff to reVlew the amortlzatlon clause and prepare a report on the posslblllty of strlklng Sectlon 28-2350(F) (requlrlng legal non-conformlng satelllte dlshes to be removed or replaced ln conformlty wlth ZTA 2-85 wlthln two years of the effectlve date of the ordlnance) from the Clty Code. In redraftlng the Clty'S satelllte dlSh regulatlons, the Clty Attorney's Offlce had two obJectlves: (1) to lncorporate the Clty Councll's dlrectlVe to extend the amortlzatlon perlod lnto the ordlnance and (2) to flne tune the regulatlons to resolve amblgultles WhlCh had surfaced through thelr appllcatlon. Staff flnds the proposed ordlnance accompllshes the Councll';s dlrectlve to extend the amortlzatlon perlod for satel11te dlshes and at the same tlme the amendments clarlfy areas of amblgulty and reduce the potentlal of vlolatlng the FCC gUldel1nes. Staff recommends that the Planlng Commlsslon recommend the draft ordlnance to the Clty CounCll for adoptlon. MOTION by Jessner; second by Rullo to adopt Resolution 1492 recommending the approval of Zoning Text Amendment 1-88 to the City Council. MOTION CARRIED 4 - 0 * * * 5.
