MARCH 16, 1988
The Plannlng Commlsslon of the Clty of Seal Beach met ln regular
seSSlon wlth Chalrman Covlngton call1ng the meetlng to order at
7.30 p.m.

PUBLIC HEARINGS
Conditional Use Permit 1-87
212 5th Street
Seal Beach Inn
STAFF REPORT was glven by Pam Walker who stated that CUP 1-87 lS
a request by MarJorle Bettenhausen, owner and operator of the
Seal Beach Inn, to extend lndeflnltely CUP 1-87 establlshlng the
anclllary serVlces to be permltted wlth an eXlstlng hotel use.
Staff recommends approval of CUP 1-87 by amendlng the orlglnal
resolutlon, Resolutlon No. 1455, to allow anclllary serVlces to
contlnue lndeflnltely. The amendment would lnclude a clause that
a publlC hearlng was held thlS evenlng and that the Plannlng
Commlsslon found the orlglnal condltlons of the CUP had been
satlsfled. The last condltlon, requlrlng reVlew after one year,
would be deleted. Staff recommended adoptlng Resolutlon 1455 as
amended.

PUBLIC HEARING was opened.
PHIL RAMER - 223 FIFTH STREET, SEAL BEACH requested that thlS CUP
be extended for one more year because he felt the use of the Inn
for outdoor actlvltles (and the parklng spaces sltuatlon) had not
been tested and he wanted to make sure the systems were properly
ln place and worklng well.
MARJORIE BETTENHAUSEN - 212 5TH STREET lntroduced herself as the
appllcant and the owner and operator of the Seal Beach Inn. She
sald the Inn has had outdoor functlons and a couple of weddlngs
of 100 people. The Inn worked to have the parklng for these
weddlngs coordlnated; the people were there and gone wlthln 180
mlnutes. They do keep thlngs very qUlet and upscale.
Chalrman Covlngton compllmented Ms. Bettenhausen on her operatlon
of the Inn and on her good-nelghbor pol1cles as there have been
no complalnts to hlS knowledge.
MOTION by Sharp, second by Rullo to approve Conditional Use
Permit 1-87 by adopting Resolution No. 1455 as amended.

STAFF REPORT was glven by Ed Knlght who stated that CUP 1-88 lS a
request by appl1cant Laurle Neuse on behalf of Spaghettlnl's to
sell beer, Wlne and dlstllled SpHltS ln conJunctlon wlth a new
restaurant. The restaurant lS located wlthln the B1Xby OfflCe
Park. The Clty Councll approved the preclse plans for
Spaghettlnl's on 9-8-87. It has a lounge but lS a bona flde
restaurant. ThlS restaurant lS antlclpatlng openlng at the end
of Aprll or early May. The CUP approval process would be

9:00 p.m.
MOTION by Rullo, second by Jessner to approve Conditional Use
Permit 1-88 by the adoption of amended Resolution No. 1499 which
will read: .with the applicant1s consent, the hours of operation
shall be as follows: Monday through Thursday, 11:00 a.m. to
10:00 p.m., Friday and Saturday, 11:00 a.m. to 11:00 p.m. and
Sunday, 3:00 p.m. to 9:00 p.m..

Corporation (d/b/a The Soup Exchange) lS requestlng permlsslon to
sell beer and Wlne ln conJunctlon wlth a new restaurant located
at 3001 Old Ranch Parkway ln the B1Xby Offlce Park, next door to
Spaghettlnl's Restaurant. There lS no lounge. They antlClpate
openlng ln Aprll.

STAFF REPORT was glven by Pam Walker who stated the appllcant,
General Mi 11 s, seeks to convert the Seafood Broller to a Red
Lobster and lS requestlng to transfer an on-sale general llquor
11cense. Staff lS recommendlng approval of CUP 3-88 by the
adoptlon of Resolutlon No. 1501 subJect to elght condltlons (not
seven condltlons as set for ln the staff report). The elghth
condltlon would lnclude the hours of operatlon.

No one wished to speak for or agalnst CUP 3-88.
MOTION by Jessner, second by Sharp to approve Conditional Use
Permit 3-88 by the adoption of Resolution Number 1501 amended to
include an eighth condition which will read: .With the
applicant1s consent, hours of operation shall be Sunday through
Thursday, 11:30 a.m. to 10:00 p.m., and Friday and Saturday,
11:30 a.m. to 11:00 p.m.-

6. ORAL COMMUNICATIONS FROM THE AUDIENCE
There were no oral communlcatlons from the audlence.
7. COMMISSION CONCERNS
Chalrman Covlngton vOlced hlS concerns on
(A) STATE LANDS PARCEL - The old Marlne Palace property
The staff lnformed hlm that there are new owners for the
lease from the State. He thanked the Clty, the staffs and
the col1ectlve and lndlvldual members of the Plannlng
Commlsslon who, for the last 12 years have fought off ...
non-productlve uses for that land. He sald thlS lessee
wlll put up a hotel on that slte that wlll pay monles to the
State and that wlll beneflt the Clty flnanclally also from
sales taxes, etc.

(B) VARIANCES - He sald he has observed that 1/2 to 1/3 of
the varlances denled at Plannlng Commlsslon level are
overturned at Clty Councll level. He feels thlS lS unfa1r
to the cltlzens who ablde by the bUlldlng codes and
ordlnances appllcable to thelr property because the reasons
for the reversals appear to be superflclal wlth no new
facts to warrant them.
(C) IN-LIEU PARKING DOWNTOWN - He sald thlS subJect has
been revlewed over and over and no Solutlon to the parklng
shortage on Maln Street has been found. He sald the longer
the Clty walts the more expenslve land and constructlon
costs wlll be, the treater the trauma to the Clty w111 be.
The solutlons are dlsappearlng. He feels that It'S tlme for
the Plannlng Commlsslon to go ahead and start holdlng publlC
hearlngs, get lnput and start dOlng somethlng.
8. STAFF CONCERNS
At March 7, 1988 Clty Councll meetlng the Shaddox' tentatlve
tract map was approved. Thelr three unlts can now become
ownershlp houslng.
The sate" lte dlSh zone text amendment was lntroduced and flrst
readlng; there were no changes. A second readlng wlll be at the
March 21 Clty Councll meetlng.
