HomeMy WebLinkAboutPC Min 1973-08-01 . . . e e MINUTES OF THE PLANNING COMMISSION MEETING OF AUGUST 1, 1973 The Planning Commission of the City of Seal Beach met in regular session on Wednesday, August 1, 1973, in the Council Chamber of the City Administration Building. The meeting was called to order by Chairman Ripperdan at 7:30 p.m. and Mr. Knapp led the Pledge of Allegiance. Present. Absent: Cook, Hammond, Lanning, Knapp, Ripperdan None The minutes of the meeting of July 18, 1973 were approved as presented. Chairman R1pperdan opened nominations for Planning Commiss1on Chairman for f1scal year 1973-74. Mrs. Lanning-nominated Mr. Knapp for the position of Chairman, seconded by Mr. Cook. There being no further nominations, nominations for Chairman were closed. AYES: NOES: ABSTAIN: Cook, Lanaing, Hammond, Ripperdan None Knapp Mr. Knapp was elected Chairman for fiscal year 1973-740 After accepting the gavel, Chairman Knapp commended Mr. Ripperdan for a Job well done as Planning Commission Chairman for the year 1972-73. Chairman Knapp opened nom1nations for Planning Commission Vice Chairman for f1scal year 1973-74. Mrs. Hammond nominated Mrs. Lanning for the position of Vice Chairman, seconded by Cha1rman Knapp. There being no further nominations, nominations for Vice Chairman were closed. AYES: NOES: ABSTAIN: Cook, Hammond, R1pperdan, Knapp None Lanning Mrs. Lanning was elected Vice Chairman for the fiscal year 1973-74. 1. Pub11c Hearings A. Maurice Millard, V-22-73 Proposal to construct a garage in excess of 10 fto in height in Surfs1de Colony, at B-49. Purpose of the 13'9" high garage was to allow a recreational vehicle to be stored 1nside. Hearing opened. Mr. Millard stated that the overhanging eaves on the proposed garage were not necessary and he would delete them. Mrf Lanning asked if other garages in Surfside exceeded the height limit of 10 ft. Secretasy indicated that there were a few on "B" row. One written communication was noted from a pmoperty owner in Surfs1de and a letter from Surfs1de Colony requesting den1al was noted. Public hearing closed. Mrs. Lanning moved to approve V-22-73 with the cond1t1on that the eaves not project past the bear1ng walls. Seconded by Mrs. Hammond and approved unanimously. Resolut1on No. 764. . . . e e B. Mrs. Cunningham, V-23-73 Proposal to construct a duplex w1th tandem parking and less than requ1red exterior s1de yard at the corner of Ocean Ave. and Electric Ave. Public hearing opened. Mr. Cunningham stated that due to shape, size, and location of the lot, it was necessary to have the building proJect 1nto the exterior side yard in order to provide the necessary parking spaces. Mr. Ripperdan questioned the location of a window at the second level and on the exter10r side property line. Mr. Reid of the Build1ng Department indicated that the D.B.C. requires windows to be set back from all property lines. Chairman Knapp read a letter from D. M. Callis object1ng to tandem parking. Applicant indicated that he would redesign the 2nd story w1ndows to conform with D.B.C. Mr. Cook and Mr. R1pperdan stated they weJ:e not in favor of a "0" side yard setback. Mrs. Cunningham noted that no one showed up to obJect to the project. Mr. Cunningham requested a continuance 1n order to revise the plans on the exterior side yard property line. Chair ordered the matter continued until August 15, 1973, at 7:30 p.m. 2. Oral Commun1cations There we~e no oral communications. 3. Written Communications There were no written communications other than those connected with other Plann1ng Commission 1tems. 4. New Business A. Rossmoor Bus1ness Center (Hungry Hamburger), PR-8-73 Applicant 1S proposing the installation of a 30 x 8' sign reading "Chair Broiled Burgers" at an existing restaurant in the Rossmoor Business Center. Chairman Knapp moved to approve PR-8-73 subJect to the condition that the sign not flash or rotate or appear to flash or rotate. Seconded by Mrs. Lanning and unanimously approved. Resolution No. 765. 5. Report from Secretary. Sec. 1819 of Zon1ng Ordinance. A letter was received f~om Lawrence Peters regarding property at 213 Ocean Ave., and compliance with Sec. 1819. Secretary reviewed past actions by the Planning Commission regarding the interpretation of Sec. 1819 and what a literal interpretation of Sec. 1819 would cause on development of 25 ft. wide lots. Don Davis, Architect, stated that he was familiar with 15 buildings on 6th St. uhich were built under Sec. 1819 and the add1tiona1 setback was required only at the doors, not along the total side yard. William Gill, 213 Ocean, stated that he had received approvals 11 months ago from the City and was intending to comply with all Planning Commission conditions. Laurence Peters, 211 Ocean, stated that the proposed construction at 213 Ocean had less than the requ1red side yards and d1d not comply with Sec. 1819. He stated that his concern is with light and air as well as with adequate fire and earthquake emergency exists. He requests a new interpretation of Sec. 1819 more in keep1ng . . . e e with a literal interpretation of that provision rather than simply a reaffirmation of previous policies. Planning Commission d1scussed Sec. 1819 and~~re of the opinion that the reason for increasing the side yard setback to 5 ft. at front entrances opening on a side yard was to facilitate the movement of furnishings and large appliances into dwelling units and that any required setback increase should only come at the door entryway. Mr. Ripperdan moved that Sec. 1819 be reinterpreted as follows: Sec. 1819. Side yard abutt1ng front or rear entrances of dwelling. Where dwellings are arranged so that their front or rear entrances abut on a s1de yard, the required s1de yard abutting the front entrances shall be increased two feet at each separate en~e of each dWeZZing un~t having a front entrance opening into or reached V1a the side yard, and the required side yard abutt1ng the rear entrances shall be increased one foot at each sep~ate en~nce of each dWeZZ~ng un~t opening into or reached via the side yard; provided, such ~ncrease need not ~ceed f~ve feet at sa~d entrance ~cept 1Jhen other prov~s~ons of th~s ord~nance bJoU Zd so requ~re." In addit10n, that th1s matter be forwarded to the City Counc1l for aff1rmation and that staff be directed to prepare an amendment to the zoning ordinance wh1ch would more clearly express the proper 1nterpretation of Sec. 1819. Seconded by Mrs. Lanning and unanimously approved. Resolut10n No. 766. Cumulative Zoning Ord1nance Provisions. Secretary reviewed the request of Mr. Cook at the Planning Commission Meeting of August 1, 1973, regarding the pyram1ding effect of the zon1ng ordinance which would theoretically allow residential uses in Commercial or Manufactur1ng zones. Secretary advised that by amending Art. 12, Sec. 1200 (1) adding section (f) reading "all residential uses" 1t would be possible to prohibit residential uses in the C-3, M-l and M-2 zones. Planning Comm1ssion discussed the advantages and d1sadvantages of prohibiting residential uses in other than "R" zones. Staff was directed to adveruze for a pub11c hearing to conS1der amending Art. 12, Sec. 1200 (1) adding (f) reading "all residential uses." Inspection of 1507-1509 Seal Way. Secretary reported that the Plann1ng staff and Building Department had inspected the 4-unit apartment building at 1507-1509 Seal Way at the request of the Planning Commission and had found no substantial changes in the building. Mrs. Lanning stated that electric carts were being repa1red in the Leisure World Shopping Center in violation of the approvals granted by the Plann1ng Commission. Staff w1ll investigate.
