MINUTES OF THE PLANNING COMMISSION MEETING OF SEPTEMBER 19, 1973
The Planning Commission of the City of Seal Beach met in regular session on
Wednesday, September 19, 1973, in the Council Chamber of the City Administration
Building 0 The meet1ng was called to order by Chairman Knapp at 7:30 pomo and
Vice Chairman Lanning led the Pledge to the Flago

Minutes of the meeting of September 5, 1973 were approved as presented by the
following vote:

10 Public Hearing

Secretary rev1ewed application and previous hearing.. He also reported on staff
investigat10n of building department and finance department records for evidence
of issuance of a bui1d1ng permit with no 1ndication of moneys received or permit
validated for the additiono Hearing reopenedo Mrs.. Crowley was present and
stated that a permit had been obtained, 1nspection card posted and two inspections
made by city inspectorso She had been attempting to find a copy of the perm1t or
a cancelled check but had not been successful.. In response to a question by Mrso
Lann1ng, Mr.. Reid advised that lateral bracing would be needed to meet code for
earthquake or w1nd resistance.. Mr. Cook asked about lot dimensions and per cent
of lot coverage w1th additionso Discussion followed uith staff records showing
coverage of 39+%0 Mrso Crowley agreed to make revisions to meet building codeo
Mr. Neprud reviewed extensive research of all recordso After additional discussion,
no other comments received, hearing was c10sedo Various phases discussed.. Mrs.
Lanning detailed her memory of the constructiono Mrso Lanning moved to approve
the variance subject to the condition that structure be brought to building code
requirementuo Othpr-possib1e methods of locating evidence of a permit being
issued were discussed includ1ng checking County Assessor records.. Mr.. Cook asked
that lot coverage be recheckedo Applicant advised that room would have to be
removed if variance deniedo Mrso Hammond asked if permit would be necessary for
work previously done.. Motion amended to inc1ud~ requirement of permit for

Beryl Cove Way, commented that city inspection in the past years had been very
deficient.

D. Frank Padilla, V-25-73 (continued)
Secretary reviewed the application and discrepancies brought out at the last meeting.
He reported on on site investigation and solutions proposed for 2nd story access.
Hearing open. Mr. Padilla stated he had removed existing wooden stairs that were
unsafe and installed a circular steel stairway, then found his contractor had
failed to get building department approval or a permit. Mr. Padilla desired to
meet all requirements to avoid later problems. A concrete steps and landing
in the sideyard as has been installed at other locations was proposed to provide
access to the second story, but still allow through access for emergencies. In
reply to Mr. Cook's question, the walkway partially encroaches into the parking
area but does not prevent parking use. Hearing closed. Mr. Cook moved to approve
V-25-73 subject to execution of a Land Use Agreement limiting number of units to
3, reserving parking for vehicles, and providing for annual inspection. Seconded
by Mr. Ripperdan and passed unanimously. Resolution No. 781.
C. Dennis Jaffe, V-28-73
Applicant proposing a single family residence at A92 Surfside. Variance requested
to allow 4 stories for a portion of the building uith1a the 35 foot height limit.
Hearing open. Letter of approval of plans rec.eiv~ from Surfside.Colon.y. Dr.
Jaffe reviewed the background of the proposal and misunderstanding of separate
requirements in the Surfside area. Mr. Davidson, Architect, advised that a pennt
had been issued by the South Coast Regional CammilB!:li<<m.. Steve Spence, 209 7th,
asked if this proposal would conflict with proposed Land Use Element. Discussion
of existing zoning and changes that might be made after adoption of the Land Use
Element. Mr. Cook commented 011 the effec.t on density be a four story or three
story building. Concern regarding setting of precedence in the Surfside area
by this action. Mr. Davidson felt this a spedal case and would not be deemed
a precedent.. Hearing closed. Mrs. Hammond stated that since this was a single
family residence and had approval by Surfside she would move for approval of
V-28-73. Seconded by Mrs. Lanning.. Mr. Knapp requested that Surfside Board of
Directors clarify their position as to building height. Mr. Cook felt this could
be precedent setting and recommended denial.

2. Oral Communications
Steve Spence, 209 7th, presented copies of a flier to be distributed regarding
the hearing before the Council on the Land Use Element. Discussion of items that
might be misleading. Mr. Neprud explained procedure for amendments to the zoning
ordinance to bring into conformity with adopted Land Use Element. Mrs. Spence
apologized that the flier had not been proofread before printing. Mr. Cook
commended those persons responsible to try to get the public involved.
3. written Communications
Several letters received from residents of the trailer park asking for specific
zoning. Mr. Neprud reported he had met with a number of the residents to explain
various options and their effects. Staff feels that the Unclassified Use Permit
the best procedure and could offer the most protection. If MObile Home Park Zone
and Standards were established, they would not permit the existing park to contin~m.
It was suggested that residents negotiate for a long term lease or have owner
request Unclassified Use Permit.

Secretary also reported on investigation for financial assistance on low income
housing. Three programs were found but none seamed to be applicable to trailer
or mobile home housing. He also discussed city acquisition and possible
inclusion in the Redevelopment Agency. This would require more detailed review
and the effect upon the existing park might not be satisfactory.
Mr.. Lamonica, 11 Marina Dr.., spoke at length about low income housing and the
need for cities to take some of the responsibility.. Many federally operated low
income housing programs were failing. He felt mobile homes were less expensive
and a better answer for low income housing.. Re also recommended that thca trailer
park have a special zoning for an older park that would not incorporate all of
the standards for a new park.. Commission suggested that res1dents contact owner
or lessee and explained that zoning would not give permanent protection because
owner could clear land and establish a new trailer/mobile home park or ask for
rezone. Extensive discussion continued on the same topics.. Mrs. Agur spoke
regarding the area being shown on the Land Use Element as a trailer park. Th1S
would restrict use and recognize the need of the residents.. It was again explained
that rezoning, if any, would be considered for total area after adoption of the
Land Use Element.
Mrs. Lanning moved to receive and file the communications.. Seconded by Mr..
Cook.. Additional c01llDents received from the audience reiterating statements
made earlier as to the desire for protection zoning. Motion was passed
unanimously..
4. New Business

No flashing or rotating features included. Mr. Ripperdan abstained from
discussion or action to avoid conflict of interest. Mr.. Knapp moved to approve
the signing as presented.. Seconded by Mre..'Lanning..

Mr. Neprud reminded Commission of public hearing before City Council to cons1der
the Land Use Element on Monday, September 24.
Mr. Knapp advised he could not be present at the next regular meeting due to a
conflict with his profession..
