Mro Martln also revlewed their research regarding effect of the proJect on
street traffico drainageo ~~dothe location of the parksiteo He pointed out
that drainage from thlS slte would be furnished be separate fac11it1eso and
that they were working with the city to alleviate the existing drainage problemo
He d1scussed the wall and requested they be allowed to place some wal1sg earth
bermso and landscaping along Lampson instead of a solid block wall for visual
variety and beaut Yo He spoke of the possibility of noise problems from the
Air Station and plans to provide sound attenuatlon through use of materlalso

Delmar Smitho 4540 FirD advised he had lived 1n the area 5~ years and was a
m3mber of the executive board of the College Park Homeowners Associationo He
commented on the hlstory of thlS parcel and stated homeowners were led to believe
lt would be developed as a park and that the area tmuld contaln only single
family homeso He summarized the bond election to acquire this parcelo

Mr. Smith also felt that a larger parksite was going to be provided with a
pool as shown 1n some dra\'l1nqs. He adv1sed that those present at the last CPHA
meetlng, a unanlmouS vote opposed the proposed parks1te. D1Scussion between
Mr. Smith and Commlssloners reqardlnq type of park desired by the residents.
Add1t1onal dlScusslon of what salespersons for developer represented to prospective
buyers in rplatlon to facts aval1able through the Clty. Dleter Trost, 4196 Doqwood,
asked for clarlflcatlon of varlance and number of units. Caro11ne See1, 4292
Dogwood, opposed park locatlon, asked about posslbl1ity of Clty purchas1nq additional
land for better s1zed park and expressed concern about 1ight1ng along Lampson.
Gene Blackman, Candleberry and Aster, worrled about flood1ng condltlons and park
10catlon. Jean Dorr, 231 6th St., reported on a conversatlon wlth the Clty Engineer
regard1nq the floodlng cond1tlons. Frank Laszlo, 4480 Cand1eberry, spoke regarding
the 10catlon of the park and flood1ng conditlons.
Chair ordered at recess at 9:10 p.m. Reconvened at 9:20 p.m.
Mr. Bob Dienstag, 4209 Cand1eberry, spoke about the noise problems, part1cu1arly
those from hellcopters. Jay Covington, 4557 Candleberry, spoke reqarding the
park slte, the Envlronmental Impact Report, and noise problems. He cited and
read excerpts from the Press Te~egram regardlnq hlqh sulphur fuels, the E.I.R.,
and state laws. He felt areas of concern were additlons to trafflc, drainage,
overflow parklnq by quests, and safety from alr accldents. He felt sound tests
had been taken at the wronq times, and not when activit1es are at their hiqhest
at the alr statlon. Mr. Cov1ngton advlsed the Commlss10n on posslble 11abl1ity
for the City reqardlnq standards of the State Aeronautlcs Board and suqgested
legal adVlce be'obtalned from the Clty Attorney. Steven Kenyon, 1201 Ocean,
urged that sufflclent open space be requlred because it was a problem for the
ent1re Clty. Lt. Cdr. Au1ward, UoA.S., advlscd the new commandlnq officer of
the statlon 1S trYlng to obta1n authorlzatlon to acqulre the property by d1rect
purchase or trade. He also conf1rmed the antlc1pated 140,000 operat10ns per
year. Each, fllght 1S made up of three operatlonsi take-off, approach and
landing. ~1r. Au1ward also conf1rmed that approx1mately 2/3 of the flights
would take place on week ends. He adv1sed that addlt10nal sound studles were
belng made and should be ava11ab1e as an addendum to the E.I.R. by the 1st of
May. J1m Schmldt, presldent of College Park Homeowners Assoc1atlon reported
that the Oranqe County Alrport Lands Commlsslon had frozen use of land northerly
of the a1r stat10n and they should be contacted for the1r rullng concerning
the proJect area. Mr. Schmldt also opposed the proposed 10cat10n of the park.
Mr. Martln explalned that Blxby favored a paSSlve type of park, but C1ty staff
want~d an actlve type. It was felt that the Bass\/ood/Aster locatlon was best for
actlve uses. He further dlscussed the nOlse studles and the Alrport Land Use
Commission. General dlScusslon and questlons and answers wlth Commissioners.
Dave Recupero, consultant for B1Xby, clted an Orange County Alrport Department
report stat1ng the hellcopter operatlon would be compatlble wlth ne1qhborlng
land uses. The questlon of sufflclency of the E.IoR. was d1scussed and Secretary
Neprud reviewed procedure for deteMm1nat10n by E.Q.C.B. After add1t1onal dlScussion
the hear1ng was closed.
Mrs. Hammond moved to approve Var1ance V-38-73 subJect to the cond1tlons (1) plan
review by Commlsslon on the prlvate recreatlon area, (2) comb1nat10n of wall, earth
berm and 1andscap1nQ along Lampson to mltlgate nOlse and subJect to staff approval,
(3) Units to be constructed wlth gypsum board, flberg1ass and glass as shown on
page 23 of the E.I.R., (4) landscap1ng to satlsfact10n of staff, (5) Vlsltor parking
spaces to be permanently malntalned, (6) comp1lance wlth bUlldlng, englneerlnq and
f1re department condltlons, and (7) no street parklng on lnterlor streets. Seconded

Mro Neprud explalned the tentatlve map and advised that one determ1natlon they
should make would be a ~ecommendat'on to the City Councll ~egarding requirlng
dedlcation of land or fees in lieu for park purposeso Hearlng openo Mro Cook
felt addltlonal sound studies were necessary when typical week end air operatlons
were in process at the Naval Air Stationo He was concerned about municipal
l1ab1lity of approving a proJect that might not maet state standardso Mro
Martln of Walter Rlcha~dson and Associates, representing Bixby Ranch COOg made
no presentatlon, but reserved rebuttal rightso Mro Blac~man9 Candleberry and
Asterg was concerned about hel1copter noise effect and possible negotiation to
acqulre the property by the Navyo Jay COYlngton spoke about the activity level
at the alr station to be hlgher than when studles were madeo He also read a
section of the EoloRo relatlng to mil1tary aircraft and thelf compatibil1tyo
Mro Ma~tin pointed @ut that the hel1copter actlvity was referred to as compatlbleo
He expla1ned the dlfference in deClbQl ratings and a composite noise studyo He
also pointed out that the [oloRo had been determined as sufficlent by the
Envlronmental Qual1ty Control Boardo Hearlng closedo
The Sec~etary advlsed that the Cammlssion should make recommendatlons to the
Councl1 regarding the parksite, land or fees, and its locatlono If a change
of location was recommended and the Counc1l concurso a revlsed tentatlve map
would be neededo He also read portions of the staff report citing advantages
and disadvantages of various 10catlons for the parko Mro Cook quest~one~ legal
pOlnts regardlnq ~ound tests and the envlronmental- lmpact report for thlS
proposed proJecto D1Scussion followed of location and use of parko Mrso Hammond
moved to recommend approval of the t~ntative map by the City Council and that
dedication of land for a parksite be requlred in lieu of feeso The following
additional recommendations were mad~ to the Clty Council:
If lt ;s determlned that the parkslte will be used as a tennis courtg it is
recomm~nded that the park be located at Basswood and Aster as proposed on th~
tentative mapo If It 1S determlned that the parksit~ wll1 be used for other
recreational purposeso it 1S recommended that it be located at the corner of
Candleberry and Astero
It is recommended that the City Council request that the Clty Attorney rend~r
an opinion regarding the CityOs legal posit10n pertaining to approval of said
proJect as it may relate to the StateBs Department of Aeronautics regulations
affecting constructlon of low r1se ~esldentlal buildings wlthln the 65 CNEL
