MINUTES OF THE PLANNING COMMISSION MEETING OF MARCH 20, 1974
The P1annlng Commlsslon of the Clty of Seal Beach met In regular seSSlon on
Wednesday, March 20, 1974, In the Councl1 Chamber of the Clty Admlnlstratlon
BU11dlng. The meetlng was called to order by Chalrman Knapp and Vlce Chalrman
Lannlng led the Pledge to the Flag.
Present: Cook, Knapp, Lannlng, Rlpperdan
Absent: None
Chalrman Knapp lntroduced Mr. James Schmltt who has been appolnted to replace
Mrs. Hammond. Secretary Neprud exp1alned the reason for delay In belng
seated due to new dlsc10sure law.
The mlnutes of the meetlng of March 6, 1974 were approved as presented.
1. PubllC Hearlngs
A. Blxby Ranch Co., V-3-74 (contlnued)
App11cant requests varlance to permlt more than 10 unlts on a slng1e parcel.
The proposal lS to construct a 60 unlt condoMlnlum on 7.85 acres of land.
Secretary Neprud advlsed of hlS membershlp wlth the Old Ranch County Club owned
by B1Xby Ranch Co. and turned the meetlng over to Charles Antos as Actlng
Secretary and Steve Dorsey, Asslstant Clty Attorney. Mr. Dorsey advlsed that
Slnce some conf11ct of lnterest was lnvo1ved wlth two Commlssloners, lt would
be necessary for them to act on the app11catlon due to the rule of necesslty.
Mr. Knapp and ~1r. Rlpperdan both dlsc10sed former membershlps In the Country
Club, but declares no lnf1uence due to past assoclatlon. Hearlnq open.
Mr. Ralph r~artln of Rlchardson & Assoclates, representlng B1Xby, revlewed the
matter covered In prevlous hearlngs by summarlzlng the slte plan and effect by
the Naval Alr Statlon. He also exp1alned that the unlts would have prlvate
ownershlp, the open space provlded met Clty standards, and dlScusslon of 10catlon
of the parkslte to be dedlcated to the Clty. Dralnage for parcel to also lmprove
dralnage problem In the area. Screenlng of Lampson and trafflc generatlon also
dlscussed. Mr. Martln dlsp1ayed charts of sound lmpact by Navy base and f11ght
patterns WhlCh were composltes of several studles and spoke at length regardlng
a11eg~d hazards and lf new operatlons by the Navy created problems or hazards,
they should be requlred to fl1e an envlronmenta1 lmpact report. He stated they
had appeared 4 tlmes before several boards and the Blxby E.I.R. had been approved
as approprlate, the proJect meets Clty codes, and safety problems would be the
same for the nelghborlng resldentla1 area. Mr. Cook asked lf addltlona1 land
should be donated In 11eu of the blke tral1 system. Mr. Antos clted the
subdlvls10n ordlnance and exp1alned.
Jack Cortelyou, 4201 Dogwood, stated many nelghbors feel the Condomlnlum5 are
deslrab1e. Jay Covlngton, 4557 Cand1eberry, rebutted pOlnts about trafflc effect
and also dlscussed the sound studles and potentla1 hazard at length. He also
requested that actlon be delayed untl1 Mr. Schmltt, representlng 6500 College
Park East resldents, could be seated on the Commlsslon. He reported on the
Orange County Land Use Commlss10nls development of a comprehenslve general plan.

DaV1d Ph1111pS, 1309 Ocean, p01nted out the Comm1ss10n must make the pol1t1cal
dec1s10n of whether the C1ty buy the land for a park as the c1t1zens want or
to allow Blxby to bU11d to make money. Phll1p Chap1rson, ~70 Aster, dld not
feel the proJect would 1ncrease value or enhance the area and m1ght create
congest10n and parklng problemso John Perr1n, Naval A1r Stat10n, Los Alam1tos,
Resources and Commun1ty Plann1ng, appeared w1th an unb1ased report for
1nformat10n only. He p01nted out the d1agram for hel1copter operat10n des1gned
to reduce 1mpact. The Navy 1S accelerat1ng the1r program to better def1ne
the 1mpact and report should be ready 1n May. He d1scussed the crash hazard
area and presented a draw1ng of latest stud1es, w1th a report to be forthcom1ngo
Mr. Knapp asked regard1ng 1/3 of College Park East and asked what steps were
be1ng taken tp prevent crash hazards? Mr. Perr1n adv1sed the Navy would be
happy to send a panel to br1ef the Plann1nq Comm1ss10n. The1r effort 1S to
f1nd compat1ble land uses and avo1d hazards and, 1f necessary, may go to leas1ng
or land acqu1s1t10n.
Steve Spence, 209 7th, asked 1f could be poss1ble that the c1ty would be 11able
1n the event of a crash. C1ty Attorney adv1sed they would not beo Mr. Spence
also p01nted out there had been a d1fferent type of use at the a1r stat10n when
College Park East developed and need to cons1der future uses. He felt hazards
should not be allowed 1n 1ncrease Just because some eX1st.
Mr. Mart1n expla1ned the charts used were furn1shed by the Navy and felt the
Navy was ask1ng the C1ty to prevent land use by an owner because of poss1ble
future plans, many concerns about sound and crash hazards are op1n10ns only.
He rev1ewed prev10us p01nts, and asked for act10n by the Comm1ss10n. In reply
to Mr. Cook, Mr. Mart1n stated the proJect \~as ready to proceed upon approval.
Mr. Perr1n reported on sound attenuatlon program, also that Navy had offered
land swap w1th B1xby but d1d not know 1f there had been an answer. Mr.
Case, B1xby Ranch Co., rev1ewed deal1ng and commun1cat10ns w1th the Navy over
a perlod of t1me and that B1xby had been w1111ng to trade land 1f comparable
parcel offered and they had not approved any profferedo Last lnformat10n
was a vague offer of a m1ss11e s1te. Hear1ng closed.
Mr. Cook asked attorney to report on A1rport Land Use Comm1ss10n. Mr. Dorsey
advlsed the AoL.U.C. could deny or reJect the Comm1ss10n act10n, but the
Plann1ng Comm1SS10n must act f1rst. Mr. Cook felt safety and sound problems
would eX1st regardless of use and could be worse 1f developed as a park or
pool w1th many persons present, commerc1al or 1ndustr1al could 1ncrease use
by people, and not deslrable to leave the open f1eldo Proposed development
would have few ch11dren.
Mr. Cook moved to approve Var1ance V-3-74 subJect to Cond1t10ns 1 through 7
of the staff report and #8 for park to be located at Aster and Candleberry,
and #9 that tentat1ve map be subm1tted to the A1rport Land Use Comm1SS10n for
cons1derat10n. Seconded by Mrs. Lann1ng and passed unan1mously. Re~. No. 814.

Cov1ngton called attent10n to the A.L.U.C. m1nutes denY1ng the B1Xby proJect
w1thout preJud1ce. Mr. Antos adv1sed that B1xby had proceeded to A.L.U.C. on
staff recommendat10n S1nce no method or procedure ava11able and den1al based
on 1nformatlon aval1able. Attorney Dorsey also adv1sed that act10n must be
taken because of tlme element, no act10n would be an automat1c approval.

Mrs. Lann1ng moved to approve the tentat1ve map for Tract 8534 and recommend
to the C1ty Counc11 the requ1rement for ded1cat10n of land for park use rather
than payment of fees. Seconded by Mr. Cook and passed unan1mously. Res. No. 815.
C. Add1t10n of R/C/P Zone, O-E Zone, Creat10n of D1str1ct VI,
and ReV1S10ns to Sec. 1801 and 1803
Mr. Neprud rev1ewed the proposed ord1nance and also expla1ned the annexat10n
agreement w1th Rossmoor BUS1ness Center. Slnce the representat1ve of Rossmoor
Center was on vacat10n, he requested that the matter be cont1nued. Hr. Cook
obJected. Secretary adv1sed of poss1ble act10ns. Hear1ng open. Steve Spence,
209 7th St., spoke 1n Oppos1t10n. He felt the Propos1t10n 20 requ1red a
spec1f1c plan be adopted and the R/C/P would not meet th1S requ1rement. Mr.
Dorsey was unsure, but felt the requ1rement for parkland and unrestr1cted access
would meet requ1rements. Spence requested that act10n on R/C/P be deferred for
attorney's op1n10n. He also felt that res1dent1al/park was best use for JWater
and Power property, but the R des1gnat10n d1d not 1nd1cate R-l, R-2 or R-3.
He asked th1S be deferred unt11 further 1nformat10n ava11able. Mr. Cook expla1ned
he m1sunderstood staff request to cont1nuance, and d1d not obJect. Cha1r ordered
hear1ng cont1nued to Apr11 3.
D. Change of Zones to Comply w1th Land Use Element
Secretary expla1ned relat10nsh1p of th1S ord1nance to prev10us ord1nance and
requested cont1nuance. Hear1ng opened. Cha1r ordered cont1nuance to Apr11 3.
Mr. Cook felt other 1tems should be cons1dered w1th zone change and c1ted the
he1ght 11m1t 1n the M-l zone. He suggested that he1ght 11m1t be reduced 1n
all zones to a maX1mum of 27 feet.

In reply to quest10ns, Mr. Neprud expla1ned that Gum Grove Park and Ed1son Park
were not 1ncluded for 20n1ng to prevent 1nverse condemnat10n of pr1vate properjy.

Plans presented for construct10n of a storage bU11d1ng for ma1ntenance equ1pment.
Mr. R1pperdan absta1ned due to former assoc1at10n w1th an arch1tectural f1rm
reta1ned by Rossmoor Center. Mr. Cook moved to approve the plans. Seconded by
Mrs. Lanm ng.
