MINUTES OF THE PLANNING COMMISSION MEETING OF APRIL 3, 1974
The Plannlng Commlss10n of the City of Seal Beach met In regular seSS10n on
Wednesday, Apr11 3, 1974, 1n the Counc11 Chamber of the C1ty Adm1n1strat10n
BU11d1ng The meet1ng was called to order by Chalrman Knapp who led the
Pledge of Alleg1ance to the Flag.
Present Cook, Knapp, R1pperdan, Schm1tt
Absent: Lann1ng
Mrs. Lann1ng's absence was excused due to 111ness.
The m1nutes of the meet1ng of March 20, 1974 were approved as presented.
Secretary Neprud adv1sed of the present status of the publ1C d1sclosure law.
He also rev1ewed the procedure for rece1v1ng test1mony dur1ng a publ1C hear1ng.
1. Publ1C Hear1ngs
A. R1chard & El1zabeth Cooper, V-6-74
Proposal 1S to construct a garage and garage apartment 1n the R-2 zone wlth
var1ance for tandem park1ng and one park1ng space of less than requ1red length
at 317 14th St. It was p01nted out the one park1ng space would be 19 ft. 1n
length to ma1ntaln the requlred turn1ng rad1us. Hear1ng open. No comments
rece1ved. Ne1ghbor asked to reV1ew plans. D1SCUSS10n of proposed land use
agreement. Hear1ng closed. Mr. Cook moved to approve Var1ance V-6-74 subJect
to the execut10n of a land use agreement 11m1t1ng the number of un1ts to 2,
holdlng park1ng for automob11es, and annual 1nspect10n. Seconded by Mr. Knapp
and passed unan1mously by the members present. Resolut10n No. 8190
B The Gold M1ne (Alan Shankmdn), CP-1-74
Appl1cant proposes to construct approx1mately 295 sq. ft. walk-up/take-out
restaurant w1th var1ance for tandem park1ng. Locat10n 1S 218 Maln Street.
Cond1t10nal Use Perm1t requlred for th1S use 1n the C-2 zoneo One letter
recelved from Jane LaMosney protest1ng the proposal as 1ncompat1ble. Hear1ng
open. No comments from aud1ence. Mr. Cook asked 1f other tandem park1ng had
been approved 1n the C zone. Secretary expla1ned there had been. Mr. Knapp
expressed concern about trash generated and asked what prov1s10ns would be
made. Mr. Shankman stated he would provlde a conta1ner or prefered to have
the Clty plaoe another street contalner there. In reply to a quest10n of the
F1re Department's report, 1t was expla1ned that the F1re Department had no
obJect10ns 1f the proposal met all bU11d1ng and health department requ1reMents.
Mr. Cook expressed concern about only one eX1t. Mr. Re1d adv1sed no plan check
had been made, and 1f another eX1t were requ1red lt would have to be 1ncluded
before a perm1t would be 1ssued. Further dlScuss10n of safety problem. Hearlng
closed. Mr. R1pperdan stated he was opposed to the proJect because of the
effect on the area and 1t not be1ng appl1cable to the area. Mr. Schm1tt agreed,
d1d not want to deny use of property, uut was very concerned about trash and
debr1s on the street and area. He suggested the case be cont1nued for more
1nformatlon regard1ng the doors, trash, etc. Appl1cant agreed, and the Cha1rman
ordered the case cont1nued to Apr11 17.

C Amendment to Ord1nance 628 by add1t10n of R/C/P Zone, O-E
Zone, Creat10n of D1str1ct VI, and Rev1s10ns to Sect10ns
1801 and 1803
Secretary rev1ewed h1story of the proposal. Hear1ng open. No comments from
aud1ence Mr. Cook stated he was aga1nst rezon1ng Wh1Ch could have greater
he1ght. He felt he1ght should be an 1ssue and wanted property 1nvolved deferred
unt11 he1ght cons1dered. Secretary adv1sed th1S p01nt would be cons1dered
under the next hear1ng. Mr. Knapp stated the O-E zone had been thoroughly
d1scussed under land Use Element, but asked what 11m1tat10ns effected the I'R"
of the R/C/P zone. Secretary p01nted out word1ng of .med1um dens1tyl. He
also rev1ewed the C1ty Counc11 act10n and d1rect10n. Mr. Cook felt that
14 un1ts per gross acre could surpass R-2 dens1ty and he was not sat1sf1ed w1th
the 1nterpretat10n as the Counc11.s 1ntent. He felt the Planmng Comm1ss10n
was respons1ble to determ1ne dens1ty. Mr. Cook also asked 1f any commerc1al
uses would be requ1red to ded1cate land for recreat10nal use, and a d1Scuss10n
followed on area appl1cable to calculat1ng the requ1red park ded1cat10n.
Mr. Neprud adv1sed of h1S research and request for clar1f1cat10n of 1ntent.
The Department felt the cond1t1onal use perm1t prov1ded control and safeguard.
Mr. R1pperdan asked how property would be developed. Mr. Neprud expla1ned
the procedure 1nclud1ng the Redevelopment Agency, Env1ronmental Impact Report,
and Coastal Comm1ss10n. Mr. Cook wanted net acreage for res1dent1al and control
of populat10n dens1ty, to have the ord1nance reflect net acreage zoned R-2, not
gross acreage. Secretary stated the C1ty attorney.s op1mon that h1S the only
property w1th spec1al zon1ng due to un1queness. Mr. Cook asked 1f the attorney
would call Rossmoor Center un1que and rema1ned adamant on the change of word1ng.
Mr. R1pperdan agreed, but feels 1t should be R-3 due to cost of development.
Mr. Cook p01nted out the land Use Element called for med1um dens1ty. Mr.
Knapp felt the property had been d1scussed at length and needed more gU1del1nes
on zon1ng, dens1ty, use and d1rect10n from C1ty Counc11. Mr. Neprud attempted
to clar1fy the proposed ord1nance and suggested the add1t10n of "for the purpose
of determ1n1ng resldent1al dens1ty only that area for res1dent1al purposes shall
be used for calculat1ng dens1ty." Th1S would ellm1nate use of gross area
1ncludlng the parks1te. Mr. Cook had further concern 1f the property were
d1v1ded. Secretary adv1sed C1ty would have to approve subd1v1s10n or lQt Spl1t.
Mr. R1pperdan wants 1t 1n the ord1nance to be developed as a slngle parcel.
In response to Mr. Schm1tt.s quest10n of what we are propos1ng, Mr. Neprud
expla1ned to follow C1ty Counc11 d1rect10n. Mr. Schm1tt suggested the zon1nq
of R-2/C/P or R-2/C-l/P. Add1t10nal d1Scuss10n regard1ng park w1th Mr. Cook
feel1ng that the requ1rement of a 3 acre ded1cat10n not unusual, but Mr.
R1pperdan d1sagreed as not reasonable. Mr. Cook then suggested sendlng the
proposal to the Counc11 as R/P w1th 3 acres of park requ1red. Hear1ng closed.
Mr. Cook moved to reV1se and approve Art1cle 6A to R/P, Re~1dent1al-Park,
Zone w1th three (3) acres ded1cated to the C1ty, a rn1mmUlll of 1/3 of the parcel
for park use w1th unrestr1cted access, balance of parcel to be R-2, and subJect
to 1ssuance of Cond1t10nal Use Perm1t as spec1f1ed 1n Art1cle 20. Mr. Knapp
stated ne real1Zed the C1ty Counc11 hdd glVen d1rect10n, but seconded the mot10n
w1th reservat10n.

Mot10n fa11ed. In accordance wlth by-laws,
the proposal 1S carr1ed over.

01Scuss10n of proposed amendment to Art1cle 3 establ1sh1ng new 01str1ct VI.
Mr. Cook opposed the proposal and felt no reason to glve spec1al regulat10ns.
In reply to Mr. Schm1tt, Secretary advlsed of locatlon and Slze of undeveloped
property effected. Mr. Cook felt th1S act10n aga1nst Land Use Element.
01SCUSS10n followed. Secretary c1ted the annexat10n agreement. Mr. R1pperdan
felt th1S proposal would reduce present regulat10ns.. Mr. Cook had extreme
concern about followlng the Land Use Element for the total of the Rossmoor
Bus1ness Center.
The O-E Zone was dJeused and Mr. Neprud explalned other 011 ord1nances that
prov1ded add1uonal controls.
Mr. Cook requested delet10n of Sect10n 1, requ1rements of Olstr1ct VI from
Sect10n 4, and Sectlon 5 from total conslderatlon. Hear1ng closed.
Mr. Rlpperdan moved to adopt Sectlon 1 as wr1tten. Seconded by Mr.. Schmltt.

d1ed for lack of a second.

The Chalrman amended the agenda wlth the consent of the members prpsent to
conslder New Buslness.

Appllcant proposes an addltlon to the clubhouse at Old Ranch Country Club.
Mr. Ferrell was present and the plan and need. There would be no lncrease
ln membershlp and no change ln parklnq. Mr. Knapp moved to approve the plans
as presented. Seconded by Mr. Schmltt Resolutlon No. 82],

D. Amendment chang1ng zones of var10US propert1es 1n comp11ance
w1th the Land Use Element to the General Plan
One wr1tten commun1cat10n recelved from Maynard E. Lutts protest1ng Sp11tt1ng
the zon1ng on h1S parcel of land. Th1S lS shown a~ Parcel 56 and lS requested
to rema1n as R-3. Secretary adv1sed that any cons1derat10n of he1ght 11m1tat10n
for M-1 would requ1re advert1sed pub11C hear1ng. He rev1ewed the property
proposed for M-1, the f11ght path, E.I.R. and park1ng that would 11m1t he1ght.
He also adv1sed that owners are th1nk1ng of a m1n1-warehouse, w1th balance of
property to rema1n C-2. Mr. Cook prefered that warehous1ng be 1nc1uded under
the C zone rather than rezone to M. Hear1ng closed.
Mr. Cook moved to approve the chang1ng of zones except de1et1ng Item 30 unt11
he1ght 11m1ts stud1ed, Item 31, Lots 5, 6, 7 and 8 from Item 56. Seconded
by Mr. Schm1tt and passed unan1mous1y by the members present. Res. No. 822.
Secretary adv1sed that R/C/P would be recons1dered.
