MIHUTES OF THE PLANNING COMI1ISSION MEETING OF APRIL 17, 1974
The Plann1ng Comm1ssion of the C1ty of Seal Beach met in regular seSS10n on
Wpdnesday, Aprl1 17, 1974, 1n the Counc11 Chamber of the City Adm1 mstration
Building. The meet1ng was called to order by Cha1rman Knapp at 7:35 p.m. and
Vice Chairman Lann1ng led the Pledge to the Flag.
Present: Cook, Knapp, Lannlng, Schmltt
Absent: Rlpperdan
Mr. Rlpperdan's absence was excused due to buslness.
The mlnutes of the meetlng of Aprl1 3, 1974, were approved as presented.
1. PubllC Hearlngs
A. The Gold Mine (Alan Shankman), CP-1-74 (contDd)
Applicant submltted a letter wlthdrawlnq the appllcatlon for a condltional use
permlt.
B. Corinne Sa1se, CP-2-74
Proposal lS for on-site sale of beer 1n conJunction with an existlng restaurant
at 131~ Maln St. Hearlng open. Applicant present to answer questlons. No
comments from audlence. Mr. Cook asked lf sanitary facilltles requlred by law
are provlded. Mr. Reld explalned license would not be issued untl1 approval
granted by Health Department. Mr. Schmitt asked lf the intent was to serve wlth
meals only and not have a bar. App11cant answered in the afflrmative. Hearlng
closed. Mr. Knapp moved to approve the Conditlonal Use Permlt to be lssued to
Corlnne Sa1se only for a perlod of one year, subJect to renewal. Seconded by
Mrs. Lannlng and passed unanlmous1y by the members present. Resolutlon No. 823.
C. Rossmoor Bus1ness Center (Robert Hirsch), CP-3-74
Secretary reviewed the appl1cation for a res1dentlal board and care home ln the
C-2 zone of Rossmoor Business Center. ThlS is an allowable use in the subJect
zone upon lssuance of a conditlona1 use permit. Variance is requested 1n the
applicat10n for less than requlred parking. Applicant sent a telegram requesting
a continuance to M~ 1 due to a conflict of business committments. Hearing open.
Mr. Schmitt commented on the appllcation because he would be unable to attend
the M~ 1st meetlng. He expressed concern over the parking variance and the
suitability of the proJect in this area. He pointed out the proximity of the
Community Center and theatre with many crowds and heavy traffic. He felt the
nearness of the shopping center could be poor nelghborhood for this type of
residence. Mrs. Lanning also questioned the location, one elevator and parking
inadequacy. Hearlng cont1nued to May 1.
D. Amendment to Ordlnance by Addltion of R/C/P, Residentlal/Commercla1/
Park, Zone
Secretary exp1alned this ltem had been carrled over from the last meetlng because
of 2-2 vote. Contents have not been changed, but can be modifled at the will of
the Commlsslon. Hearlng open. Eileen Cook, 441 Central, commented that the
consultants recommended resldential use 1n the Land Use Element study rather than
commercial. Mrs. Olsen, 707 Central, expressed concern about trafflc generated
by Commercial activltles. Mr. Cook asked what changes would be necessary in the

Land Use Element to zone the area residential/park. Secretary explained the
Land Use Element did not requlre commercial, only that it was allowed. He
also discussed the Clty Council motlon. Planning Commisslon could recommend
modificatlon. Mr. Cook also asked about difference in densi~ adopted in
Dlstrlct VI from that in the Land Use Element. Mr. Neprud explalned that,
ideally, zoning ordlnance should comply with the elemento If changes are made,
the Land Use Element should be amended and the Planning Commission can point
out this inconsistency to the Clty Councl1. Mr. Cook felt consultants were
rlght that the Water and Power property should have high class resldentlal to
give the clty the greatest return and effect, He also was concerned by change
of ownership, development of the area as more than one parcel, and density for
net acreage. Mr. Schmitt felt the resldentlal-park zone too 11mlted. The
R/C/P zone allows the Council more latltude but does not obligate commercial
development. He felt a nice restaurant could be excellent and serve all
resldents while a park ~culd glve a choice locatlon to a few. Mrs. Olsen
stated a restaurant would detract from Maln St. business. and would not be
approprlate wlth old town houses. Mrs. Lannlng felt the Clty needed a good
restaurant. Mr. Cook clted the peoplels obJection to a restaurant on Pacific
Coast Highway recently and the concern of residents of any development at the
base of the pier. Mro Cook also felt there should be clarification of intent
of the parkslte on the W/P property if two parcels developed separately. He
asked if any other city had a sfml1ar zone. Mr. Neprud replied not to his
knowledge, but City Attorney had advised it was legal. Mr. Neprud also explalned
that others have unclassifled or undeslgnated zones to allow a variety of uses.
He concluded the ObV10US reason for the R/C/P zone was due to implied dlrection
by the Land Use Element and the requlrement to comply. D1Scussion of conformity
with Land Use Element on other actlons. Secretary to point out deviatlons to
City Councl1 and the problems regarding the annexation agreement. Hearing closedo
Mro Cook moved that the Water and Power property be zoned as R-2/P, Medlum Density
Residentlal/Park, wlth 1/3 reserved for park and unrestrlcted access, subJect to
lssuance of Condltlonal Use Permit per Artlcle 20, and denslty per net acreage.
Seconded by Mr. Knapp.

Absent: Ripperdan
Motion failed.
Mr. Schmitt stated he dld not disagree wlth Mr. Cook1s pOlnt, but that the pOlnt
dld not apply to certain propertyo He felt Mr. Cookos motion was not germalne
to agenda item. Mr. Schmitt moved to recommend the approval and adoption of
Artlcle 6A, R/C/P Zone. Seconded by Mrs. Lanning. Discusslon followed, including
whether thlS action would automatically amend the zoning map.

Noes: Cook, Knapp
Absent: Rlpperdan
Motion falled.
Because of tie vote, to be continued to next meetingo
E. Change of Zone of 9+ acre parcel adjacent to San Gabrlel River
Secretary recommended continuance until ~oning designatlon resolved. D1SCUSSlon
followed. Hearlng opened. No comments, the Chairman continued the hearing to
May 10

Mr. Cook expressed concern about an article that appeared 1n the LoA. Times
regarding the Bixby property. His impression was the Planning Commiss10n
approval recommended use of the land be subJect to review by the Alrport Land
Use Commission, not as implied, a stamp of approval, and requested the lssue
be returned to the Planning Commiss10n. Secretary Neprud adv1sed of the A.LoUoC.
action, and the public agency must conduct ada1t10nal hearing. The Attorney
is studying to see if Planning Commiss10n or City Council will process and lt
could come before the Planning Cornmlssion on May 5. Mr. Schmitt requested a
ruling by the Attorney regarding any confl1ct of interest in th1S applicat10n.
