HomeMy WebLinkAboutPC Min 1975-02-05 ~ . . . e e ~ MINUTES OF THE PLANNING COMMISSION MEETING OF FEBRUARY 5, 1975 The Plann1ng Comm1ss1on of the C1ty of Seal Beach met 1n regular seSS10n on Wednesday, February 5, 1975, 1n the Counc1l Chambers of the C1ty Adm1n1strat1on BU1ld1ng The meet1ng was called to order bv Cha1rman Lann1ng at 7 30 p.m and the Pledge to the Flag was led by V1ce Cha1rman R1pperdan Present Cook, Schm1tt, R1pperdan, Knapp, Lann1ng Absent None The m1nutes of January 15, 1975, were unan1mously approved as corrected 1 Publ1C Hear1ngs A Harvey Webb (Carl Irw1n), V-1-75 Request to perm1t a 611 structural encroachment 1nto a requ1red slde yard for forty-four feet of a second story add1t1on to an eX1st1ng slngle fam1ly res1dence at 701 Taper Dr1ve Publ1C hear1ng opened Carl Irw1n, 1631 Atlant1c Ave , Long Beach, stated that the encroachment was due to an 1naccurate f1eld measurement when the plans were drafted He p01nted out that the encroachment began at about 9 ft above grade, the natural grade had not been chanqed and a 12'611 d1stance eX1sted between the subJect house and the ne1ghbor's house Harvey Webb, 701 Taper Dr1ve, spoke 1n favor of the request. No one spoke 1n Oppos1t1on to the var1ance Publ1C hear1ng closed Mr Knapp moved to approve V-1-75, seconded by Mr R1pperdan and unan1mously approved. Resolut1on No 887 B Thomas Greeley, CP-1-75 Request to perm1t structural alterat10ns to a nonconform1ng slngle fam1ly res1dence 1n the R-3 zone, nonconform1ng by reason of less than requ1red park1ng, substandard rear yard and one substandard slde yard at 1629 Seal Wav The proposal 1S to add 70 Sq ft to an eX1st1ng second story art1st StUd10 above the eX1st1ng qarage. Publ1C hear1ng opened. Thomas Greeley, 1629 Seal Way, stated that the StUd10 add1t1on was actually the enclos1ng of an eX1st1ng open porch at the second level In response to a quest1on, Mr Greeley stated that h1S garage was currently used for storage of mater1als 1n conJunct1on w1th the general renovat1on of the house and that he would shortly be open1ng up the garage for automob1le park1ng No one spoke 1n Oppos1t1on to the reauest Publ1C hear1ng closed. Mr R1pperdan moved to aoprove CP-1-75, seconded by Mr Knapp and unan1mously aoproved Resolut1on No. 888 2 Oral Commun1cat1ons Mrs Dorr, 236 6th St., asked what pr1or1t1es the Plann1ng Comm1ss1on had establ1shed for Hous1ng and Commun1ty Development Act moneys and what proJects the f1rst year's funds would be used for Secretary answered. 3 Wr1tten Commun1cat1ons All wr1tten commun1cat1ons were w1th spec1f1c agenda 1tems ~ . . . e . 4 4 Unflnlshed Buslness A Bruce Taschner, A-5-74 Appeal, A-5-74, flled by Bruce Taschner on Plannlng Commlsslon denlal of Varlance V-35-74 for a wall In excess of maXlmum helght In the front yard setback at 601 Beachcomber Dr Appeal was referred by Clty Councll to the Plannlng Commlsslon for a report Clty Councll consldered the matter of A-5-74 on January 13, 1975, and voted to refer the matter to the Plannlng Commlsslon wlth the recommendatlon that the Commlsslon conslder the unusual locatlon of the property as lt relates to nOlse levels as qrounds for approval of the request Mrs Taschner, 601 Beachcomber Dr., spoke In favor of the appeal notlng that trafflc on Bolsa was heavy, nOlse from the street and school was dlsturblng and that they had experlenced theft and vandallsm at their house. She stated that the qates as proposed were bl-fold gates WhlCh would not obstruct turnlng movements of automoblles The Plannlng Commlsslon was of the oplnlon that the wall as bUllt would not effectlvely dlmlnlsh nOlse It was pOlnted out that trafflc speed should be reduced due to the new stop slgn at Bolsa and Balboa The locatlon of the property lS not dlrectly across the street from the school and, therefore, any nOlse from the school would affect other propertles to a greater degree than the subJect property It was pOlnted out that the garage at 601 Beachcomber could not be used for the parklng of two automoblles due to a partltlon In the garage maklng an offlce In a portlon of the garage The Plannlng Commlsslon was of the oplnlon that the Commlsslon lS bound by a strlct lnterpretatlon of the code and varlance can be approved for mlnor requests ,only. Mr Knapp moved, seconded by Mr. Rlpperdan, to afflrm the Plannlng Commlsslon prevlous actlon as contalned In Resolutlon 878. Prlor to vote Mrs. Lannlng stated that lf she were present at the meetlnq where Resolutlon 878 was adooted, she would have supported the denlal of the varlance. Ayes Noes Absent Abstaln Knapp, Rlpperdan, Schmltt Cook None Lannlng Motlon carrled Resolutlon 889 5 New Buslness A Conslderatlon of Appllcatlon Forms The Plannlnq Commlsslon revlewed forms for submlsslon of varlOUS appllcatlons After dlScusslon the forms were unanlmously approved as corrected by mlnute order 6 Report from Secretary A Secretary reported on the results of the questlonnalre dlstrlbuted to the audlence durlng the Plannlng Commlsslon's publlC hearlng on the Houslng and Communlty Development Act of 1974 B Secretary reported that the Alrport Land Use Commlsslon for Orange County took an actlon WhlCh, In effect, cast doubt on the Clty'S rezonlng of property In compllance wlth the Land Use Element and that a number of parcels ~ . . . . . 4 for var10US reasons were not rezoned 1n compl1ance w1th the Land Use Element The Plann1ng Comm1ss10n d1rected staff to advert1se for a publ1C hear1ng on February 19th to reaff1rm zon1ng 1n compl1ance w1th Sec 21676 of the Publ1C Ut111t1es Code and to advert1se for a publ1C hear1nq on February 19th to cons1der chanq1ng the zone on other parcels 1n compl1ance w1th the Land Use Element to the General Plan C Cha1rman Lann1nq announced that the Plann1ng D1rector and the Plann1ng Comm1ss10n Cha1rman would speak at a meet1ng 1n Le1sure World on the subJect of "Future of Planmng 1n Seal Beach II The meet1ng was adJourned at 9 00 p.m ~ a!i:J Act1ng Record1ng Secretary
