The meet~ng was called to order by Cha~rman Lann~ng at 7 30 p.m. and the Pledge to the Flag was led by V~ce Cha~rman R~pperdan. Present Absent Cook, Sch~tt, R~pperdan, Knapp, Lann~ng None The m~nutes of February 5, 1975, were approved as presented 1 Pub1~c Hear~ngs A. Mar~on F. Conrad (Wm. S~verson), V-2-75 Request to perm~t construct~on of a s~ng1e fam~ly Surfs~de w~th var~ance for (1) less than requ~red (2) stairway encroachment ~nto a requ~red garage, walkway above f~rst l~v~ng level. Pub1~c Hear~ng Mr Sch~tt moved to postpone a.ct~on on th~s seconded by Mrs Lann~ng and unan~mous1y passed residence ~n the R-1 zone of s~de yard setback on one s~de, and (3) sta~rway and elevated Opened Pub1~c Hear~ng Closed. issue unt~l March 5, 1975, (App1~cant requested cont~nuance) B Cons~derat~on of Chang~ng Zone of Var~ous Parcels of Land ~n Comp1~ance w~th the Land Use Element to the General Plan Mr. Neprud exp1a~ned the four parcels ~n quest~on for this hear~ng. Public Hear~ng Opened. Mrs Pe1och~no, from 117 Ocean Ave bought her property at 400 Mar~ne Dr when ~t was C-2 zone. This property was purchased as a l~fe t~me investment, and she felt that a change of zone to R-3 would be a great hand~cap. A d~scuss~on followed between COmm1ss~oners and Mrs. Pe1och~no as to where the R-3, h~gh dens~ty res~dent~al area should start or stop. Mrs. Pe1och~no po~nted out her property bordered commerc~al property, but d~d not feel she was able to answer th~s part~cular quest~on. Mr. Pe1och~no stated the~r property faced an arter~a1 h~ghway and 400 Mar~na Dr. was ~n the m~ddle of the commerc~a1 area. Mr. Steven Kenyon, from 211 13th St. felt log~cal1y and techn~cal1y there ~s no reason that Mr. and Mrs. Pe1och~no's property could not be zoned commerc~a11y. He ref~rred to the general plan and found noth~ng ~n it that excluded th~s property from commerc~al use. The Comm~ss~oners had no obJect~on to the use of the property for commerc~al use, but felt ~t unpract~ca1 to zone ~t C-2, C-l would be someth~ng that would be more appropr~ate. Mr. Cook moved the ~ssue be postponed unt~l March 5, 1975 for cons~derat~on. Mr ~pperdan seconded the mot~on and ~t was unan~mously passed Discuss~on and c1ar~f~cat~on followed on ~tems B, C, D, Mr. ~pperdan moved ~tens B, C, D, be approved, the motLou was seconded by M~ Cook and unanLmously passpd by memoers present Res. Aff~rm Zon~ng on Var~ous Parcels of Land ~n Compl~ance w~th Sec 21676 of Publ~c Ut~lit~es Code Mr. Neprud expla~ned the ~tem ~n quest~on, expla~n~ng that the purpose of th~s hear~ng so there would be no uncerta~nt~es about zon~ng. Mr. Schm~tt moved for approval of the aff~rmat~on, the mot~on was seconded by Mr. Cook and unan~mously passed. Res. No I 891. Snafr d~rected to advert~se for Publ~c Hear~ng on 6 ac B~xby Property to change to P.L.U. 2. Oral Commun~cat~ons There were no oral commun~cat~ons 3 Wr~tten Commun~cat~ons All written commun~cat~ons were with spec~fic agenda ~tems. 5 New Bus~ness A. Determ~nat~on of Zone - Auct~on House Both the Pol~ce Department and the staff felt an auct~on house in that locat~on would not be a pract~cal bus~ness to l~cense. The Commiss~oners d~scussion delet~ng prov~s~ons for l~cens~ng of that sort. Mr. Sch~tt felt a bus~ness of th~s k~nd could be an asset to our commun~ty at some t~me and felt the l~cens~ng of these bus~nesses should not be deleted from th~s c~ty. Mrs. Lann~ng was ~n agreement w~th Mr. Schm~tt. Mr. Sch~tt moved th~s ~ssue should be held over unt~l the next meet~ng. Mr R~pperdan seconded the mot~on and ~t was unan~mously passed. B. Clar~f~cat~on of Use - Roof-mounted Greenhouse ~n Res~dent~al Zone Mr. Knapp felt th~s could allow a mult~tude of stuctures to be bu~lt, there ~s a need for a def~n~t~on. He felt th~s to be an unsafe stucture ~n t~me of d~saster. Mr. R~pperdan felt ~t unnecessary to r~le out greenhouses, but deter~ned l~m~ts should be set Under certa~n s~tuat~ons th~s could be benef~c~al to the commun~ty. Mr. Knapp moved roof-mounted greenhouses ~n res~dent~al zone not be allowed Seconded by Mr. Cook Res.
