MINUTES OF THE PLANNING COMMISSION MEETING OF MAY 7, 1975
~ The Plann~ng Comm~ss~on of the C~ty of Seal Beach met ~n regular sess~on on
Wednesday, May 7, 1975, ~n the Counc~l Chambers of the C~ty Adm~n~strat~on
Bu~ld~ng The meet~ng was called to order by Cha~rman Lann~ng at 7 30 p m
and the Pledge to the Flag was led by V~ce Cha~rman R~pperdan.

The Secretary rev~ewed the method for rece~v~ng publ~c test~mony at meet~ngs.
1. Publ~c Hear~ngs
A. Robert Herron, V-8-75

Request var~ence to perm~t a porch add~t~on to a nonconform~ng s~ngle fam~ly res~-
dence ~n the R-I zone, nonconform~ng by reason of substandard s~de yards, c~mney
encroachment ~nto a s~de yard and park~ng spaces of less than requ~red depth The
Secretary read all wr~tten commun~cat~on both ~n agreement and oppos~t~on referr~ng
to the matter Publ~c hear~ng opened. Robert Herron, A-68 Surf~s~de expaa~ned he
needed enlarged porch add~t~on due to the follow~ng hardsh~ps 1) the l~v~ng area
~s located on the second floor, where the porch ~s requested, 2) an escape route ~n
case of f~re e g , Jump~ng from the th~rd floor of house, the porch would act as
buffer on second floor, and 3) add~t~onal area for ch~ldren to play. Mr. Herron
d~d not feel ~t would be a hardsh~p to any of h~s ne~ghbors ~f the porch was con-
structed He also po~nted out th~s matter w~ll be d~scussed at the next Share-
Holders Meet~ng. Mr Schm~tt suggested cont~nuat~on of construct~on not deal~ng
w~th porch unt~l the matter was resolved at the Share-Holders Meet~ng. However
Mr R~ed ~nformed the Gomm~ss~on the proJect can not cont~nue unt~l th~s spec~f~c
matter has been resolved. Mr Cook asked about alternate routes ~n case of f~re
Mr Herron expla~ned there was another ladder ava~lahle, but do to ~tls s~ze
one would be unable to carry another obJect wh~le descend~ng from bu~ld~ng. Mr.
R~pperdan asked how the porch was approved ~n the f~rst place, Mr R~ed expla~ned
"om~ t" was placed on the bhe pr~n,ts of the plans before ~ t was constructed Mrs
Sm~th, A-67 was ~n agreement w~th the conffiract~on cf1the porch Also ~n agreement
w~th the porch for the reason(s) p01nted out by Mr Herron was, Mrs Legerton,
1307 Seal Way, Mr. Leonard, B-68, Mr Daly, A-69, res~dent of A-61, ~nd MrsoLeDn~rd,
B-68. A res~dent from B-58 and Representat~ve of the Board of D~rectors of Surs~de
opposed the construct~on of the porch because he feltgu~de l~nes for zon~ng shluld
be followed A res~dent for A-50 opposed the porch because he felt the rules should
be enforced ~n order to have stab~l~ty of gu~del~nes, and he also felt the porch
was not necessary for recreat~on area Mr Bruton, B-61 would not only l~ke to see
the standards ma~nta~ned, but he feels th~s construct~on would enchroach on other
res~dent's v~ew Mr Knapp felt the extens~on of the second floor porch for means
of escape was unreal~st~c. Mr Cook suggested cutt~ng back on th~rd floor porch.
Mr R~pperdan suggested recess~ng l~v~ng ro~m wall for enlargement of porch Publ~c
hear~ng closed Mr Schm~tt felt th~s was a hardsh~p case because the ~ssue has
not been dec~ded by the Share-Holders and ~f they approve of the second floor porch,
there would be a waste of the mater~al used for the enlarged porch whe~e the beams
stand now Mr Knapp, Mr~,rR:iLppe~dan~ and Mr Cook felt th~s was not a hardsh~p case.
Mr Cook moved to deny V-8-75, Mr R~pperdan seconded tl! mot~on

requ~red rear yard setback Publ~c hear~ng opened Mr. Joseph Krader, 3540 Bluebell
Street felt the freeway no~se created a hardsh~p case Mr Schm~tt fa~led to see how
these obJects would protect the house from any no~se because they were not located
between the freeway and the house Mr R~pperdan asked ~f the pat~o was cons~dered
an accessory bu~ld~ng. The Secretary expla~ned that ~t was an accessory bu~ld~ng,
and ~t had to have the same rear yard setback Mr. Stoner, 3560 Bluebell Street
felt Mr. Krader's ne~ghbors were very sat~sf~ed w~th the stucture because they were
such a good no~se block. Mr. Hughes, 3541 Camel~a Street, felt Mr Krader's struc-
tures were very uns~ghtly, wh~ch was very unfa~r to the ne~ghbors Publ~c Hear~ng
closed. Mr Cook felt there was no hardsh~p to warrent a var~ence Mr Cook moved
to deny V-9-75 Mr. Knapp seconded the mot~on and ~t was unan~mously passed by the
members present. Resolut~on No 907
C Calv~n Ehler (Mar~o Ross~), V-IO-75
Request var~ence to perm~t add~t~ons to a nonconform~ng s~ngle fam~ly res~dent ~n the
R-l zone, nonconform~ng by reason of less than requ~red s~de yards and less that
requ~red park~ng Publ~c hear~ng opened. Mr. Ross~, Arch~tect felt th~s to be a
un~que s~tuat~on ~n terms of the conf~gurat~on of the house and how ~t ~s s~tuated on
the lot, wh~ch presents a hardsh~p for the owners The Comm~ss~on d~scussed other
poss~ble arrangements yet none were feas~ble. Publ~c hear~ng c10sed. Due to the
layout of the bu~ld~ng, Mr R~pperdan felt t~s was a hardsh~p case Mr Schm~tt
moved to approve V-IO-75 The mot~on was ~ecoRdednby Mr. R~pperdan and passed

order by Cha~rman Lann~ng at 9 29p.m
D. D~ck Schuster (Joe Dav~s), V-11-75
Request to perm~t a lot spl~t of 2 lots of record to create three lots w~th var~ance
for less than requ~red lot w~dth Publ~c hear~ng opened Mr Dav~s, 10961 Bloomf~eld
Steet ~n Los Alam~tos felt th~s s~ze of lot to be common ~n the ne~ghborhood, and
the three lots would be much more econom~cally feas~ble Mr Cook felt by spl~tt~ng
the lots a hardsh~p would be created Publ~c liear~ng closed. Mr Knapp felt the
homes proposed were not ~n conJunct~on w~th the ones ther~ and there was no use ~n
bu~ld~ng homes wh~ch would be nonconform~ng Mr Schm~tt felt the 6ft waIf would not
be adequate as a no~se block, he also felt the block would not accommodate the fam~l~es
mov~ng ~nto the houses Mr Schm~tt moved to deny V-11-75. The mot~on was seconded
by Mr Cook and passed unan~mously by the members present Resolut~on No 909

Irv~ne po~nted out he could f~ll the requ~red park~ng spaces, but s~nce ~t ~s a dr~ve-
through bus~ness ma~nly there ~sn't the necess~ty for add~t~onal park~ng Mr.
Schm~tt felt ~t very ~llog~cal to add the park~ng spaces ~n the rear where a f~re
ex~t would be much more su~table Mr Cook felt there was adequate park~ng w~thout
know~ng outlook of f~nal~zed bu~ld~ng, but would d~rect the appl~cant to look at the
need for add~t~onal park~ng Publ~c hear~ng closed Mr R~pperdan moved to approve
CP-5-75 ~nclud~ng both the restaurant and the park~ng, w~th the st~pualt~on that
the owner make every effort to prov~de add~t~onal park~ng The mot~on was seconded

Plann1ng Comm1ss10n 1n approv1ng or denY1ng th1s app11cat10n 1S f1nal and conclus1ve
unless the Plann1ng Comm1ss10n's act10n 1S appealed to the C1ty Counc11 w1th1n ten
days Appeal app11cat10ns may be obta1ned from the Plann1ng Department.

Jean Dorr 231 6th St asked what was be1ng done to the property on the SW corner of
Westm1nster Ave and Seal Beach Blvd) The Secretary expla1ned that was the property

Westm1nster Ave and Seal Beach Blvd. Mr Ball 1 expla1ned the plans Mr Cook
was concerned w1th thelaCk.Of loadlng spaceIt was expla1ned that load1ng and de11ver1ng
were done at such t1mes of the day that th1s d1d not present a problem Mr Knapp

Plan reV1ew on s1gn program for shopp1ng center Mr SChm1tt felt there no need for
any S1gns to be placed 1n such an unfettered area. Mr SChm1tt moved to approve
the S1gn cr1ter1a as out11ned 1n the Staff Report The mot10n was seconded by Mr.
R1pperdan and approved unan1mously by the members present Resolut10n No 912

Plan reV1ew for s1gn1ng for an eX1st1ng commerC1al bU11d1ng 1n the C-l zone. A
Representat1ve of Heath and Co ,Inc 3225 Lacy Street, Los Angeles, descr1bed the
s1gns and felt they would be very advantagous to the new bus1ness Mr. Knapp
felt a S1gn was no 1mprovement Mrs Lann1ng obJected to the roof S1gn. Mr. Knapp
felt the shopp1ng center was well estab11shed and was not 1n need of S1gns for
advert1s1ng Mr Knapp moved to approve the s1gn 1f the 3 by 5 modules were lowered
to the face of the store Mr Cook seco~d the mot10n and 1t was approved unan1mously
by the members present Resolut10n No 913
5 Report from Secretary
Mr Neprud presented the Comm1ss10n w1th a copy of the Se1sm1c-Safety Element for
the1r cr1t1C1sm. The Comm1ss10n d1scussed the legal conS1quences of the Seal Beach
Fault The Comm1sS10n was 1n general approval of the plan, they felt 1t was a very
f1ne plan

Mr SChw1tt asked about the property located at Ma1n and Ocean. It 1S presently
1n front of the C1ty CounC11. Mr Neprud 1nformed the Comm1ss10n of a poss1ble
