MINUTES OF THE PLANNING COMMISSION MEETING OF JULY 16, 1975

The P1ann1ng Commiss1on of the C1ty of Seal Beach met 1n regular session on
Wednesday, July 16, 1975, 1n the Counc11 Chambers of the C1ty Adm1nistrat1on
BU11d1ng. The meet1ng was called to order by Cha1rman Lann1ng at 7.30 p.m.
and the Pledge to the Flag was led by V1ce Cha1rman R1pperdan.

Absent: None
The m1nutes of July 2, 1975, were approved as subm1tted.

The Secretary rev1ewed the method for rece1v1ng pub11C test1mony at meet1ngs.
1. Pub11C Hear1ngs

App11cant lS request1ng approval for structural mod1f1cat1ons to a nonconform1ng
slng1e fam11y res1dence 1n the R-1 zone of Surfs1de. The matter was held over
to glve the app11cant an opportun1ty to present rev1sed plans. Pub11C hear1ng
opened. Dr. Sm1th, owner of A-51, exp1a1ned the proposed changes to the bU11d1ng
1nc1ud1ng the re10cat1on of a water heater from the substandard garage. D1Scuss1on
followed on the opt1ons of re10cat1ng the sta1rway and en1arg1ng the garage to
accommodate a standard slzed car. Dr. Sm1th d1scussed the poss1b111ty of a
replacement garage door to prov1de a more usable park1ng space. Pub11C hear1ng
closed. A quest10n was ra1sed regard1ng d1mens1ons on the plans. Cook moved
to approve CP-6-75 subJect to (1) approval supersed1ng pr10r var1ance approval,
(2) BU11d1ng Department 1nspect1on of all work, and (3) water heater relocated
outs1de of the garage. Seconded by Schm1tt.

B. Jack Haley, V-13-75
App11cant lS request1ng approval of a S011d roof and glass slded pool cover in
the rear yard setback of the R-1 zone 1n D1str1ct I. Pub11C hear1ng opened.
Jack Haley, 404 Ocean, descr1bed the mater1a1s to be used 1n the structure and
stated that the enclosure would e11m1nate the need of ra1s1ng the fence 1n the
rear yard to 6 ft. and should prov1de greater safety than a fence. The Comm1ss1on
d1scussed the proposal and quest10ned the app11cant regard1ng hardsh1p. Mr.
Haley was of the op1n1on that hardsh1p eX1sted due to the 10cat1on of the
property adJacent to the beach. Pub11C hear1ng closed. R1pperdan moved to deny
V-13-75, seconded by Cook.

Appllcant lS requestlng approval for converSlon of side entry garage to llvlng
quarters and constructlon of a replacement garage wlth varlance for less than
requlred front yard setback In the R-l zone In College Park West. PubllC hearlng
opened. Roy Benstead, 132 Yale Lane, presented a petltion of nelghbors who
favored the proposal. Appllcant stated that the addltlonal area was needed for
actlvltles he conducts for hlS church and scouts. Blll Jones, 192 Yale Lane,
spoke In favor of the appllcatlon. D1Scusslon followed on alternatlve locatlons
for the addltlon. PubllC hearlng closed. Knapp moved to approve V-14-75,
seconded by Rlpperdan.

Appllcant lS requestlng a Condltlonal Use Permlt for on-sale beer and Wlne In
conJunctlon wlth a restaurant dellcatessen In the C-l zone in the Lelsure World
Shopplng Center. PubllC hearlng opened. Mrs. LUtltO, 6321 Crest Ave., Buena Park,
revlewed the proposed operatlon and stated that she had operated other slmllar
bUSlnesses In the past. Mrs. Lannlng spoke very hlghly of the operatlon and
the cleanllness of the buslness. PubllC hearlng closed. Schmltt moved to
approve CP-7-75 subJect to staff condltlons, seconded by Cook and unanimously
approved. Resolutlon No. 934.
E. PubllC Hearlng on NOlse Element to the General Plan
Secretary explalned the purpose and lntent of the Element and outllned the
lmplementatlon measures. PubllC hearlng opened. Dale Stoner, resldent of
College Park East stated hlS support for the proposed sound barrler wall to be
constructed In College Park East to help reduce nOlse from the freeway. PubllC
hearlng closed. Schmitt moved to approve the Element and recommend to Clty
Councll adoption of the Element, seconded by Knapp and unanlmously approved.

2. Oral Communlcatlons
Jean Dorr, 231 6th St., asked Secretary lf water heaters were permltted In
garages. Secretary stated that water heaters may be located In garages under
certaln condltlons.
3. Written Communlcatlons
There were no wrltten communlcatlons.
4. Unflnlshed Buslness
A. Referral by Clty Councll of zonlng on 9 acre parcel located
west of Seal Beach Blvd., north of San Dlego Freeway, and
south of the communlty of Rossmoor
Secretary revlewed the hlstory of the parcel lncludlng the varlOUS actlons that
have been recently taken by both Plannlng Commlsslon and Clty Councll. Secretary'
revlewed the alternatlves open to Plannlng Commlssion lncludlng a staff

recommendat1on to delete certa1n undes1rable uses 1n the M-l zone, requ1re a
cond1t1onal use perm1t for M-l development as well as a requ1rement for an
1ndustr1al park concept on all M-l development. Roy Kransky, Rossmoor
Homeowners Assoc1ation, opposed development of the property due to its 10cat1on
and h1S opin1on that certa1n a1rcraft crash hazard eX1sted. Mrs. Peterson,
3351 Yellowta1l Dr., supported the Planning Comm1ss1on's preV10US dec1s1on to
recommend C-O zon1ng for the parcel. Knapp moved to reaffirm the Plann1ng
Comm1ss1on's previous recommendat1ons for a C-O zone on the property, seconded
by Cook.

5. New Bus1ness
A. Joyce Rauschenbach - Rev1ew of Parcel Map
The Plann1ng Comm1ss1on rev1ewed a parcel map subm1tted as a cond1tion of
Plann1ng Comm1ssion Resolut1on 898 Wh1Ch approved a lot Spl1t to create two
37~ ft. lots 1n the 200 block of lOth St. Knapp moved to f1nd the parcel
map 1n compl1ance w1th the Plann1ng Comm1ss1onls requ1rement for subm1ss1on of a parcel map,
seconded by Schm1tt and unan1mously approved.
6. Report from Secretary
Secretary reported that staff 1S work1ng w1th the bus1nessmen on Main St. and
1nterested res1dents to formulate a Spec1f1c Plan for Main St. Sketch plan
alternat1ves w1ll be presented on July 23rd at 7.30 p.m. 1n the Counc1l Chambers.
The meet1ng was adJourned at 10.13 p.m. by Cha1rman Lann1ng.
