The meetlng was called to order by Chalrman Lannlng at 7.30 p.m. and the Pledge to the Flag was led by Vlce Chalrman Rlpperdan. Present: Knapp, Rlpperdan, Schmltt, Lannlng Absent Cook (excused) The mlnutes of September 17, 1975 were approved as presented. 1. Public Hearlngs A. Proposed Speciflc Plan for Maln Street (contlnued) Secretary gave a staff report on the proposed plan lncludlng the varlOUS alternatlve actions open to the Commlsslon. Secretary stated that Asslstant Clty Attorney, Pat Coughlan, was present to answer legal questlons. PubllC hearing opened. Chalrman Lannlng stated that she llstened to the tape recordlng of the meetlng of September 17, 1975, and would partlcipate In dlScusslon and votlng on the matter of the Speclflc Plan for Main Street. Lawrence Peters, an attorney on Maln Street, spoke In favor of the Plan and uSlng the Redevelopment Agency for lmplementlng the Plan. R1Ch Harbour asked the Clty Attorney what power the Agency has to take property. The attorney replied that both the Clty and the Agency make take property, but that generally an Agency has more money and could, therefore, theoretlcally take more property. He suggested that In evaluatlng the eventuallty of an Agency taklng property, the lndlvldual Agency should be consldered Slnce attltudes and phllosophles vary from agency to agency. Sven Llndstrom, representlng the Masonlc Lodge, spoke In Opposltlon to the lncluslon of Maln Street In the Agency. John Vandette, representlng the new owners of the Bay Theatre, spoke In favor of the Plan but made no comment on impl ementatl on. Peter Ebellng spoke In favor of the Plan and uSlng the Agency for lmplementatlon. Dr. Morrls, owner of 7 bUlldlngs on Maln Street, spoke in oppositlon to the plan. Helena Smlth spoke In favor of the Plan and Agency lmplementatlon. Susan Salsbury spoke In favor of the Plan and Agency lmplementatlon. Howard Brlef spoke In favor of the Plan but suggested the Agency go from sldewalk to sldewalk and not take in Maln Street propertles. Martln Murphy spoke In favor of the Plan and uSlng the Agency from sldewalk to sldewalk. Clty Attorney stated that havlng the Agency go from sldewalk to sldewalk would vlolate Redevelopment Agency Law and the Attorney General would most probably challenge any such attempt by the Agency. Kay Carrol spoke In Opposltlon to the Maln Street belng lncluded In the Agency. Howard Brlef asked about various methods of flnanclng the Plan lmprovements uSlng a comblnatlon of capltal lmprovement funds, Housing and Communlty Development Act funds and an assessment dlstrlct. Secretary replled that such a method was posslble. Jean Dorr spoke In favor of the Plan and Agency lmplementatlon. Sven Llndstrom and R1Ch Harbour spoke agaln In Opposltlon to the Agency for varlOUS reasons. John Nescher spoke In Opposltlon to the Agency because of hlS oplnion that taxes would lncrease. Fremont Wood spoke In oPPosltion to both the Plan and Agency lmplementation. Mr. Plnado spoke on the pros and cons of redevelopment agencles. Charles Hutchinson spoke In oppositlon to the Agency. Chalrman Lannlng declared a 10 mlnute recess. ~ . . . e e 4 Chalrman Lannlng called the meetlng back to order at 9'15 p.m. Hank Lucero, representlng the Downtown Buslnessmen's Assoclatlon, spoke In favor of the Plan but did not comment on lmplementation methods. PubllC hearlng closed. CommlSSloner Schmltt stated hlS support for the Plan and the Redevelopment Agency as an lmplementing tool based upon the speed, practlcallty and percelved beneflts to be derived for the Clty as a whole as well as for the Maln Street area. Commlssloner Ripperdan concurred wlth Schmltt's comments. Rlpperdan moved to recommend to Clty Councll adoptlon of the Speclflc Plan for Main Street wlth the Redevelopment Agency as the lmplementlng tool. Seconded by Schmltt. Commlssloner Knapp spoke agalnst the motlon based upon the lack of urgency to lmplement the Plan at thlS tlme. He suggested that Houslng and Communlty Development Act funds and capltal lmprovement funds be used to lmplement the Plan over an extended perlod of tlme. Ayes' Noes' Absent. Lannlng, Ripperdan, Schmltt Knapp Cook Motlon carrled. Resolutlon No. 949. B. Amendments to the M-l provlslons of the Zonlnq Ordlnance Secretary presented a staff report outllnlng the obJectlves of the proposed amendments. PubllC hearlng opened. Ray Krlnsky, representlng the Rossmoor Homeowners Assoclatlon, spoke In Opposltlon to a zoning actlon taken by the Clty Councll and in Opposltlon to various M-l uses that could be lncompatlble wlth nearby resldential development. Charles Ball of Buslness Propertles suggested that the city reVlew lndustrlal standards for Irvlne and Newport Beach. He recommended that the Clty adopt a set of development crlterla rather than use a conditional use permlt for all development. PubllC hearlng closed. The Plannlng Commlssion voted to hold the matter over untll October 15, 1975, to give staff an opportunlty to research other lndustrlal provlslons In other cltles. 2. Oral Communicatlons There were no oral communlcatlons. 3. Wrltten Communlcatlons All wrltten communlcatlons were In conJunctlon wlth speclflc agenda ltems. 4. New Buslness A. Buslness Propertles (Sambos), PR-11-75 Appllcatlon for two slgns In conJunctlon wlth a restaurant at the Business Propertles development at Westmlnster and Seal Beach Boulevard. Charles Ball spoke In support of the appllcatlon and to permlt the free standlng slgn structure to be 17 foot hlgh. Knapp moved to approve PR-11-75 subject to 16 foot overall helght for the free standlng sign. Seconded by Lannlng and unanlmously approved by the members present. Resolutlon No. 950. ~ . . . e e 4 5. Report from Secretary Secretary announced that Annexatlon 75-1 was complete. Secretary announced that Chalrman Lanning had served on the Plannlng Commisslon for ten years.
