DATE: TO: May 27, 2008 THRU: Honorable Mayor and City Council David Carmany, City Manager FROM: Vincent Mastrosimone, Director of Public Works SUBJECT: ACCEPTANCE OF THE MAIN STREET PARKING LOTS REHABILITATION PROJECT NO. 50237 SUMMARY OF REQUEST: The proposed City Council action will adopt Resolution No. 5732 to formally accept completion of construction for the Main Street Parking Lots Project No. 50237. BACKGROUND: . On February 11, 2008, City Council awarded a construction contract to Imperial Paving Company, Inc. for $34,837.50 for construction of the Main Street Parking Lots Project No. 50237. In accordance with the contract documents, Imperial Paving Company, Inc. has completed the project for a final construction contract for $35,821.25. Change orders for $983.75 were needed for additional concrete and asphalt work. FINANCIAL IMPACT: City Council budgeted $75,000 from parking in-lieu fees for the design, construction, and inspection of the Project. The net cost of the project including design, construction, change orders, and inspection is $35,821.25. The project was completed under budget and $39,1 f8.75 in remaining funds will be returned to the parking in-lieu fees Fund Account. . RECOMMENDATION: It is recommended that the City Council: . 1. Adopt Resolution No. 5732 to accept completion of construction for the Main Street Parking Lots Project No. 50237 2. Direct the City Clerk, to file a "Notice of Completion" with the Orange County Clerk-Recorder within ten (10) days from the date of acceptance. Agenda Item J 3. Direct staff to release retention funds of $3,582.13 upon expiration of thirty-five (35) days from the date of filing of the "Notice of Completion",. . A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA DECLARING WORK TO BE COMPLETED PER CONTRACT DOCUMENTS FOR MAIN STREET PARKING LOTS PROJECT NO. 50237 WHEREAS, on February 11, 2008, the City of Seal Beach entered into a contract with Imperial Paving Company, Inc.; and WHEREAS, the City Engineer has determined that the work has been substantially completed in accordance with the contract documents. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: Section 1. That the work required to be performed by said Contractor has been completed. That the total cost of said work is $35,821.25. That the work is hereby accepted and approved. It is further ordered that a "Notice of Completion" be filed on behalf of the City in the Office of the Orange County Recorder within ten (10) days of the date of this resolution. Section 2.
