He J.ndJ.cated that J.n order to expand a non-conformJ.ng use J.t J.S necessary to have a Plan RevJ.ew approved by the PlannJ.ng CommJ.ssJ.on. MOTION by Jessner; SECOND by Rullo to approve Plan ReV1ew 17-89 w1th two cond1t1ons: 1. Th1S 1S a request to extend 1ndef1n1tely a perm1t for off-sale general l1quor 1n con]Unct1on W1 th an eX1st1ng grocery store at 1101 Pac1f1c Coast H1ghway. Mr. Wh1ttenberg noted the state of Cal1forn1a laws proh1b1t alcohol1c beverage sales between the hours of 2:00 a.m. and 6:00 a.m. Comm1ss1on Comments Mr. Suggs requested a clar1f1cat1on between cond1t1ons numbered 7 and 8 by add1ng verbage to cond1tion 8 to read as follows: 8. MOTION CARRIED 5 - 0 SCHEDULED MATTERS ZONE TEXT AMENDMENT 2-89 e Mr. Wh1ttenberg gave a status report on the 1mplementat1on of a Cond1t1onal Use Perm1t for Off1ce Uses 1n commerc1al zones. Mr. Wh1 ttenberg sa1d the Ad Hoc Reta1l Sales Comm1 ttee 1S meet1ng ton1ght. Staff ant1c1pates they w1ll make the1r f1nal recommendat1ons th1s even1ng and they w1ll probably be forwarded to the C1ty Counc11 for the1r cons1derat1on at the1r 11-13-89 e e . ORAL COMMUNICATIONS There were no oral commun1cat1ons from the aud1ence. STAFF CONCERNS Mr. Wh1ttenberg gave a status report on v1deo arcades. Staff has requested 1nformat1on from the League of Cal1forn1a C1t1es regard1ng other c1t1es concerns, standards re v1deo arcades. The 1nformat1on was rece1ved the early part of last week and 1S be1ng rev1ewed by staff and should be on the Comm1ss1on's Agenda for the November 1 w1th a general overV1ew of what staff feels some of the 1ssues and concerns would be and some ways to approach these. Staff would be seek1ng a consensus on how to proceed. Mr. Wh1ttenberg gave each Comm1ss1oner a report to C1ty Counc1l re the Development Agreement between Mola and the C1 ty . A clar1f1cat1on was requested regard1ng a change 1n the acreage f1gures for the wetlands areas. (Copy attached for reference). COMMISSION CONCERNS There were no Comm1SS1on concerns. Development Serv1ces HELLMAN RANCH PROJECT WETLANDS and OPEN SPACE ACREAGE To: Attent1on: From: DISCUSSION At the October 14, 1989 C1ty Counc1l meet1ng a clar1f1cat1on was requested regard1ng the amount of land proposed and approved for wetlands and open space purposes on the Hellman Ranch property. Attached are excerpts of appropr1ate documents Wh1Ch discuss the amount of land for the wetland and open space uses. e In review1ng the referenced documents and the rev1sed Tentat1ve Tract Map 1t appears that the acreage f1g~re for the wetlands as 1nd1cated 1n the Draft supplemental Env1ronmental Impact Report (page 8, Sect10n 0.1.) of 41.4 acres 1S a gross f1gure and does not 1nclude the reduct10n of 4.6 acres of 1mpacted wetlands. The 1mpacted wetlands 1nclude F1rst Street r1ght-of-way (1.6 acres), commun1 ty park area ( 1 . 8 acres), and the rema1n1ng 1.2 acres Wh1Ch are isolated patches. If the 1mpacted 4.6 acres are deducted from the 41.4 gross acres, there 1S then 36.8 acres rema1n1ng. It should also be p01nted out that the Draft supplemental Env1ronmental Impact Report 1nd1cates there 1S currently 22.0 acres of eX1st1ng wetlands, and the rema1n1ng 19.4 acres is upland hab1tat Wh1Ch are adjacent to the eX1st1ng wetlands. The adopted resolut1ons 1nd1cate 37.9 acres of wetlands and 24.39 acres for Gum Grove Park and the Commun1ty Park area, wh1le the approved Tentat1ve Tract Map 1nd1cates 36.68 acres of wetlands and 25.45 acres for Gum Grove Park and the Commun1ty Park. In add1t1on, the approved Tentat1ve Tract Map 1nd1cates 2.82 acres of landscape and pocket parks throughout the proJect and 1.86 acres w1th1n the 30-foot landscape easement area. Approxlrnately 1.6 acres of the l.mpacted wetlands are wlthln the First Street rl.ght-of-way and 1.8 acres are wlthl.n the cornrnunlty park. Except for the 'e upper port10n of the central channel, the rema1n1ng 1mpacted wetlands are pr1mar11y 1s01ated or nearly 1s01ated patches of severely degraded wetlands on the per1phery of the exist1ng wetland area. The loss of these wetlands 1S not biolog1cally Slgnif1cant due to the1r small area and low value. However, the net loss of any wetland 1S cons1dered a sign1f1cant 1mpact under the polic1es of the Department of Fish and Game (DFG), Cal1forn1a Coastal COmID1SS10n (CCC), Corps of Eng1neers (COE), and U. s. F1Sh and W11dl1fe SerV1ce (FWS).
