DATE: June 9,2008 TO: Honorable Mayor and City Council THRU: David Carmany, City Manager FROM: Linda Devine, City Clerk SUBJECT: BIENNIAL REVIEW OF CONFLICT OF INTEREST CODES - RDA SUMMARY OF REQUEST: That the City Council proceed with the biennial review of the City's conflict of interest code by notifying the staff and Redevelopment Agency that a review of the current codes is required by October 1, and directing the City Attorney to coordinate the review of the current codes for required amendments. . BACKGROUND: The Political Reform Act requires all local governments and agencies to review and, if necessary, to update their conflict of interest code in each even-numbered year. The City last updated its conflict of interest code on November 13, 2006, when the City Council adopted Resolution No. 5508. A biennial review generally consists of three steps: (1) by July 1 st the "code reviewing body" (the City Council) issues a direction to staff that the City's conflict of interest code is to be reviewed for required amendments, and to any City agency that maintains its own conflict code (the Redevelopment Agency); (2) by October 1 st staff and the Redevelopment Agency give the City Council a report of required amendments or a statement that no amendment is required; and (3) by December 30th the Council adopts any required amendments to the City's conflict of interest code and approves any amendments to the Redevelopment Agency's code. FINANCIAL IMPACT: No fiscal impact. RECOMMENDATION: It is recommended that the City Council proceed with the biennial review of the City's conflict of interest code by notifying the staff and Redevelopment Agency that a review of the current codes is required by October 1, and directing the City Attorney to coordinate the review of the current codes for required amendments. .
