AGENDA STAFF REPORT DATE: June 9, 2008 TO: THRU: Honorable Mayor and City Council David Carmany, City Manager FROM: Vince Mastrosimone, Director of Public Works SUBJECT: SEAL BEACH BOULEVARD BRIDGE WIDENING PROJECT No. 97-SBCH-MPAH-1154 REQUEST FOR AN EXTENSION OF TIME TO USE MEASURE M FUNDS SUMMARY OF REQUEST: . The Council is asked to adopt Resolution No. 5737 to request that the Orange County Transportation Authority (OCT A) provide an extension of time to use Measure M funds for the Seal Beach, Boulevard (SBB) Bridge Widening Project No. 97-SBCH-MPAH-1154 in FY 2009/2010. BACKGROUND: The OCTA is responsible for administering the Measure M streets and roads program. The Measure M programs are funds available to Orange County Cities from one-half percent sales tax through the Combined Transportation Funding Program (CTFP). In 1997, Seal Beach received grant funds through the Measure M program for the Seal Beach Boulevard Widening Project No. 97-SBCH-MPAH-1154 in the amount of $1,680,000. The project is to widen SBB Bridge. . . Currently, Seal Beach Boulevard is three thru lanes and a bike lane approaching the bridge in each direction, crossing over the 1-405 freeway. The bridge is bounded by two signalized intersections operating at a Level of Service (LOS) of F. Nearing the bridge, there is an existing "bottleneck" reducing the three thru lanes to two lanes in each direction. By removing the bottleneck, it will increase the capacity, bring SBB to full width Master Plan of Arterial Highways standards and raise the LOS to an acceptable D. The" $1,680,000 MPAH funds are subject to lapse end of the fiscal year 2007/08. In order to avoid the lapsing of funds, OCT A has created a time extension policy Agenda Item M . that requires the City Council to formally request the time extension and a delay of the Seal Beach Boulevard (SBB) Bridge Widening Project No. 97-SBCH- MPAH-1154 to FY 2009/2010. The time extension is necessary because the SBB Bridge Widening Project has been folded into the OCTA West County Connector (WCC) Project, with OCT A acting as lead agency. The WCC project includes plans to widen the freeway under SBB Bridge and completely replace the Seal Beach Boulevard Bridge. Combining the projects will reduce the impacts to the public and help contain project costs through economies of scale. At this time, staff is requesting City Council to submit a 24-month time extension to OCTA for Project No. 97-SBCH-MPAH-1154 in the amount of $1,680,000. FINANCIAL IMPACT: None at this time. RECOMMENDATION: It is recommended City Council adopt Resolution No. 5737 to request that the Orange County Transportation Authority (OCT A) provide an extension of time to use Measure M funds in FY 2009/2010 for the Seal Beach Boulevard (SBB) Bridge Widening Project No. 97-SBCH-MPAH-1154. . These funding sources are allocated through the Combined Transportation Funding Program (CTFP) for local streets and roads projects throughout Orange County. As the administrator of the CTFP, OCT A meets with each local agency twice a year to assess the status of projects funded through the CTFP. This process is commonly referred to as the semi-annual reviews (SAR). In November 2004, the OCT A Board of Directors approved a time extension policy and directed staff to keep local agencies informed of the requirements (Attachment A). Time extensions may be granted for special circumstances that are beyond the control of the implementing agency. A formal request for a time extension should be presented to OCT A as early as possible or at a semi-annual review but no later than June 30th of the fiscal year in which the project is programmed. During previous reviews and the recent March 2008 SAR, the City of Seal Beach requested time extensions for the projects listed in Attachment B. This letter serves as a reminder to submit all corresponding documentation (e.g. council action) by May 31, 2008. Initial and final payments are contingent on the receipt of outstanding information. Agencies may request a one-time delay of up to 24 months. Jurisdictions will be required to justify this request and seek approval of OCTA staff, Technical Steering Committee (TSC), and the Technical Advisory Committee (TAC) as part of the semi-annual review process. . A second delay request may only be awarded by obtaining the council approved revised Capital Improvement Program (CIP) that indicates the project's revised program year. The second delay request will still require the OCTA staff review and the TSC and T AC approval. . Any further delay beyond the second delay request would require a direct request for approval from the OCT A Board of Directors. A RESOLUTION OF THE SEAL BEACH CITY COUNCIL REQUESTING AN EXTENSION FROM THE ORANGE COUNTY TRANSPORTATION AUTHORITY (OCTA) TO USE MEASURE M FUNDS FOR THE SEAL BEACH BOULEVARD (SBB) BRIDGE WIDENING PROJECT NO. 97-SBCH-MPAH-1154 IN FY 2009/2010 WHEREAS, the City of Seal Beach ("City") has received a Master Plan of Arterial Highways grant (Project No. 97-SBCH-MPAH-1154) with a remaining balance of $1,680,000; and WHEREAS, the grant is subject to lapse by the end of fiscal year 2007/08; and WHEREAS, the City is formally requesting a 24-month time extension per the Combined Transportation Funding Program (CTFP) Time Extension Policy, which provides that cities may seek a delay. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: . Section 1. The City has met and fully satisfied the requirements of the CTFP Time Extension Policy. Section 2. The City hereby formally submits a 24-month time extension request for grant funding for the Seal Beach Boulevard Bridge Widening Project No. 97- SBCH-MPAH-1154 from FY 2007/08 to FY 2009/10.
