The regularly scheduled meet1ng of the Plann1ng Comm1SS1on was
called to order 1n C1ty Counc11 chambers by cha1rman Sharp at
7:32 p.m.

MOTION by Suggs; SECOND by Flfe to approve the Plannlng
CommlSSlon Mlnutes of November 15, 1989 as presented.

2. PLAN REVIEW 20-89
202 16TH STREET
Staff Report
Plan ReV1ew 20-89 1S a request by appl1cant, Remodelers Inc., on
behalf of owner, Robert Donnell, to add 587 square feet to a non-
conform1ng duplex. It 1S non-conform1ng due to a number of C1ty
standards. Most of these w111 be brought 1nto conformance by the
proposed add1t1ons. The detached parcel, where the off-street
park1ng 1S now prov1ded, must be t1ed to the res1dent1al property
w1th a covenant to ensure that parcel cannot be sold separately
thereby loslng the park1ng.
Comm1ss1on Comments
Mr. F1fe requested staff reV1ew the mathemat1cal formula for 10%
maX1mum allowable lot coverage. Add1t1onally, Mr. F1fe sa1d

Cond1t10n #3 should have the word "1rrevocable" added so the owner
could not records a revocat10n of that covenant. At Cond1t10n #5,
1t 1nd1cates presently substandard elements w111 be brought up to
code, does th1s 1nclude all plumb1ng and electr1cal elements? The
rear property does not heat and should have.
Ms. Forsythe asked about park1ng. Mr. wh1ttenberg sa1d park1ng 1S
a d1ff1cult 1ssue. The Code requ1res you have the ava1lab111ty of
park1ng spaces prov1ded on the property but 1t'S hard to enforce
by the C1ty.
Robert Donnell * 202 16th street
Mr. Donnell sa1d the two propert1es have been t1ed together for the
last f1fty years. He has three covered spaces w1th a full park1ng
stall next to the garages plus add1t10nal paved spaces 1n back of
the un1ts and along s1de the legal spot. There 1S a temporary
even1ng park1ng space used 1n front of the garages. There 1S
currently an electric heater 1n the bathroom and a f1replace 1n the
11v1ng room. The tenants are on th1rty-day leases.
MOTION by F1fei SECOND by Suggs to approve Plan ReV1ew 20-89 w1th
the add1t10n of the word "1rrevocable" to Cond1t10n #3:

covenant on the t1tle of the property requ1r1ng that the
garages permanently be recogn1zed as requ1red park1ng for

beer and wine at the Ma1n street De11. Mr. Wh1ttenberg noted that
Cond1t10n #2 of the1r or1g1nal (1988) cond1t10ns has not been
adhered to. Th1S requ1red all alcohol1c beverages be consumed
entlrely w1th1n the bU1ld1ng and none shall be sold as takeout.
In d1scuss1ng th1s w1th ABC representat1ves, staff found out that
thlS prem1ses has been 11censed w1th ABC for many years for sale
1ns1de the premlses and also for consumpt10n on the outs1de d1n1ng
area. ABC does not recogn1ze a 11m1tat10n as to "1ns1de" or
"outs1de" of locat10n - they 11cense the property. ABC and the
Seal Beach Pol1ce Dept. has not rece1ved any compla1nts for th1s
address. The owners check 1dent1f1cat10n of buyers and they also

check 1dent1f1cat1on of all persons who ]Oln the purchaser 1n th1S
outs1de area. The beverages are sold 1n glass conta1ners. Staff
feels 1t would be appropr1ate to reword Cond1t1on #2 to allow for
the consurnpt1on of alcohol1C beverages 1n the outs1de d1n1ng area.

Mr. F1fe suggested the language 1n Cond1 t10n #4 be changed to
prov1de that all alcohol1C beverages served on the prem1ses be
served 1n glass conta1ners.

The appl1cant was not present. No one 1n the aud1ence w1shed to
speak for or aga1nst CUP 12-88.

Mr. Stark asked staff to reV1ew the procedures for revok1ng a CUP.
Mr. whittenberg reV1ew the Code prov1s1ons for th1S.
MOTION by Suggs: SECOND by F1fe that Cond1t1on Use Pe~t 12-88 be
approved through the adoption of Resolut1on No. 1525 w1th a word1ng
change to Cond1t1on #4 to read that all alcohol1c beverages served
on the prem1ses shall be served in glass conta1ners.

Mr. Stark welcomed Gwen Forsythe to the Plann1ng Comm1SS1on. He
1nd1cated she was an act1ve member of "Sprlng", a group concerned
w1th equal treatment of all c1t1zens w1th1n Seal Beach.
STAFF CONCERNS
Mr. Wh1ttenberg 1nd1cated there were no 1tems for the
Plann1ng Comm1SS1on meet1ng and therefore there
meet1ng.

Mr. Sharp requested a staff status update of the block wall on
Beryl Cove Wh1Ch was too tall. Mr. Wh1ttenberg 1nd1cated staff
made an lnspect10n of the wall and 1t 1S too h1gh. The homeowner
has been contacted and has been requested to take one row of blocks
off. Th1S w1II br1ng 1t down to the proper he1ght. To comply w1th
UBC requ1rements he w1II have to take the wall entlrely down and

start over aga1n because he does not have the proper re1nforc1ng
bar 1n 1t. The homeowner sa1d he would do th1S after the f1rst of
the year.
Mr. Sharp asked staff for a status update on the DWP property. Mr.
Wh1ttenberg 1nd1cated there was noth1ng at th1S t1me.
Mr. Sharp asked staff for a status update on the State Lands
property. Mr. Wh1 ttenberg sa1d the developer has subm1 tted
prel1m1nary Sl te plans, floor plans and elevat10ns about 2 1/2
months ago. Staff rev1ewed these and sent them back w1th a number
of suggested mod1f1cat1ons that staff felt would be more 1n
compl1ance w1th the Spec1f1c Plan and the prov1s1ons of the
Ord1nance. The developer 1S rev1ew1ng these. Staff strongly urged
them to contact the Coastal Comm1SS1on because a port1on of the1r
park1ng lot area 1S shown to be 1mmed1ately adJacent to the
wetlands area.
Mr. Sharp asked staff 1f the Mola proposal would go before the
Coastal Comm1SS1on 1n December? Mr. wh1ttenberg sa1d Mola
reappl1ed to the Coastal Comm1SS1on. They are not on the December
agenda. Our assumpt10n 1S they w1II be on the January agenda but
staff 1S not certa1n.
Mr. F1fe asked staff where the report from the Ad Hoc Reta11 Sales
Comm1ttee was he expected th1S after Thanksg1v1ng. Mr.
Wh1ttenberg sa1d he would check w1th the C1ty Manager's off1ce to
see who exactly 1S d1str1but1ng th1S report and get th1S to the
Comm1SS1on. A J01nt meet1ng was scheduled for January 29 - th1S
commun1cat1on was rece1ved by the Comm1SS1on.
Ms. Forsythe asked staff about McGaugh School pavement mark1ngs.
These appear to have been paved over or removed. Mr. Wh1ttenberg
1S to check W1 th the Publ1C Works Department and adv1se the
Comm1SS1on on the status. Ms. Forsythe wants the "SLOW - SCHOOL
CROSSING" marklngs restored.
