The City of Seal Beach Planning CommIssIon met in regular session at 7:30 p.m. in the City
Council Chambers, wIth ChaIrperson Campbell callIng the meeting to order with the Salute to
the Flag.

ORAL COMMUNICATIONS
Jim Caviola * 1008 Ocean A venue. Seal Beach
Mr. CavlOla spoke about hIS feelmgs on trees, pnmarIly about a tree that was removed at 101
MaIn Street. He explaIned how trees enhance the beauty of any city, the need for more trees
and his concern for the removal of expensive, mature trees. Mr. Caviola produced a photograph
that he claimed dIrectly contradicted the statements of Bob Eagle and took issue with Mr.
Eagle's statements and felt that they were untrue.
Chairperson Campbell thanked Mr. Caviola for his comments and requested he follow up on his
ideas and concerns. She asked staff to find out what the red bands on two trees at the
intersection of ElectrIC A venue and Mam Street mdIcate

Staff Report
Mr. Curtis presented the staff report. [Staff report on file in the Planning Department]. The
proposed Zomng Text Amendment would establish CItY-WIde standards for the temporary dIsplay
of advertising banners 10 commercIalhndustnal zones. The proposed regulatlons would mstltute
a permittlng process and set maximum time and SIze limits for the dIsplay of temporary banners.
Commission Comments on Staff Report
Commissioner Dahlman asked If the defimtIOn temporary exterior sign would apply to mtenor
banners? Mr. Curtis saId no, staff dId not mtend to mclude interior banners 10 this ZTA.
Commissioner Dahlman asked If banners were to be restricted to fabric and/or fleXIble matenal,
including paper? Mr. Curtis SaId yes.
Commissioner Dahlman asked If staff had considered the lIghtlng of banners and the Impact of
such lighting on nearby residents? Mr. Curtls SaId he had not envIsIoned lightlng for thIS ZT A
but noted lighting would require a separate, electrical permit. He explained lightlng must not
stray, it must be shielded and kept on ItS own property.
Commissioner Dahlman asked what was staff's purpose in defimng temporary sign? Mr. Curtis
saId it was a further defimtion for a banner --- a banner IS descnbed as a temporary sign and
therefore a temporary sign was descnbed.

Mr. Wilson introduced himself as the Marketlng DIrector for the Rossmoor Shoppmg Center.
. He stated he just received his copy of the staff report on Monday afternoon and requested

. additional tlme to go over the report wIth the key merchants in the Center. In the brief time he
has had to review the report and dISCUSS It WIth certain Center merchants, he indicated the
merchants would like to see some restrictions on temporary signage and banners. Their property
managers also feel the restrictions are necessary. However, the do not want to see busmess and
their potential growth restricted.
CommIssioner Dahlman asked Mr. WIlson If he was aware the CIty has an effective ordinance
allowing a planned sign program? Mr. WIlson indIcated the Rossmoor Shoppmg Center already
has a planned SIgn program.
Chairperson Campbell saId she had some questIons for staff but felt thIS matter must be deferred
because Mr. Wilson had stated he needs more tIme to discuss the staff report with the people
he needs to contact. She felt thIS was probably the same SItuatIon WIth Seal Beach Business
AssocIation.
MOTION by Brown; SECOND by Dahlman to continue the Public Hearing on Zoning Text
Amendment 95-1 to the Planning Commission meeting of November 21, 1995.
There bemg no further publIc comments, ChaIrperson Campbell closed the Public Hearmg.

Chairperson Campbell asked staff what SItes north of the 405 Freeway are affected by the
temporary banners? Mr. Curtis SaId that would mclude Rossmoor Center and the three
commercially zoned Bixby parcels. Mr. Whittenberg SaId It would also technically apply to the
Bixby Office Park. ChaIrperson Campbell said she was concerned that there IS a stretch of
fencing at Candleberry and Heather which serves as the neIghborhood bulletIn board. She didn't
want to see that restricted and it's a wonderful neIghborhood asset.
ChaIrperson Campbell SaId one thing not mentIoned 10 the staff report IS the content of the
banners and she asked If It would be lImIted to bUSIness endeavors? Mr. WhIttenberg SaId CIties
have very few restrictIons that can be placed on polItIcal SIgns ChaIrperson Campbell SaId the
College Park East neIghborhood association places SIgns, from time-to-time, regarding meetings
and upcoming activities on the fence at Candleberry and Heather. Mr. CurtIs SaId those SIgns
are not allowed to be placed on the fence but the Issue IS not enforced by the CIty or by thIS
ZTA. He added lilt's a totally separate Issue that I assume we would contInue not to enforce".
Chairperson Campbell asked about a banner on public property for a public purpose? Mr.
Whittenberg said there's a dIfferent permittIng and approval process for banners on publIc
property. Those are not a part of this ZTA, this zomng ordInance only applies to pnvate
property .
Regarding the content of advertISIng banners, Mr. Steele SaId the ordInance cannot permIssIbly
regulate content at all, the ordmance must be content neutral.

Commissioner Dahlman saId he thought banners would be lImited to two subjects, and one could
be price. Mr. Steele saId "We lImIt content but that lImIt is content-neutral. We can't
differentiate between commercial and charitable or retail versus food, but we can say that within
the context of being neutral, what the sign can contain". CommIssioner Dahlman saId he was
concerned about that, and noted CIty regulations WhICh do limit that kind of content. He would
be concerned if that's a policy the CIty needs to live by, especially wIth regard to specIfic brands
of alcohol being advertised in WIndows.

Staff asked if the CommIsSIon WIshes to meet on Wednesday, November 22nd as It'S the day
before ThanksgIving and many people WIll be travelIng? The CommiSSIOn unanimously
determined to continue the November 22nd meeting to December 6th.

There were no Commission concerns
