PUBLIC HEARINGS 2. CondItIonal Use PermIt 97-4 1700 Pacific Coast Highway Staff Report Mr. WhIttenberg delIvered the staff report. [Staff report on fIle m the Planmng Department for reference]. ThIS matter was contmued from the May 21, 1997 CommissIon meetIng. The request IS to operate a vetermary hOSpItal wIthm an eXIsting commercIal buIldmg. InCIdental retaIl sales would be provided in additIon to the vetennary servIces. CommIssion Ouestions on Staff Report CommIsSIoner Yost asked staff if the CIty receIved any comments on thIS applIcation? Mr. Whittenberg said no, no letters or phone calls were receIved on thIS notIced PublIc Heanng. e Public Hearm~ Dave Bartlett * Huntin~ton Beach Mr. Bartlett, agent for property owner D W. MItchell, saId he and Mr. MItchell concur WIth the staff report's recommendation to approve thIS applIcation. However, they requested reconSIderation of CondItion of Approval #9 whIch reqUIres Planmng CommISSIOn reVIew at twelve (12) months. He CIted the veterinary doctor's 17-year record of good busmess practices on Seal Beach Boulevard. They never receIved a complaint. Chairman Brown asked Mr. Bartlett for a calculation of the dIstance from this busmess to its neIghbors. Mr. Bartlett Said there IS a residentIal umt next door, a commerCIal property next door and a resIdential property on the opposite side of the alley. The first residence, Walt MIller's apartment, IS 30' away. The other resIdence IS about 30' away due to the alley's WIdth. No one m the audIence WIshed to speak m favor of or agamst thIS applIcation and the Chair closed the PublIc Heanng. CommIssion Comments CommISSIoner Sharp Said the 17-year records speaks for Itself. - MOTION by Sharp to approve the applIcatIon WIth the CondItIons m place. -2- City of Seal Beach Planmng COmmlE-MOn - MmuteE- ot June 4, 1997 . The ChaIr asked to delay the Motion for addItIonal Commissioner comments. CommISSIoner Hood saId he favored keeping CondItIon #9 because they are In a new locatIon WIth new neIghbors. CommISSIoner Yost SaId that although the vetennary clImc has an excellent 17-year record, and the CIty apprecIates havIng their busmess In Seal Beach, he favored keepIng CondItIon #9 because they wIll have new nl'"lghbors and they are In closer proxImIty than they were In their Seal Beach Boulevard location. CommissIoner Law said she too favored retaImng CondItIon #9 because they wIll be in a new location wIth new neighbors. She felt thIs mIght be a dIfferent SItuatIon. ChaIrman Brown agreed, saYIng the concern IS the clImc would be only 6' away along a long wall. MOTION by Brown; SECOND by Yost to re-open the PublIc Heanng to allow Dons Haggans, DMV to speak. There bemg no ObJectIons, ChaIrman Brown re-opened the Public HearIng. e Dons Haggans. DMV * Seal Beach Ammal ClImc. Inc. Dr. Haggans, under rebuttal, SaId she wants to upgrade her climc. She really admires the buildIngs at 1700 PaCIfic Coast HIghway and thought It would be a pleasure to have the community served in a beautIful surroundmg as proposed. This IS the fifth clImc she has deSIgned and she has more than one clInic operatIng. The cllmc's cages have been arranged toward PaCIfic Coast Highway and toward an alley adjacent to the driveway of the liquor store. She noted that while she IS a vetennarlan she IS also a resident and is cogmzant of nOIse. She noted "My patients are very qUIet If we do get any kInd of nOIse factor, It'S usually In the day tune ". She dId not antiCIpate beIng a problem to anyone. MOTION by Sharp; SECOND by Hood to approve Resolution No. 97-13, thereby approvIng ConditIonal Use PermIt 97-4. Parcel Map 96-182 3900 Lampson A venue Staff Report Mr. Whittenberg dehvered the staff report. [Staff report on file m the Planmng Department]. ThIS Item was continued from May 21, 1997. The request IS to subdIVIde the 6.7-acre BIXby Old Ranch Tenms Club SIte mto two parcels. It will remaIn C-2 (General CommercIal) ZOnIng. At the May 21, 1997 meetIng there was Commission discussIon regardmg notes on the preVIOUS plan indIcatmg there were three easements, whIch related to the property m some manner. The CommIssIon wanted those easements mapped on the plan if they did apply to It. Based on the CommIssIon's dIrectIon, staff went back and revIewed the easements m further detaIl, both WIth the CIty'S engmeers, the applIcant's engmeers and the Federal AVIatIon AdmInistration. Two of the easements on the InItIal submISSIon map don't apply to the subject property. One easement does apply, It covers the entire parcel. It's an aVIgatlOn easement WhICh restricts anything to be built in the area above 150' above grade level The CIty'S heIght hffilt m that zone IS 35'. CommISSIon QuestIons on Staff Report There were no questIons or comments. e PublIc Heanng The apphcant's representative was present m the audience but dechned to speak There were no persons wIshmg to speak m favor of or agaInst thIS apphcatIon and the ChaIr closed the PublIc Heanng. CommIssion Comments CommiSSIoner Law saId she had no problems WIth the request. CommISSIoner Hood thanked staff for makIng sure the easements dId or dId not apply and explaInIng to the CommIssIon exactly what they were. He also thanked all the CommIssIoners for the continuation to allow the plotting to be done. He added that If anythmg comes before the CommIssIon regardmg thI~ area he would hke to see all easements plotted. He would vote for approval of this apphcaIton MOTION by Hood, SECOND by Law to approve Resolution No. 97-14, thus approvmg TentatIve Parcel Map 96-182. MOTION CARRIED' AYES: NOES: 5-0-0 Hood, Law, Brown, Sharp, Yost e Mr. Steele adVIsed that this recommendatIon WIll now go to the CIty CounCIl. -4- City of Seal Beach Plannmg COJU11l1!.Mon - Mmutes ot June 4, 1997 e ST AFF CONCERNS Mr. WhIttenberg advIsed the CommIssIon that there are no applIcatlons or Items on the agenda for the June 18th meetmg. Therefore, he recommended the CommIssIon cancel the June 18th meetlng; the Commission agreed. The next meetlng will be July 9th COMMISSION CONCERNS Chairman Brown asked for an update on the sand replemshment proJects. Mr. Whittenberg Said sand IS bemg replemshed at two locatlons --- Surf sIde and the main beach. At Surfside, the sand replemshment IS stIll on gomg. The Army Corps of Engmeer's permIt has a condItIon on It that they have to cease pumpmg sand in mId to late June. They have pumped approxImately 1.1 mlllIon CUbIC yards. The mItlal proposal was to pump 1.5 millIon cubic yards. They will not reach that but will get approxImately 1.2 to 1.3 mIllIon CUbIC yards on the beach at Surf sIde. That project wIll be shut down. He was not certain If they would remobIhze at a later date to pump the addItlonal sand. That deCISIon has not been made one way or the other yet. e At the main beach, the CIty is now prepanng the enVIronmental documentatIOn for submission to the Coastal CommIssion, the Army Corps of Engmeers, the RegIOnal Water QUalIty Control Board and one other agency to Import sand from a quarry SIte m the Palmdale/Lancaster area. It w1l1 be brought to Seal Beach by tram. It WIll travel through the Naval Weapons Statlon and be stockpIled on the Station. It w1l1 be moved from there onto the beach. ThIS IS m antIcipatlon of the CIty'S receIvmg monies through the Governor's budget, once the State approves thIS year's budget. There should be $900,000 of fundmg aVailable m that budget for the CIty to use for that purpose. The CIty IS gettlng ready to have the work done once the budget IS approved That way the project can be started qUIckly.
