HomeMy WebLinkAboutPC Min 1998-05-20 e e e . , . i, CITY OF SEAL BEACH PLANNING COMMISSION MINUTES MAY 20, 1998 The regularly scheduled Planning Commission meeting of May 20, .1998 was called to order by Chairman Brown at 7:30 p.m. The meeting was held in City Council Chambers and began with the Salute to the Flag. Roll Call Present: Chairman Brown Commissioners Law, Larson, Hood Also Present: Department of DeveloJ)ment Services: Lee Whittenberg, Director Craig Steele, Assistant City Attorney Joan FiUmann, Executive Secretary Chairman Brown indicated that Commissioner Yost is now Council Member Yost and his seat on the Planning Commission will remain vacant until he makes an appointment. Agenda Approval Mr. Whittenberg said the applicants for Conditional Use Permit 98-10, tonight's Public Hearing for Taco Surf, sent a FAX to the City requesting their application be continued to the Commission's June 3n1 meeting. They didn't receive the supplemental staff report, wanted to get a copy and needed time to digest the information. They were unaware staff changed its recommendation to not recommending approval of their request to extend their hours of operation. Chairman Brown asked if the applicants were present tonight? Staff said no. When asked by the Chair, Mr. Steele recommended the Commission grant the requested continuance. The applicants have indicated they did not receive a staff report containing recommendations, which are adverse to their application. Chairman Brown asked the audience who was here to speak on this request? Many hands were raised. Mr. Steele advised the Chair he could open the Public Hearing, take testimony from those people who could not attend the next meeting and continue the Public Hearing to June 3n1. I . . e e e .. City of Seal Beach Planning Commission * Minutes of May 20, 1998 Mr. Whittenberg said a staff report was mailed to the restaurant but evidentially was not received. MOTION by Hood; SECOND by Law to approve the Agenda as presented. MOTION CARRIED: AYES: 4-0-0 Hood, Law, Larson, Brown Oral Communications Rita Brenner * Seal Beach! Ms. Brenner asked about the First Street wall and gates in that wall at the Seal Beach Trailer Park. She asked who owns the wall, who has jurisdiction of the wall, who is responsible for the gate permits --- the City or the State? Who is responsible for after- the-fact permits? If any after-the-fact permits are granted she felt they should be conditioned to allow everyone who faces First Street and wants to have a gate should be allowed to have one. She asked Mr. Whittenberg in what time frame she could expect a reply from staff] Mr. Whittenberg said staff could provide a written response by the middle of next week. For the Record, Ms. Brenner said she had never asked the Seal Beach Trailer Park to pay for a gate for her in the First Street wall. She would pay for any gate herself. Sue Corbin * Seal Beach Ms. Corbin complained that the taped replays of Planning Commission meetings were not being shown on television. She complained that explanations from Seal Beach TV3 had been given but she felt a refund should be given. She then read an article from "Huntington Beach Tomorrow" on developers. Reg Clewley * Catalina A venue. Seal Beach Mr. Clewley spoke on code enforcement and the deck at 1733 Crestview. He said it has taken too many months (December 1989) for resolution on this deck encroachment. Mr. Clewley next talked about the swimming pool at 206 Ocean Avenue, noting it was a danger because the sidewalls created steps enabling entry to the pool. He said the fence does not meet the City's requirements, the permit was not properly issued and someone may drown as a result. He said a safety fence should be erected directly around the pool itself. Mr. Clewley then asked why the revocation of Variance 87-6, re Howard Briefs in-lieu parking fee matter was not on the Planning Commission's agenda forecast? On other matters he asked who is polluting the beach with the 10' signage? Why aren't the police making arrests? He asked the Planning Commission to I See verbatim addendum at the end of these minutes. 2 ... . e e e ~ City of Seal Beach Planning Commission * Minutes of May 20, 1998 table all matters on the Agenda and start planning how to enforce the laws already on the books. Consent Calendar Mr. Whittenberg said that the May 5th Planning Commission meeting there was discussion on the timing of the Planning Commission hearings on the Bixby EIR. Staff had prepared an initial schedule indicating the Planning Commission would start their hearings on the approval process prior the EQCB's finalizing the recommendation to the Council; the meetings would be held concurrently. Now, however, the Planning Commission's Public Hearings will take place after the EQCB' s hearings are completed and the EQCB has made a recommendation on the adequacy of the FEIR. Commissioner Hood asked to amend the Minutes to put the new calendar in place of what the Minutes had shown. Mr. Whittenberg said that would be fine, it could be included as an attachment to the Minutes of this meeting. Staff will attach the page from the EQCB staff report that indicated their meetings will be concluded prior to the start of the Commission meetings. The new calendar does not have dates, only a chronology. MOTION by Hood; SECOND by Law to approve the Consent Calendar as amended: 1. Approve Planning Commission Meeting Minutes of May 6, 1998. Conditional Use Permit 98-10 [from 5-6-98] 16281 Pacific Coast Highway * Taco Surf Sup.plemental Staff Re.POrt Mr. Whittenberg presented the supplemental staff report. 2[Staff report on me in the Planning Department for inspection]. Several letters were attached to the staff report both in favor of and against the application. Staff received a letter in opposition from the firm of Hill, Farrer and Burrill representing Surfside; this was distributed to the Commission. 2 Staff report began at 6:50 p.m. 3 City of Seal Beach Planning Commission * Minutes of May 20,1998 b . e Commission Comments and Deliberations Chairman Brown said the Public Hearing would be continued after taking public testimony. Therefore there will be no Planning Commission comments or deliberations tonight. Public Hearing Applicants - Not present. e Bob Lau~hlin * A-31 Surfside Mr. Laughlin said he is awakened almost every Friday and Saturday night by the noise from the Japanese restaurant across the Pacific Coast Highway in Huntington Beach, probably 300' away. The police helicopters hover around with its lights are on, the patrons are out in the parking lot arguing, police cars roll up, he has to listen to the foul language and cars burning out. He suspected that an open patio at Taco Surf would be a similar situation. They will cater to the same age group of customers. He felt it would be very destructive to the community of Surfside. The rental properties in Surfside will leave when the noise and police from Seal Beach are down at Taco Surf trying to quell the problems. The landlords will reduce rents, the property values will go down. He said he was very concerned on how this restaurant will function and noted there is no request to change the music. He said the nearest home would be 25' from the back wall of the kitchen. The patio will be on the Pacific Coast Highway side. He asked the Commission to consider themselves as living close to this restaurant and to vote their conscience. "What is happening there is detrimental to the community" . Patrick Evans * 2872 Cove Circle. #301 Huntin~on Beach Mr. Evans said his condominium faces directly across to that area, which he finds very disruptive at night. Turc's and Harbor House generate a lot of noise at night, people hang around in the parking lot, and there's a young crowd. The whole area has become known as a place to go at night for the young crowd. He disliked the idea of an open patio, as it would be detrimental, saying there is no reason the restaurant and karioke music can't be contained inside. Taco Surf took over that site with existing permits. "I think they're way out of line to think that for a couple of extra bucks they should have the right to inflict noise and headache on the people that live in that area" . There's enough noise in this area already. He was annoyed to find the restaurant has begun construction without City building permits. He said this showed a bad attitude and wanted to know why it occurred. He opposed any changes to existing permits. e Sue Corbin * Seal Beach Ms. Corbin said the Maris's are very conservative people who have worked very hard and should be granted the extended hours. She said that because Hennessey's 4 City of Seal Beach Planning Commission * Minutes of May 20, 1998 ~ e restaurant was allowed, Taco Surf should be allowed to operate. She said Hennessey's has violated every condition in their CUP such as they were supposed to be a family restaurant, there's no food after a certain time. She suggested a compromise in the hours of operation, suggesting 12:30 a.m. She said the people living in Sunset/Surfside should go to the City of Huntington Beach and/or the proper authorities and get the noise issues resolved. Arthur Galucci * Surfside A venue. Seal Beach Mr. Galucci said he found it disconcerting to allow the applicant a second opportunity to postpone this hearing. He also found it disconcerting that all the residents received a Notice and the applicants didn't. Regarding the distance between businesses and residences, he said the Sun newspaper carried an article two weeks ago about neighbors fighting a Long Beach restaurant --- and it was 500' away from homes. Taco Surf is less than 30' away. The first staff report recommended that the hours be extended. "I find that unconscionable". e Regarding an expansion without a Public Hearing, he asked what happened to the Variance on this site? It was for a specific use. The applicants have bulldozed the back end of Taco Surf restaurant and made it 10' longer and 3' wider. This can't be done with a Variance in place, as it would be an expansion of the use without a Public Hearing. Regarding parking, the staff report discusses they are short 9 spaces. Does this include the 2 parking spaces required for the apartment above the restaurant? Where is the handicapped parking? What is the net-net parking? Regarding the outside patio, all residents deserve the same consideration. The residents in Surfside deserve the same consideration that those residents backing to Main Street receive. When the applicants purchased this property they were fully aware that the restaurants in the same area were in another city, another jurisdiction. He does not accept the expansion of the Variance allowing an additional 10' and the lack of parking. The use should stay the same. You can see the parking stripes that go up to where the building has been expanded. I He said "It's not so much being woken up, it's the language. Constantly. With my two young daughters having to listen to the language from the back of that parking lot. I'm not saying this is going to be the same but, it tends to have that at 2:00 in the morning when alcohol's being served. Food is not being served, it's a bar". He asked to have his questions answered at the next hearing. He asked the Commission to vote their conscience, and consider whether they'd like it next to their home. e Mr. Whittenberg said he would like to review the various reports on this site before answering all the questions. The parking did include the residential unit above. The revised parking plan, submitted with the remodel plans, did meet" the handicapped requirements. Their plans are to convert the apartment to an office. Regarding the remodeling, it is going on at this time. "They weren't aware they needed a permit from us to open that area up because it was part of the previous restaurant. There was a wall there and they just took the wall out. They could just do that automatically since they weren't actually expanding the area of the restaurant. We told them no, they needed approval from us to do that". Dan Nowak * BRow. Surfside Mr. Nowak said he opposed the application. It seems this is being rammed down his throat. The staff report initially said that every Thursday, Friday and Saturday someone is going to be having a party almost in his back yard to 2:00 a.m. Mr. Whittenberg said the supplemental staff report recommends denial of changing the operating hours. Mr. Nowak said he has no problem with the restaurant but he does mind all of the noise, obscene language, cars racing, police coming, helicopters etc. e Jerry Wallace * Seal Beach Regarding parking problems, Mr. Wallace said he didn't know how to come up with an answer to the problems. Because there is minimal parking at Taco Surf, many people have. to park on Pacific Avenue in Sunset Beach. When Noel's closed at 11:00 p.m. the patrons would go to Pacific Avenue where their cars were parked, and they would remain there for approximately one hour. They would then go to the beach at Surfside and continue partying. This is an unincorporated area and is controlled by Orange County. The problem started in Seal Beach because that's where the restaurant is. It ends up at his property, where the patrons use his front yard to dispose of their trash. He wondered if someone at the restaurant could be assigned to make sure the patrons leave the area or are appropriate when exiting the area but they tend to entertain themselves for a few hours after the restaurant has closed. This needs to be controlled. e Regarding enforcement, he noted that because City Hall is closed on weekends, the residents who have problems must call the Police Department who seem unaware of what a Conditional Use Permit (CUP) is and what the Conditions of Approval are for Taco Surf. He has called the Police regarding these problems. They would arrive at 11:30 p.m., thirty minutes after the restaurant was to be closed, and they would talk to the restaurant owners. The Police would drive away. The restaurant would remain open, continue operating with the band playing and with the doors open. He felt that calling the Police Department did no good because the officers were not aware. Because they don't have the CUP information they assume most bars are open to 2:00 a.m. and if it's not 2:00 a.m. they leave and nothing is done. He asked staff to give CUP information to the Police Department for their distribution. 6 City of Seal Beach Planning Commission * Minutes of May 20,1998 -: e Regarding the outside patio, he didn't think it would work. The staff report calls for an employee to present at the patio when alcohol was served but the reality of it is there will be a waitress assigned to the outside patio. When she goes in to get food or drinks, there will be no one at the patio. He asked specifically what this condition meant? Will there be someone always in the patio, not just a person assigned to the patio, and to make sure that they don't start drifting into the parking lot with the alcoholic beverages? He said the supplemental staff report is much better than the original staff report. Chairman Brown said that one of the letters says the former owner frequently and regularly stayed open late and had bands play until 2:00 a.m. - even though the CUP says to stop at 11:00 p.m. Was this true? e Mr. Wallace said they always stayed open past 11:00 p.m. They had caravans that would pull up with a bus with 50 to 100 people in it. The bus would empty out and they would get a couple of drinks and then go on to the next bar which might be two or three miles away. When the buses would get hung up at another bar, the owner had paid for this bus service, so sometimes the busses didn't get there until after 11:00 p.m. and he was not going to close down when he knew he had 100 people coming on a bus to buy drinks. When they got there he was going to service them. What would happen is the bus would stay at the previous location. It might have a hard time getting all the people out of that bar and onto the bus to go to the next bar. So sometimes the bus would arrive after 11:00 p.m. There would usually be two busses and they would sit out on Pacific Coast Highway and the people would get off the bus, go in drink and party and then get back on the busses and go to the next location. We get a lot of noise. Commissioner Law, noting the outdoor patio has not been approved, said there is no door from the patio to the parking lot. Mr. Wallace said the outdoor patio is open. They are still in construction. Mr. Whittenberg said staff is recommending the patio be closed off with a wall. Chairman Brown asked what is the name of the Japanese restaurant people were referring to? Someone from the audience said it is Daimones. And it's the age group that causes the problems. The typical patron of Noel's was 35-50 years old. The patrons of Taco Surf would be 25-30 years old. Rita Reeser * A3 Surfside Ms. Reeser said she feels it's very important to support the noise control restrictions. There are many problems coming from the beach. The beach parties continue to 4:00 a.m. The waves don't mask the noise, the noise echoes. She asked if the Commission received the petition with 95 signatures? e Mr. Laughlin presented the Commission with his copy of the petition. 7 City of Seal Beach Planning Commission * Minutes of May 20, 1998 ;; e Ms. Reeser said it was interesting talking to different residents. She said the residents of Surfside Colony need to be taken seriously when they complain for lack of Police enforcement and feared the value of properties in the Colony would decrease because of these problems. Cindy Reean Nowak * B-14 Surfside Ms. Nowak supported keeping the hours from 11:00 a.m. to 11:00 p.m. She said they get a lot of noise from Sam's restaurant across Pacific Coast Highway. If it becomes noisier late at night it will be very difficult for them to live there. There's a gate into Surfside by the Watertower. People run across Pacific Coast Highway at night, screaming and yelling as they do so. They will go through the gate, into Surfside, and go thru their yards. The residents may have to deal with the Colony on this, suggesting an entry code be put on the gate. She said the Surfside residents would appreciate the Commission's support. There being no other speakers the Chair continued the Public Hearing to June 17, 1998. Commissioner Law asked if there wasn't a law stating everybody had to be off the beach by a certain time? She suggested a curfew might be put on the Surfside beach. e Mr. Whittenberg says he would have to research the law re Surfside, saying there is a curfew of 10:00 p.m. in the Old Town area. Commissioner Larson asked if the Planning Commission could consider whether Taco Surf is allowed to sell liquor? Mr. Whittenberg advised the Commission Taco Surf has a license to sell beer and wine. There are no grounds to revoke that license. Since they have not operated it would be hard to find grounds for revocation. They took over an existing license from an existing business. Chairman Brown asked if there would be another supplemental staff report at the June 1"]'h meeting? Mr. Whittenberg said yes, it would be a revised supplemental staff report to address concerns and questions brought forward tonight. Commissioner Larson said there seemed to be a disagreement as to whether they've expanded the actual foundation or footprint from the original building to what they're building now. He thought the Planning Commission should know whether this is true or not. Mr. Whittenberg said this would be addressed in the staff report. e 8 City of Seal Beach Planning Commission * Minutes of May 20, 1998 e MOTION by Hood; SECOND by Law to continue the public hearing on CUP 98-10 to the Planning Commission of June 3, 1998. MOTION CARRIED: AYES: 4-0-0 Law, Larson, Hood, Brown Staff Concerns Redevelqpment Standards in Commercial Zones Mr. Whittenberg said this item would be rescheduled on the Agenda due to staff's workload at present. Commission Concerns Replies to Constituents & Copy to Commissioners Commissioner Hood said he felt the City needs to listen and reply to its citizens who make public statements. He felt staff should reply to concerns of the public in writing and that the Planning Commission should be copied so they will know what has been said. e Mr. Whittenberg indicated that some questions and some answers are not televised. For example, people do come to the Building/Planning Department counter, ask questions and get answers. The people who have made comments tonight have been told certain matters are pending litigation and the City can't comment on those issues. If they continue to address the Planning Commission on those same matters, staff still cannot comment on the matters because of the pending litigation. Fences Around Swimming Pools Commissioner Law asked what is the legal height of a fence around a pool? Mr. Whittenberg said the legal fence height is 6'. Mr. Steele said there is pending litigation regarding the swimming pool at 206 Ocean Avenue. The City's official position is the position being argued in the litigation and there will not be any discussion in public meetings of what's going on with that particular property. - Bixby Letters Commissioner Larson said that he has begun receiving letters on the Bixby proposal. When he does receive such a letter he does not read it. Commissioners should not get evidence outside the Public Hearings. People should address their comments to the Planning Director who, in turn, will give those comments to the Commissioners at their meetings. 9 City of Seal Beach Planning Commission * Minutes of May 20, 1998 e Mr. Steele said this is a great point. It has always been the City Attorney's position that the evidence on any project should be solely that which is presented at the Public Hearing. On occasion there are instances where a Commissioner may get a phone call or somebody approaches them on the street and it has always been cautioned that those communications should be disclosed during the hearings so each member of the Commission is basing his/her decision based on the same evidence and so that the public knows what information has been presented. If Commissioners get written communications at home, please send them to the Planning Director. The comments will then be included in the Planning Commission's packet, rather than being read individually. ~ Chairman Brown said some time ago the Planning Commission considered the matter of rear yard decks backing to the Hellman Ranch property. The Planning Commission took a position favoring removal of the decks and forwarded that recommendation to the City Council. The City Council decided to bounce the matter back to the Planning Commission. At some point in the future the Planning Commission will re-consider the issue and send it back to the Council again. e Code Enforcement The issue of enforcing the municipal code has been discussed multiple times on the Planning Commission level. It has been sent to the City Council and they have decided to do nothing at this time. CUP Enforcement The issue of CUP enforcement has come up before. Mr. Whittenberg said staff has given the Police Department copies of the Conditions of Approval for all the different restaurants/bars in town. This should be at the Watch Commanders desk. If needed, staff will provide it again. Chairman Brown told the audience that if the Police do respond in a manner which reflects they are unaware of the Conditions of Approval, then please telephone Director Whittenberg and he would contact the Police Department. Howard Brief In-Lieu Parking Fees Mr. Steele said staff and the City Attorney's Office are working with Mr. Brief. They have taken direction from the City Council. They are working on this issue. Chairman Brown said he does not consider this a matter which has been forgotten. - Trash on the Beach 10 City of Seal Beach Planning Commission * Minutes of May 20, 1998 e Chairman Brown said this is not within the purview of the Planning Commission. But it does affect property values and that is within the Commission's jurisdiction. Mr. Whittenberg said he was not sure the comment was directed to trash. He indicated EI Nino storms washed tremendous amounts of debris onto the beaches. Trash on the beach is a serious issue and it will remain until cities catch up and get it cleaned up. It takes time and money to do it. Wall At Seal Beach Trailer Park Chairman Brown asked staff about this wall. Mr. Whittenberg said the trailer park is subject to an Unclassified Use Permit for operating the park. A number of pedestrian access gates have been put in the block wall without proper approvals from the City. A Code enforcement action was begun. The park was informed that to legalize those gates, if they wished the gates to remain, they would have to submit an application to the City to modified their Unclassified Use Permit. Their deadline to do this is coming up within the next two weeks. If they do not comply, a formal legal proceeding will begin . e Height Limits on Main Street Chairman Brown said he has received many calls on the height limit on Main Street. The feeling is that only two stories are allowed on Main Street. He said he was confused and asked this matter be put on the next agenda. Mr. Whittenberg said the issue is before the City Council on May 26111. They will be receiving a report regarding the height and number of stories allowed on Main Street. This will include allowing new residential uses to be built on Main Street. Staff will be looking for Council direction on both issues. Regarding the number of stories allowed, the current municipal Code allows commercial buildings to be 30' but there is no specified number of stories. This could mean a person could build three 10' stories. Some people believe that in 1984 the City Council directed there be only two story building on Main Street but none of the Codes were ever changed to reflect this. The Code is what we have to go by. Once the City Council takes an action staff will prepare a report to the Commission. Applicant Not Show Commissioner Larson said tonight there was another applicant who did not show for his Public Hearing. He felt that if an applicant does not show the applicant is not interested. It is important for applicants to attend Planning Commission hearings. Save Our Pool Chairman Brown read from a flier promoting contributions to "Save Our Pool" and hoped people would respond. e 11 City of Seal Beach Planning Commission * Minutes of May 20, 1998 e 2nd Oral Communications Rita Brenner · Seal Beach Ms. Brenner thanked the Commission for their attention to all the comments. She noted that she has seen people go the Planning/Building Department counter and get answers from staff. She said people do come to the Commission for more clarification or to be on the Record on what's happening. She recalled one speaker's comments regarding Taco Surf -- that building was started without permits. She wondered why people don't know you need permits to build etc. She suggested fines for people who build without permits. It's been a long time since I've been up here to speak and good evening everyone. My name, as you know, is Rita Brenner and I live in the Seal Beach Trailer Park in Seal Beach. I have a question of concern this evening, and just for the Record, these questions will begin -- can you hear me? --- (Adjusts microphone). My questions: ; 1. As a matter of concern, I would like to know who actually owns and who has the jurisdiction over the Trailer Park wall, the area that is just in front of First Street? e 2. Who is responsible for the gate permits on First Street? Would that be the State? Would it be the City? And, for any of the after-the-fact permits? Also, I'm asking that if any of the after-the-fact permits are granted, all well and good, but I'm interested to see that they should also be conditioned permits, so that everyone that faces First Street should be allowed to have the opportunity to choose if they want a gate access as just a few people already have. Also, Lee, could I ask you please, what kind of time-frame could I expect before I get some kind of answer from you? Can you give me any idea? Thank you very much. And I have one last thing I would like to say and this is for matter of Record. I have never, never asked the Seal Beach Trailer Park to pay for me to put in a gate onto First Street. I am prepared, if that opportunity comes, to take care of it myself. I wouldn't know why that would come about, why they would say such a thing. But, I have never asked that and I would like to please have these statements written as such verbatim and not just a general record." Once the Final EIR has been prepanld, die Committee will review Section V-M and forward a recommendation to the EQCB as to the adequacy of the information contained within the Final EIR. In addition, the Committee will be forwarding a recommendation to the Planning Commission relative to the adequacy of the p1opOxd Mitigation MtaSUreS relating to Cultural Resources, as contained in the Final EIR. e a Upon c:ompIction of the 4S-day public comment period on the Draft ErR, City staff and the Consultant Team will prepare the CEQA required -Response to Comments-, Mitigation Monitoring Program, and Final EIR, which will be reviewed by the Board for adequacy. The F'mal EIR will then be forwarded to the Planning Commission for the initiation of the fonnal public hearing process on the Final EIR, and the General Plan Amendment, Zone CJw1ge, Vesting Tentative Tract Map, and other requests by the Bixby Ranch Company P=tinent to this project.
