PLANNING COMMISSION AGENDA INFORMATION SHEET
The following is a brief explanation of the Planning Commission agenda
structure:
AGENDA APPROVAL: The Planning Commission may wish to change the order of the
items on the agenda.
ORAL COMMUNICATIONS: Anyone wishing to address the Planning Commission, only
on items not on tonight's agenda, may do so during this time period. No action can be
taken by the Planning Commission on these communications on this date, unless
agendized.
PUBLIC HEARING ITEMS: Public Hearings allow citizens the opportunity to speak in
favor of or against agendized items. More detailed information is found in the actual
agenda attached. If you have documents to distribute, you should have enough copies
for all Planning Commissioners, City staff and the public. Please give one to the
secretary for the City files. The documents become part of the public record and will not
be returned.
CONSENT CALENDAR: Consent Calendar items are considered routine items that
normally do not require separate consideration. The Planning Commission may make
one motion for approval of all the items listed on the Consent Calendar.
SCHEDULED MATTERS: These items are considered by the Planning Commission
separately and require separate motions. These transactions are considered
administrative and public testimony is not heard.
STAFF CONCERNS: Updates and reports from the Director of Development Services
(Planning and Building Departments) are presented for information to the Planning
Commission and the public.

Minutes of October 4,2000
Chairperson Hood called the. regularly scheduled meeting of the Planning
Commission to order at 7:30 p.m. on Wednesday, October 4, 2000. The meeting
was held in the City Council Chambers and began with the Salute to the Flag.1

Mr. Whittenberg reported that Commissioner Lyon had called to excuse himself from
tonight's meeting due to illness. He noted that he had not yet heard from
Commissioner Sharp regarding his attendance.
AGENDA APPROVAL
Mr. Whittenberg stated that for Item No.2, Site Plan Review 00-3 and Conditional
Use Permit 00-8, a representative of Urban Solutions, Inc. had telephoned the
Director of Development Services and requested that this matter be tabled to a
future date until negotiations for acquisition of the property were complete. The
Director of Development Services stated that the item would be re-noticed and
re-advertised for public hearing. Chairperson Hood asked if the vote to table this
item should be taken now or when that item is addressed in the Agenda. Mr.
Whittenberg recommended approving the Agenda now and voting on the item when
it is to be addressed in tonight's agenda.
MOTION by Cutuli; SECOND by Brown to approve the Agenda as presented.

SCHEDULED MATTERS
3. Presentation of State Mandated General Plan Housing Element Revision
Process.
The Director of Development Services stated that he wanted to familiarize the
Commission with the process of updating the Housing Element for the City of Seal
Beach General Plan. (A copy of this presentation is on file for inspection in the
Planning Department.) He explained that under the provisions of state law, all cities
in Los Angeles, Orange, San Bernardino, and Riverside counties must have their
Housing Element updated by December 31, 2000. He stated that the City had
contracted with a consulting firm that specializes in preparing housing elements and
the City expects to receive a draft of this document to have available for the
Planning Commission by the end of October or early November.
He contfnued by stating that the State of California has adopted general laws that
apply to all cities in California with a statewide housing goal that "Decent housing
and a suitable living environment must be provided for every California family."
These laws also mandate a Housing Element to be a component of the General
Plan and require that certain items must be evaluated and identified during the
update process.
Mr. Whittenberg stated that the role of the Department of Housing and Community
Development is to review housing elements to determine whether or not they
conform with the provisions of state law, and to certify that document as being in
compliance with state law. He said that this process can be very lengthy and
sometimes quite controversial. Mr. Whittenberg then described the process for
drafting the Housing Element. He explained that the Planning Commission will
review the document and if approved, it will go before City Council for approval and
adoption. After adoption the document is sent to the State agency for review and
final approval at that level.
Mr. Whittenberg explained that the State of California has never certified a Housing
Element for the City of Seal Beach. He noted that if a city does not have a legally
adequate Housing Element as determined by the State or by a court, they are not
eligible to receive certain types of grant funds. He stated that if a city does not have
a Housing Element, they may be subject to litigation on issues related to housing.
He said that in Orange County there is a substantial imbalance of housing
availability vs. housing need. He reviewed presentation graphs depicting the
projected statistics for population growth in Orange County and existing home
prices. He noted that the increasing population by the year 2020 will create a

tremendous demand for new housing in Orange County. He indicated that housing
costs are usually higher in Southern California and that approximately 40% of all
renters within Orange County are low/moderate income families, and 15% of all
homeowners also fall within this category. Mr. Whittenberg outlined affordability of
homes and rental units in Orange County based upon family income. He stated that
the Housing Element will review existing programs and policies of the City and
attempt to evaluate how these programs provide opportunities for low to
moderate/income housing. It will also discuss what has happened to existing
housing within the community since the last Housing Element Update.
Mr. Whittenberg discussed the existing needs analysis that includes general
demographic information, housing characteristics, vacant land opportunities for new
housing, and the housing construction rate. He noted that the construction rate
within Seal Beach was very low. He stated that the Housing Element would provide
projections of housing needs in Orange County within the next 5 years and will
include a section on special needs assessment. Mr. Whittenberg stated that once
the draft for the Housing Element is complete, public hearings will be held both at
the Planning Commission and City Council level. He then proceeded to outline
some policy options for housing as follows:
1. Preservation/Rehabilitation
2. Multi-Family Housing
3. Infill
4. Mixed Use Housing
5. Manufactured Housing
6. Granny Flats
7. Senior Housing
In presenting these options, Mr. Whittenberg provided examples and reviewed the
advantages and disadvantages of each.
With regard to Granny Flats, Mr. Whittenberg explained that although mandated in
all cities in the State of California to be allowed, this use has not been utilized very
much within Seal Beach. He noted that Seal Beach has a very large contingent of
existing senior housing in the Leisure World complex, and this is an issue that would
probably not be addressed in the housing element as far as additional opportunities
for this category of housing.
The Director of Development Services discussed federal and state programs
available that provide financial assistance for housing programs. He stated that the
City currently participate in a Mortgage Credit Certificate Program through the
County of Orange, which provides reduced interest rate financing for first-time home
buyers of homes within a specific price range. He said that in Seal Beach the only
homes that qualify are attached condominium units. Mr. Whittenberg also provided
information on the rental assistance programs and the Redevelopment Affordable

Housing Set-Aside Fund available to low/moderate income residents wanting to
make needed improvements to their homes.
Mr. Whittenberg explained that within the Housing Element the City must define
specific objectives as to the number of housing units to be rehabilitated, constructed
or conserved (by income levels) over the next 5 years. He stated that input from the
Citizens Participation Committee will be presented when public hearings are held
before the Planning Commission and City Council to discuss housing needs within
Seal Beach.
Commissioner Questions
Commissioner Brown asked when public hearings on the Housing Element would
take place. Mr. Whittenberg responded that the public hearings were tentatively
expected to take place in early to mid-November. Commissioner Brown confirmed
that the process had to be complete by December 31, 2000. Mr. Whittenberg
responded that December 31 is the deadline, but he doubts that there would be a
major outcry if cities have not adopted their Housing Element by this date. He said
that part of the difficulty is that the State is required to give the Southern California
Association of Governments (SCAG) an overall housing need for its region, which
includes Los Angeles, Orange, San Bernardino, Riverside, and Ventura Counties.
He explained that each of these counties receives an allocation of units from SCAG,
and the County will distribute the number of units that each community must
accommodate. He said that the state and SCAG have been arguing for
approximately 15 months on what the appropriate number of units allocated within a
region as a whole should be. He stated that until this issue has been resolved, cities
cannot finalize their Housing Elements, and will probably not have them completed
by December 31,2000.
Commissioner Cutuli asked who would be completing the Housing Element for the
City of Seal Beach. Mr. Whittenberg reported that the City has retained the
consulting firm of Cotton, Beland, and Associates (CBA). He noted that over the last
15 years they have prepared approximately 65-70% of the housing elements for
cities within Los Angeles and Orange Counties. He said that they were very
experienced in this area. Commissioner Cutuli asked if the City is allowed to provide
input. Mr. Whittenberg responded that CBA would provide a draft document for
review by the Planning Commission and before taking the document before the City
Council for public hearing.
STAFF CONCERNS
Mr. Whittenberg reported that at the Planning Commission meeting of September
20, 2000, the Commission had requested that they be provided with a copy of the
permit to allow live entertainment at O'Malley's. He noted that a copy of the permit
had been distributed tonight to each of the Commissioners.
