PLANNING COMMISSION AGENDA INFORMATION SHEET
The following is a brief explanation of the Planning Commission agenda
structure:
AGENDA APPROVAL: The Planning Commission may wish to change the order of the
items on the agenda.
ORAL COMMUNICATIONS: Anyone wishing to address the Planning Commission, only
on items not on tonight's agenda, may do so during this time period. No action can be
taken by the Planning Commission on these communications on this date, unless
agendized.
PUBLIC HEARING ITEMS: Public Hearings allow citizens the opportunity to speak in
favor of or against agendized items. More detailed information is found in the actual
agenda attached. If you have documents to distribute, you should have enough copies
for all Planning Commissioners, City staff and the public. Please give one to the
secretary for the City files. The documents become part of the public record and will not
be returned.
CONSENT CALENDAR: Consent Calendar items are considered routine items that
normally do not require separate consideration. The Planning Commission may make

Chairperson Hood called the regularly scheduled meeting of the Planning
Commission to order at 7:30 p.m. on Wednesday, September 20, 2000. The
meeting was held in the City Council Chambers and began with the Salute to the
Flag.1

Mr. Whittenberg reported that the applicant has requested that Item No.5, Site Plan
Review 00-3 and Condit,ional Use Permit 00-8, be continued to the Planning
Commission meeting of October 4, 2000. He stated that he had spoken to the
applicant's representative today and had indicated that Staff was concerned about
the number of continuances requested on this matter. He said the representative
suggested that a meeting be scheduled with the Director of Development Services,
the applicant, and the owners of the shopping center to make sure that everyone is
clear on their individual responsibilities for meeting the conditions of approval as
documented in the Staff Report. Mr. Whittenberg noted that a meeting has been
scheduled for the following week.

Mr. Whittenberg noted that Item No.2, Minor Plan Review 00-5 should have been
listed in the Consent Calendar. He requested that the item be moved from Public
Hearing items to the Consent Calendar. He said that this item was advertised as a
Consent Calendar item so no public notice was required.
Mr. Whittenberg reported for the record that a letter from the next door neighbor to
308 and 310 Ocean expressing support for Minor Plan Review 00-5 had been
received and a copy provided to each Commissioner.

Mr. Whittenberg advised that the adoption of Resolution No. 00-30 begins a 10-day
calendar appeal period to the City Council. The Commissioner action tonight is final
and the appeal period begins tomorrow morning.

Staff Report
Mr. Cummins delivered the staff report. (Staff Report is on file for inspection in the
Planning Department.) He provided some background information on this item and
presented photographs of the establishment. He described the property as Orange
County Assessor's Parcel No. 043-122-36 and stated that the restaurant measures
approximately 2,400 square feet, which includes a 400 square foot patio fronting
Pacific Coast Highway at the corner of 12th Street. He stated that the property
received approvals from the City for a Plan Sign Program in 1989 and an amended
Sign Program in 1990. He reported that the Surf and Sun Preschool is the nearest
residential property located immediately to the south of the restaurant. Mr. Cummins
stated that routine action on all Alcohol and Beverage Control (ABC) requests is to
contact the Seal Beach Police Department (SBPD). He stated that Captain John
Schaeffer had reviewed the application and has no objections to its approval.
He described the surrounding land uses as follows:

EAST:

(RHD/RMD) Zone and General Commercial in a C-2 Zone.
Mr. Cummins reported that he had contacted ABC to acquire the current ratios for
overconcentration of ABC licenses within the County. Mr. Cummins explain'ed that to
determine the concentration of licenses ABC will take a ratio of the total number of
licenses issued in the County and divide this by the total population to establish a
base ratio. He reported that currently the ratio for on-site sale licenses is 1 license
for every 954 residents. He stated that this ratio is then applied to the population of
the census tract to generate the number of allowable licenses. He said that currently
for this census tract 7 on-site sale licenses are allowed, and currently 26 have been
issued. He reviewed ABC Regulation 61.3, which gives ABC the option to deny an
alcohol license in overconcentrated areas, which also have high crime reporting
districts. He stated that this area is not a high crime district and overconcentration in
this case would not necessitate a denial. He said that ABC leaves these issues up
to the individual cities, as there are individual characteristics to each application to
, be considered. He noted that had this restaurant been located on the north side of
Pacific Coast Highway the concentration ratio would have been significantly different
as that is where the census tract boundary line lies. He also noted that the majority
of the city's alcohol licenses are for establishments located along Main Street. Mr.
Cummins stated that noise would not be an issue as the outdoor dining area fronts
Pacific Coast Highway and is contained by a 4-foot high plastic shielding that helps
to dull any loud noise. Staff recommends approval of Conditional Use Permit 00-10,
subject to conditions as this request is consistent with the Land Use Element of the
General Plan and the building and property are adequate in size, shape, topography,
and location for the proposed use.
Commissioner Questions
Commissioner Cutuli asked if the Surf and Sun Preschool could be categorized as a
school. Mr. Cummins stated that ABC was contacted regarding this issue and
confirmed that the preschool would be classified as a school. Commissioner Cutuli
asked if there were no problem with the City approving on site beer and wine sales
at an establishment next to a school. Mr. Cummins stated that the ABC
representative had reported that ABC can refuse to issue an alcohol license to a
business that is located within 600 feet of an existing school, but it is not an
automatic refusal. He stated that ABC does provide a notice of the application for a
license to the surrounding area, and if any protest is received, then the license would
be denied. Commissioner Cutuli asked if ABC has provided notice yet. Mr.
Cummins responded that the notice has been sent and no response or protest has
been received.

Mr. Joseph Barbara stated that he is the owner of Finbar's Kitchen in Seal Beach
and that in the 4 years that Finbar's has been in operation there have been no
incidences or problems with serving alcoholic beverages. He stated that most
people realize that today in order to be successful in the restaurant business, it is
important to be able to serve wine or beer with meals. He requested approval of this
application so that the Blackboard Bistro can compete in the market.
Commissioner Sharp asked if Mr. Barbara had plans to remodel to include a bar or
lounge. Mr. Barbara stated that all of the remodeling of the restaurant is complete
and there are no plans to add a bar. He said that the only thing left to do was to
complete interior sign age.
Chairperson Hood closed the public hearing.
Commissioner Comments
Commissioner Bro,<<n asked what had happened to the district boundary signs that
were previously posted on the Council Chambers blackboard. Mr. Whittenberg
stated that he did not recall these signs being posted for quite some time. He
indicated that the property was located in Commissioner Brown's district.
Commissioner Brown stated that the issue of overconcentration of ABC licenses
would inevitably come up, but he believed the important consideration was whether
or not the business is a bona fide eating establishment. He noted that in this case
he did not see this as a problem as the applicant has a long history at other
restaurants in town and the Commission is well aware of the applicant's character.
He said that although there are concerns that should the property be sold, another
owner might decide to operate a strip bar under the same Conditional Use Permit,
he believes that some things have to be taken at face value. Commissioner Brown
emphasized that when you have a well-known business operator with a good record,
the Commission must assume that he will operate in good faith, and he was sure
that Mr. Barbara would do so. Mr. Whittenberg reassured the Commission that any
use involving entertainment would require approval of a separate Conditional Use
Permit. He reported that Conditional Use Permit 00-10 does not allow live
entertainment on a regular basis. Mr. Whittenberg also noted that in order to create
a bar area in the restaurant, the applicant would have to apply for approval by the
Planning Commission. Commissioner Brown stated that he expressed this concern
as several of the businesses on Main Street that began as bona fide eating
establishments could now be categorized as "bars" or "beer bars" and not as
restau rants.
Commissioner Sharp stated that although initially he had some concerns about
Conditional Use Permit 00-10, after talking with the Director of Development
Services those 'concerns were allayed. He said that he recognizes that it is difficult
in this day and age for a restaurant to succeed without a liquor license and he is now
in favor of approval.

The Director of Development Services clarified that after his conversation with
Commissioner Sharp, Staff had contacted ABC. He said that their rules do allow for
the automatic denial of a license for any establishment within 600 feet of a school,
and this includes day care facilities, if an objection is filed on the ABC notice of their
intent to issue a license. He stated that at this point no objections to the notice have
been received. Chairperson Hood asked if this rule also applied to anything that
might happen subsequent to the license being issued. Mr. Whittenberg responded
that should problems arise once a license has been issued and a complaint is
received, ABC will investigate and take specific steps to attempt to remedy the
problem. If the problem continues after a period of time, ABC can then rescind the
license.
Commissioner Sharp asked if a review period had been included for this application.
Mr. Whittenberg responded that for this application Staff has recommended a 12-
month review. He noted that another Condition of Approval states that should
problems arise before the end of the review period, the Planning Commission can
recall this Conditional Use Permit for a hearing. He reported that this is a standard
condition that is included with all Conditional Use Permit applications.

and adopt Resolution No. 00-33.

presented photographs of the Old Town Cafe. He described the property as Orange
County Assessor's Parcel No. 199-034-04 and stated that the restaurant measures
approximately 1,912 square feet and has recently changed ownership. He stated
that the restaurant is currently open for breakfast and lunch only and the new owner
would like to stay open for dinner and would like to serve beer and wine. Mr.
Cummins noted that Captain John Schaeffer of the Seal Beach Police Department
(SBPD) had reviewed the application and has no objections to its approval.
He described the surrounding land uses as follows:
NORTH & SOUTH:

He reported that this application falls within the same census tract as Conditional
Use Permit 00-10 with the ratio of 7 on-site sale licenses allowed, with 27 already
issued. Mr. Cummins again emphasized that overconcentration does not
necessitate denial. He said that for businesses along Main Street service of beer
and wine is important to attract both resident and visitor patronage. He stated that
having a restaurant on Main Street is highly desirable within the confines of the Main
Street Specific Plan (MSSP), and in order for a restaurant to remain viable as a
eatery within this environment, it must have the ability to sell beer and wine for on-
premises consumption. He stated that given the fact the there is no "bar area" in the
restaurant, noise would not become an issue as the Old Town Cafe is a bona fide
eating establishment. He indicated that a sample menu had been included for
review with the Staff Report. Mr. Cummins displayed a map designating the
distribution of ABC on-sale licenses along the Main Street area. Mr. Cummins
reported that the applicant is not proposing a major remodel to create a separate bar
area. Staff recommends approval of Conditional Use Permit 00-11, subject to
conditions as this request is consistent with the Land Use Element of the General
Plan and the building and property are adequate in size, shape, topography, and
location for the proposed use. He stated that Staff is also proposing a 12-month
review for this request.
Commissioner Questions
Commissioner Brown asked if a public hearing would be required simply on the
basis of changing the hours of operation. Mr. Cummins responded that a public
hearing would not be required strictly for a change in the hours of operation as a
business can operate on Main Street without a Conditional Use Permit. Mr.
Whittenberg stated that currently there are no restrictions on the hours of operation

for the Old Town Cafe. He said that approval of Conditional Use Pennit 00-11 would
allow the Planning Commission to impose a restriction on the hours of operation.
Commissioner Brown stated that he had received telephone calls regarding
intensification of use and the parking issue, since the restaurant had not formerly
stayed open for dinner. He asked why this issue had not been addressed in the
Staff Report. Mr. Whittenberg reported that the issue of parking was not addressed
because the standard for restaurants of 1 parking space per 100 square feet of
building area is the same regardless of whether or not alcoholic beverages are being
served.
Public Hearina
Chairperson Hood opened the public hearing.
Mr. Barry Curtis, a representative for David Morgan, stated that it is almost a
necessity to serve beer or wine with dinner service in today's restaurant market. He
said that of a total of 16 restaurants along Main Street, all but two serve beer and
wine. Mr. Curtis reported that the applicant accepts the requirement for a 12-month
review and is confident that there will be no problems. He stated that the owner has
no plans to modify the interior or exterior of the restaurant, but simply wishes to
expand the hours to allow him to recoup his costs of operation. Mr. Curtis stated
that as Mr. Whittenberg had indicated, should any problems arise this Conditional
Use Permit could be recalled before the Planning Commission for review.
Mr. Bob O'Rear, the owner of the property, stated that the previous owner of the Old
Town Cafe had remained open for dinner during the summer months and there had
been no problems with parking. He stated that in the past an ABC license had been
issued for the Old Town Cafe and he would like to see it reinstated.
Chairperson Hood closed the public hearing.
Commissioner Comments
Commissioner Brown stated that with this property there was more danger of it
turning into a bar. He said that in order to control this, he would like to change the
wording of paragraph 17( c ) to read "There is a substantial change in the mode,
character of operations, or approved floor plan of the establishment." Commissioner
Brown stated that he wanted the Old Town Cafe to be successful and he believes it
is a good idea to extend the hours. He said that he addressed the issue of parking
in order to respond to the inquiries made regarding this. He explained that the
Planning Commission and the City are the landlords of Main Street and based on
what they allow, they determine the character of Main Street. He said that he
believed the City and the residents want to have a friendly town, but it is not the
intent of the Plannin'g Commission or the City to have Main Street converted to "a
bar-oriented street."

Chairperson Hood indicated that several of the individuals involved with the
development of the MSSP were present at tonight's meeting. He stated that the
MSSP talks about the spirit of a small town, and he believes that this is very

eventually." He said that there are many strange notions about what small-town
America is supposed to be, and about "the Great American Golden Age."
Chairperson Hood noted that this Golden Age is an incongruous composite of primal
ancestors, Missouri boyhoods, and cowtown brothels. He said that the idea of
small-town America is not what people might perceive as they observe an individual
lurch from bar to bar dOWn Main Street. He indicated that he was not present when
this phrase was added to the MSSP, otherwise he would have said something.

Mr. Boga advised that the adoption of Resolution No. 00-34 begins a 10-day
calendar appeal period to the City Council. The Commissioner action tonight is final
and the appeal period begins tomorrow morning.

COMMISSION CONCERNS
Commissioner Brown stated that he had received a telephone call regarding
O'Malley's having a live band on site over the weekend. The concerned party had
inquired if this was allowed under the approved Conditional Use Permit.
. Commissioner Brown asked if this was a special event or if this was to be a regular
series of Saturday night events. Mr. Whittenberg responded that the City Manager
does have the authority to issue Special Event Permits, and on an occasional basis
they will issue permits to allow live entertainment in some of the Main Street
restaurants. He stated that allowing live entertainment was not approved with the
Conditional Use Permit for O'Malley's, but there have been instances for special
events where a permit has been issued. Commissioner Brown asked if a permit
would be required to have any type of live entertainment. Mr. Whittenberg confirmed
that this was true. Chairperson Hood requested that this concern appear in the
minutes and that if a permit was issued that Staff provide the date that it was issued.
Mr. Whittenberg indicated that it was different to see Mr. Barry Curtis on the other
side of the counter, as he was formerly the Associate Planner for the City of Seal
Beach. He noted that Mr. Curtis was a valued employee of the City for many years
and he has done very well in his new endeavor. He stated that it was a pleasure to
see Mr. Curtis again.
