CONSENT CALENDAR: Consent Calendar items are considered routine items that
normally do not require separate consideration. The Planning Commission may make

Chairperson Hood called the regularly scheduled meeting of the Planning
Commission to order at 7:30 p.m. on Wednesday, December 4, 2002. The meeting
was held in the City Council Chambers and began with the Salute to the Flag.1

Mr. Whittenberg noted for the record that on Minor Plan Review (MPR) 02-8 for the
property at 257 and 259 Seal Beach Boulevard, Staff has provided a revised site
plan showing the realignment of the laundry room in conformance with what is
presented In the Staff Report.
Commissioner Shanks requested that Item 1 be removed from the Consent
Calendar for further discussion.

Chairperson Hood opened oral communications.
Mr. Don Mabe stated that he had read in the Sun Newspaper that at tonight's meeting
the Planning Commission would be prohibiting construction of 3-car garages because of
the concern that residents would use them as habitable space. Chairperson Hood
indicated that 3-car garages were to be discussed during the public hearing for Zone
Text Amendment (ZTA) 02-2 later this evening.
There being no one wishing to speak, Chairperson Hood closed oral communications.

Mr. Abbe advised that the adoption of Resolution Nos. 02-44 and 02-45 begins a 10-day
calendar appeal period to the City Council. The Commissioner action tonight is final
and the appeal period begins tomorrow morning.
5. Approve Planning Commission Meeting Minutes of November 6, 2002.
Commissioner Shanks referred to Page 14, Line 18 and noted that it was his
understanding that the Planning Commission (PC) was to receive color copies of the
Planning District maps. Mr. Cummins stated that Staff would provide these maps at the
next scheduled meeting.

Staff Reoort
Mr. Whittenberg delivered the staff report. (Staff Report is on file for inspection in the
Planning Department.) He provided some background information on this item and
noted that this is an indefinite extension request for a previously approved Conditional
Use Permit (CUP). He stated that when the facility received this CUP authority for on
premises alcohol sales, there was a condition imposed at that time that a handicapped
restroom facility be provided within a 3-year period of time from the date of approval of
the initial CUP. He noted that close to the end of the 3-year period the owners of the
Rossmoor Shopping Center indicated that they would probably not be extending the
leases for businesses in that area of the center. He said the operators of the Yucatan
Grill were required to again come before the PC to extend their CUP approval.
Approximately one year ago the PC granted a one-year extension of CUP 98-6 to await
a final decision from the Rossmoor Center. He reported that as of tonight a final
decision has not been made and the applicant is requesting another extension. Mr.
Whittenberg indicated that a special condition has been added that, if approved, would
make this an indefinite extension until such time as Rossmoor Center makes a final
decision on whether to extend the lease. If no decision is made within the next three
years, the Yucatan Grill will be required to provide the handicapped restroom as was
initially required in the 1998 approval.
Commissioner Questions
Commissioner Shanks referred to Page 5 of the Staff Report and asked what the
conditions of the lease renewal would have to be (e.g., month-to-month, annually) in
order to determine when provision of the handicapped restroom is to commence. Mr.
Whittenberg stated that Staff would not accept a month-to-month extension of the lease,
as this would be categorized as rent rather than a lease. He noted that if a 6-month or
one-year lease were granted, the applicant would then have to apply for the permits to
develop a handicapped restroom or come before the PC to request reconsideration of
this condition, based on the shortness of the term of the lease. Mr. Whittenberg then
stated that the PC could include a definition of a minimum term for the lease that would
require that the applicant provide the handicapped restroom.
Chairperson Hood requested that Staff provide a review of CUPs and whether they run
with the property. Mr. Whittenberg reported that all CUPs run with the land itself, or the
building address, and are not tied to a particular business operator and all CUP
approvals and resolutions will include a condition that the applicant must sign an
Acceptance of Conditions (AOC) form that states that they agree to the conditions He
noted that in this way when a business with a CUP is transferred, the new operators

would also be required to complete an AOC form. Chairperson Hood stated that a letter
from the Rossmoor Center was on file stating that the buildings on the property might be
demolished. Mr. Whittenberg countered that the shopping center is evaluating whether
or not they may eventually destroy the buildings and redevelop the entire shopping
center. He indicated that because of this uncertainty Rossmoor Center has determined
to not extend leases beyond the year 2004. Chairperson Hood asked if the building
were to be destroyed, what would happen to the CUP. Mr. Whittenberg stated that at
that point the CUP would cease because the building that it was issued on would no
longer exist. Chairperson Hood asked what would happen to the CUP if the same
address were assigned to the newly developed building. Mr. Whittenberg stated that if
the new business was to be operated as a restaurant facility with an alcohol license and
outdoor dining and they accept all of the conditions of approval and stay within the
approved floor plan of the previous business, they would be able to keep the CUP.
Chairperson Hood read from the letter from Brian Gibbons in which he states that the
lease is to be renewed until the year 2004 after which the owner intends to demolish the
buildings, and asked if this were not their intent. Mr. Whittenberg stated that this is what
the owners of Rossmoor Center have indicated, but at this point the City has received
no application for a demolition plan permit. Chairperson Hood confirmed that if the
building were demolished, the CUP would cease. Mr. Whittenberg stated that this is
correct. Chairperson Hood asked if this statement should be included or if this were
general law. Mr. Whittenberg stated that this is a provision of general law.

Chairperson Hood opened the public hearing.
There being no one wishing to speak, Chairperson Hood closed the public hearing.
Commissioner Comments
Commissioner Shanks stated that if the new lease were extended for more than 6
months, he would like to condition approval of this request to require development of the
handicapped restroom. Mr. Whittenberg added that should the applicant feel that the
length of the new lease is not sufficient to warrant the expense of installing the
handicapped restroom, he could come before the PC again to request modification of
this condition. He recommended the following language be incorporated into Condition
No. 1 of Resolution 02-43:
"If the property owner extends the lease of Yucatan Grill for a period of time
greater than 6 months. . . II

7. Zone Text Amendment 02-2
Citywide

Request:

To amend the Code of the City of Seal Beach to require a
discretionary permit for any garage larger than 3 vehicles in
the City. Under the proposed changes, any applicant
requesting a garage larger than 3 vehicles for a residential
project would require a Conditional Use Permit.
Recommendation:
Approval, subject to conditions and adoption of Resolution
02-46.
Staff Report
Mr. Whittenberg delivered the staff report. (Staff Report is on file for inspection in the
Planning Department.) He provided some background information on this item and
stated that the Planning Commission (PC) had conducted a discussion on the issue of
3-car garages in relation to development work being completed on a home on Crestview
Avenue. He said that City Council also discussed the issue and had directed Staff to
prepare a Zone Text Amendment (ZTA) for consideration by the PC to put in place a
discretionary review process for persons who wish to construct a garage for 4 or more
cars. He then explained that the Staff Report proposes using the Conditional Use
Permit (CUP) process, which involves a formal public hearing and requires that public
notice be published in the newspaper and mailed to all property owners and occupants
of structures within 300 feet of the property proposing a garage structure for more than
3 cars. He stated that the CUP approval process is discretionary at the PC level, based
upon the PC's evaluation of the compatibility of this type of development within the
neighborhood in which in would be located. The Director of Development Services then
noted that the other process that allows for discretionary review by the PC is the Minor
Plan Review (MPR) process, which is a Consent Calendar item on the Agenda and
would not involve a public hearing. He explained that it does involve a public notice
mailed to all property owners and occupants within 100 feet of the particular property In
question. Mr. Whittenberg stated that as the Code is currently written, it states that an
accessory garage for 3 cars or more would require a CUP and the manner in which the
City has interpreted this is that this approval is required for a free-standing garage
structure, not physically attached to the house. He said that if the garage is attached to
the house, then the City has not required the CUP review. He said that this provision

would require a CUP review whether or not the garage is attached to the main
residence. He indicated that based upon the discussions on this Issue Staff believes
that there should be some sort of review process available to the public in considering
garage structures for 4 or more cars.
Commissioner Questions
Chairperson Hood clarified that if Resolution 02-46 were approved tonight as presented,
this would include the CUP process for all applications for construction of garages for
more than 3 cars. Mr. Whittenberg stated that this was correct.
Public HearinQ
Chairperson Hood opened the public hearing.
Mr. Don Mabe stated that he has a 4-car, detached garage, which he uses to store his
vehicles. He said that across the street from his home are six houses with 21 cars,
which are parked in the garages. He stated that the newspaper article he read stated
that if people had a 2-car garage and wanted to add a 3-car garage, that the City would
oppose this. He said that most homes in Old Town have 2-car garages and if families
have a teenager with a car and no ability to create a larger garage to store this vehicle,
it places the car owner at risk of having the car damaged or vandalized. He said that
when constructing his garage it was red-tagged because he had constructed a
bathroom in the garage. He stated the City needs more garages to help alleviate the
parking problems. He noted that 13th, 14th, 15th, 16th, and 1ih Streets, Marina Drive and
Dolphin Avenue are not in compliance with the Fire Code that states that the fire access
road must be 21-feet wide to park on one side of the street. He stated that all of these
streets are 20 feet or less with parking on both sides of the street. Mr. Mabe stated that
if the City were going to deny construction of more and larger garages, there would be
more cars parked on the street creating a dangerous situation. He stated that he is in
favor of allowing construction of larger garages.
Mr. Bruce Bennett stated that he had heard there was a change to one of the State
Codes that once there is a 3-car garage on a property the owner might be able to create
a 4-car garage and then convert it into a living unit. He commented that having the
complete Agenda for both the Planning Commission and City Council meetings on the
City website would make it very convenient for those members of the public interested
in acquiring the Staff Reports for specific items of interest to them.

Commissioner Comments
Commissioner Deaton stated that in response to Mr. Mabe's comments, the idea is not
to say that property owners cannot construct a garage larger than for 3-cars. She said
that the point is to allow neighbonng residents to receive notice of these projects so that

if there is a problem with it the PC has a means for dealing with the issue. She
emphasized that this would allow surrounding residents to have a say. She said that
she favors the CUP process because of the 300-foot public notice requirement.
Commissioner Shanks stated that the PC is not opposed to 4-car garages as long as
they do not affect the aesthetics of the neighborhood.
Mr. Whittenberg stated that it appears that the general consensus is that the CUP
process is favored over the MPR process, so Resolution 02-46 should be amended to
reflect this.

Mr. Whittenberg noted that on a ZT A the PC serves as a recommending body and there
is no appeal period but the ZTA will automatically be scheduled for a future public
hearing at the City Council level.
SCHEDULED MATTERS
City Council Direction Re: Section 28-2407, Enlargements or Structural Alterations To
Nonconforming Residential Buildings and Uses.
Mr. Whittenberg stated that at the request of Councilperson Antos the City Council (CC)
at its last meeting reviewed for adoption an emergency ordinance to prevent the City
from considering applications for additions or enlargements to nonconforming
residential structures. He said that the CC determined not to adopt the ordinance but
instead made a determination to instruct the PC to initiate a number of study sessions to
review the existing provisions of the ordinance to establish whether they need to be
revised based upon the concerns of the PC or the public regarding the current
provisions. He indicated that copies of the memorandums presented to CC have been
provided to the Commissioners in their Agenda packets along with a draft of the
ordinance that was not adopted. He stated that the PC could agree upon a date to
schedule a study session to review this issue. Mr. Whittenberg recommended that the
first study session be scheduled for the second PC meeting in January 2003 or the first
meeting in February 2003. Commissioner Deaton stated that she would be out of town
at the end of January and it was, therefore agreed that the study session would be
scheduled for the first meeting of February 2003. Commissioner Shanks inquired as to
whether the CC wanted to hold a joint meeting on this issue. Mr. Whittenberg reported
that Council person Antos had presented this proposal, but no further discussion was

heard from the other council members. He stated that he would report the proposed
meeting date to CC and ask if they would like to hold a joint study session at that time.
Commissioner Shanks noted that the issue of nonconforming structures is totally an Old
Town problem and doesn't really affect other areas of town. Mr. Whittenberg stated that
this issue basically affects Old Town and Surfside.
STAFF CONCERNS
Mr. Whittenberg reported that an appeal has been filed for the PC decision on
Conditional Use Permit 02-16 for 1210 Electric Avenue. He also reported that release
of the Draft Environmental Impact Report (DEIR) for the Boeing Specific Plan is
imminent. He noted that there is to be a 45-day public review period during which time
the document will also be reviewed by the Environmental Quality Control Board (EQCB)
and the Archaeological Advisory Committee (AAC) to receive input on the adequacy of
the document. Once this is complete a Final EIR will be completed along with the
project proposal and these documents will then be scheduled for public hearings before
the PC. Mr. Whittenberg indicated that the projected time of release would be late
December 2002.
The Director of Development Services ended by wishing the Commissioners a Happy
Holiday Season.
COMMISSION CONCERNS
Chairperson Hood inquired about when the bike lane striping along Lampson Avenue
would begin. Mr. Whittenberg stated that he was under the impression that it had
already begun, but he would check on this and get back to Chairperson Hood with this
information.
ADJOURNMENT
Chairperson Hood adjourned the meeting at 8:13 p.m.
