AND CHARGES FOR GOODS, SERVICES AND
FACILITIES PROVIDED BY THE CITY
SUMMARY OF REQUEST:
Conduct public hearing. After closing of the public hearing, adopt Resolution
Number 5783, A Resolution of the City Council of the City of Seal Beach
Establishing Fees and Charges for Goods, Services and Facilities Provided by
the City of Seal Beach and Superseding Resolution Number 5569.
BACKGROUND:
On June 25, 2007 the City Council adopted Resolution Number 5569,
establishing fees and charges for goods, services and facilities provided by the
City of Seal Beach, and superseding inconsistent provisions of Resolution
Number 5477. As part of the general fee revision process of the City and the
comprehensive Code revision process that has been completed by the City
Council, certain revisions to the fees and charges established by Resolution No.
5569 are requested for adoption by the City Council.
Provided below is a general summary ofi the requested fee revisions. Provided
as Attachment 1 is proposed Resolution Number 5783, which sets forth the fees
for all city-provided services, including the requested fee revisions discussed
below. Provided as Attachment 2 is a compilation of the requested revisions
provided in a strikethrough/underline version to clearly indicate the requested
revisions to the current fee resolution.
The Council will consider adopting the following amendments to the current fees:

SECTION 1. ADMINISTRATIVE FEES:
^ New Fee, Section 1, Administrative Fees, Sub-section A.1, new copy
charge for documents larger than 8'/2" x 11" to be $0.50 per page to reflect
increased cost of paper for larger document reproduction.
^ New Fee, Section 1, Administrative Fees, Sub-section A.3, new charge
for documents prepared onto a compact disc; $5.00 per disc. All
subsequent sub-sections renumbered accordingly.
^ Revised reference in Section 1, Administrative Fees, renumbered Sub-
section A.5, to indicate "Municipal Code -Titles 1 through 9."
^ New Fee and revised reference in Section 1, Administrative Fees,
renumbered Sub-section A.6, to indicate "Development Code -Titles 10
through 12" and revised fee from $35.00 to $75.00 to reflect increased
copying cost for new Titles 10 through 12 of the Municipal Code recently
adopted.
^ New Fee, Section 1, Administrative Fees, new Sub-section A.13,
"Candidate's Filing Fee." Establishes maximum amount of $25.00 as
allowed by State Elections Code, §10228. The fee is non-refundable.
SECTION 2. BUILDING FEES:
^ Revised Sub-section title, Section 2, Building Fees, Sub-section A, revise
title to read "Laser fiche/Microfilm Fee" to reflect additional record system
retention capabilities utilized by the City.
^ Revised reference in Section 2, Building Fees, Sub-section B.2. Revised
reference is to correct the referenced publisher information for "Building
Valuation Data" utilized by the Building Department to determine building
plan check and building permit fees. The reference is changed to reflect
the current publisher of the "Building Valuation Data" information. The
"International Conference of Building Officials" no longer exists, as it has
merged with the "International Code Council."
^ (Note: Contractors business license fees are revised consistent with the
basic revised fee of $207.00 as discussed below in Section 11. Business
License Tax and Permits)
SECTION 3. PLANNING FEES:
^ Deleted, New and Revised Fees, Section 3, Planning Fees, Sub-section
A, Filing Fees, and Sub-section B, Environmental Fees. New and

revised fees are proposed to reflect an increase in the basic "deposit" fees
to cover the costs of additional staff review of development applications to
ensure compliance with development standards and the increased
postage costs for public notice mailings. The deleted fees are for
discretionary land use applications that no longer are applicable with the
adoption of Title 11, Zoning, and the new fees are for the new
discretionary land use applications established by Title 11, Zoning.
^ Annual Adjustment, Section, Planning Fees, Sub-sections C and D,
Transportation Facilities & Programs Development Fees and
Transportation Facilities & Programs Development Application Fees,
proposed to be increased by 2.3% in accordance with the provisions of
City Council Resolution No. 4405, adopted August 14, 1995.
SECTION 4. POLICE FEES:
^ Revised Fee, Section 4, Police Fees, Sub-section A.3, False Alarm,
proposed to be increased by $25.00 for all false alarm categories greater
than 2 false alarms, respectively.
^ Revised Fee, Section 4, Police Fees, Sub-section 6.1.a, Animal
License, Dog, proposed to be revised as follows:
^ Revise reference to Municipal Code to reflect current Code reference
of Section 7.05.040.A;
^ Increase annual license fee from $36.00 to $65.00 for an unaltered
animal to reflect charges in surrounding communities and to encourage
that dog owners have their animals altered. The altered fee is not
proposed to change from the current $12.00; and
^ Establish a "late fee" of $25.00 to encourage acquisition of the required
license in the required time frame.
^ Revised Fee, Section 4, Police Fees, Sub-section B.3.a, Quarantine of
Small Animal, Impound Fee, proposed to be increased from $25.00 to
$45.00 to reflect increased personnel and supply costs in caring for
quarantined animals. .
SECTION 5. PUBLIC WORKS FEES:
^ Annual Adjustment, Section 5, Public Works Fees,
Sewer Service Connection Charge - "Buy In",
increased by 4.4% in accordance with the provisions

house staff resources that are utilized.
SECTION 6. RECREATION FEES:
^ Clarification of Applicability of Fees -Youth Resident Groups. Based
on comments of Councilman Miller and City Council direction on August
25 a definition of "Youth Resident Group" has been incorporated to
specify that such groups are defined as a group having 60% of its
membership residing in Seal Beach or having students attending a school
within the Los Alamitos Unified School District system with all persons
being age 18 or under.
^ New Fee, Section 6, Recreation Fees, institute a $100.00 "key deposit'
fee to ensure return of facility keys. The "key deposit" fee would be
returned upon receipt of the facility key and will apply to the following Sub-
sections:
^ A.1; A.3 through A.7; B.1 through B.5; E.5 and E.S.
^ New Fee, Section 6, Recreation Fees, institute a $15.00 per hour "staff
fee" to protect the physical facilities during a rental activity. The "staff fee"
will apply to the following Sub-sections:
^ A.3 through A.9.

accordingly. The Recreation Commission has recommended that the
rental of garden plot fee be established at $0.139 cents per square foot.
^ New Fee, Section 6.G, Special Activity Request Application Fee,
revised to clarify language to indicate how fees for the use of the City Hall
courtyard area and the public beach are determined for use by groups that
constitute a special event (more than 25 persons) utilizing a public facility
for an organized event or activity. Aiso establish a fee for "Booth Space"
at special events sponsored by the Recreation Department of $50.00 for
Non-Profit Groups and $100.00 for For-Profit Groups.
SECTION 7. FILMING FEES & CHARGES:
^ Revised Fee, Section 7, Filming Fees & Charges, Sub-section 4.b,
Lifeguard Personnel, proposed to be increased from $25.00 per person
to $40.00 per person, based on time and one-half plus benefits costs of
lifeguard personnel. (Note: specified business license fees are revised
consistent with the basic revised fee of $207.00 as discussed below)
SECTION 11. BUSINESS LICENSE TAX AND PERMITS:
^ Revised Fee, Section 11, Business License Tax and Permits, annual
adjustment pursuant to Seal Beach Municipal Code Section 5.10.030,
Annual Adjustment, in accordance with the referenced Consumer Price
Index. For all business other than those whose fee is based on a gross
receipts tax, the increase is 3.1 %, from $201.00 to $207.00.
All other fees will remain the same for fiscal year 2008/09 as previously
established by City Council Resolution 5569.
FISCAL IMPACT:
Minimal. The proposed fee revisions are established to capture actual costs
incurred for the provision of city goods, services, and facility use.
RECOMMENDATION:
Conduct public hearing. After closing of the public hearing, adopt Resolution
Number 5783, A Resolution of the City Council of the City of Seal Beach
Establishing Fees and Charges for Goods, Services and Facilities Provided by
the City of Seal Beach and Superseding Resolution Number 5569.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL
BEACH ESTABLISHING FEES AND CHARGES FOR GOODS,
SERVICES AND FACILITIES PROVIDED BY THE CITY OF SEAL
BEACH AND SUPERSEDING INCONSISTENT PROVISIONS OF
RESOLUTION 5569
WHEREAS, the City Council is empowered to impose reasonable fees, rates,
and charges for municipal services; and
WHEREAS, the City Council has determined that the fees, rates, and charges
should cover the costs reasonably borne or a substantial portion of the actual
costs of the goods and services provided by the City; and
WHEREAS, the City Council has determined that fees, rates, and charges for
municipal services do not cover the actual costs under the current fee schedules;
NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Seal
Beach hereby establishes the amount of certain fees, rates and charges, and
restates that amount of other fees, rates, charges and taxes as currently set forth
in Resolution Number 5569, as follows:
SECTION 1. ADMINISTRATIVE FEES
A. Documents
The following fees are established to reimburse the City for costs relative
to filling public requests for copies of non-confidential records; codes,
brochures, booklets and patent materials not marked for general
distribution.

Any person issuing a bank draft, note or check that is returned by a
financial institution due to insufficient funds or a closed account or is

If construction has not commenced, a refund of eighty percent

the request of the permittee. No permit fee will be refunded for any
permit that has expired. No refund will be made of the plan check

E. Main Street Specific Plan Zone In -Lieu Parking Fees
The following per space in-lieu parking fee is hereby established for uses
on commercially zoned parcels located within the Main Street Specific
Plan Zone:
1. A $3,500.00 fee per deficient space for all such uses established on
or after September 1, 1996. Such fee shall be calculated by
multiplying the number of parking spaces required, for the use that
is not provided either on-site or within three hundred feet (300') of
the parcel on which the use is situated, by $3,500.00.
2. An annual fee of $100.00 per deficient space for all such uses
established prior to September 1, 1996 which are currently
operating under an existing land-use entitlement wherein as a
condition of approval the applicant agreed to participate in the
City's in lieu parking program, except for those uses governed by
Section 3 hereinafter. Such annual fee shall be calculated by
multiplying the number of parking spaces required, for the use that
is not provided either on-site or within 300' of the parcel on which
the use is situated, by $100.00.
3. For all such uses established prior to September 1, 1996 pursuant
to a development agreement wherein the applicant agreed to
participate in the City's in lieu parking program, the fee per deficient
space shall be a specified in the applicable development
agreement for the subject property.

4. Miscellaneous Rate Information:

D. Recreation Program Fees
The Recreation and Community Services Director shall establish fees for
the various recreation programs. These fees shall be based on type of

F. Edison Community Garden Fees
To qualify for the use of an Edison Garden one must be able to prove that
he/she is a resident in the City of Seal Beach. If a gardener moves out of

Rental of a garden plot is for one calendar year. Applications must be
returned with payment to the Recreation and Community Services office
prior to January 16"' of each year in order to be renewed. After the
renewal deadline, any remaining plots will be assigned to those on the
waiting list.

SECTION 9. UNSPECIFIED FEES
Whenever fees are charged for services provided by the City and no method for
the calculation is specified through this Resolution, other City Council resolutions,
the Code of the City of Seal Beach, or other state or federal rulings, the fees shall
be the actual cost, including the proportionate part of the salaries, wages or other

compensation of any deputy or employee, material and equipment costs and the
cost of overhead at 32.40% percent of the total.
SECTION 10. FINGERPRINT FEES
The charge for taking fingerprints is $76.00. This fee covers the cost of what the
Department of Justice charges for processing the fingerprints.

*NOTE: Per the City Municipal Code section 5.10.030 the business license tax
amount for all businesses other than those based on gross receipt taxes,

SECTION 14. EFFECTIVE DATE
This Resolution shall be effective upon adoption except for any agreements,
contracts, plans and specifications submitted to the City prior to the date of
adoption.

B. Senior Center Rental Fees
To qualify for use of the Senior Center facility on a regular reservation
basis, a group must have sixty (60%) percent of its membership age 55
years or older. Resident groups shall be those groups having at least
sixty (60%) of their active membership residing within the City of Seal
Beach. Resident groups have preference over non-resident groups. Any
requests for waiver of fees by a group will require City Council approval.
