AGENDA APPROVAL By Motion of the Planning Commission, this is the time to: (a) Notify the public of any changes to the Agenda; (b) Re-arrange the order of the Agenda; and/or (c) Provide an opportunity for any member of the Planning Commission, staff, or public to request an item be removed from the Consent Calendar for separate action. IV. ORAL COMMUNICATIONS At this time, members of the public may address the Planning Commission regarding any items within the subject matter jurisdiction of the Planning Commission, provided that the Planning Commission may undertake no action or discussion unless otherwise authorized by law. v. CONSENT CALENDAR Items on the Consent Calendar are considered to be routine and are enacted by one motion unless prior to enactment, a member of the Planning Commission, staff, or the public requests a specific item be removed from the Consent Calendar for separate action. 1. Minor Plan Review 05-12 140 Welcome Lane Applicant/Owner: Request: Charles Kair / L1NC Housing LLC To construct a new, two-story cabana to replace an existing trailer in the Seal Beach Trailer Park. The overall height will be less than 25 feet and the proposed structure will provide a total of 1162.5 square feet of living space. Recommendation: Approval and adoption of Resolution 05-48. CITY OF SEAL BEACH PLANNING COMMISSION Minutes of October 5,2005 Chairperson Shanks called the regularly scheduled meeting of the Planning Commission to order at 7:30 p.m on Wednesday, October 5,2005. The meeting was held In the City Council Chambers and began with the Salute to the Flag.1 ROLL CALL Present: Chairperson Shanks, Commissioners Deaton, Ladner, and Roberts. Also Present: Deoartment of Develooment Services Lee Whittenberg, Director of Development Services Christy Teague, Senior Planner Alexander Abbe, Assistant City Attorney Absent: Commissioner O'Malley Mr. Whittenberg reported that he had received word from Commissioner O'Malley stating that he was in the hospital and was not certain whether he would be released today. He requested a motion that Commissioner O'Malley be excused. MOTION by Deaton; SECOND by Ladner to excuse Commissioner O'Malley from the Planning Commission meeting of October 5, 2005. MOTION CARRIED: AYES: NOES: ABSENT: 4-0-1 Shanks, Deaton, Ladner, and Roberts None O'Malley Mr. Whittenberg then noted that the City of Seal Beach is conducting a celebration of its 90th birthday this weekend and he invited the public to join in the festivities. AGENDA APPROVAL Chairperson Shanks requested that Item No. 1 be removed from the Consent Calendar for further discussion. CIty of Seal Beach Plannmg CommIssIon Meetmg Minutes of October 5, 2005 Mr. Abbe advised that the adoption of Resolution Nos. 05-48 and 05-51 begins a 10-day calendar appeal period to the City Council. The Commissioner action tonight is final and the appeal period begins tomorrow morning. 1. Approve Planning Commission Meeting Minutes of September 21, 2005. Chairperson Shanks noted that Commissioner Ladner would abstain from voting on this Item, as he was not present at the meeting of September 21,2005. MOTION by Roberts; SECOND by Deaton to approve the Consent Calendar as amended. Consideration of Request for Continuance Conditional Use Permit 14-87 (Revocation) 345 Tenth Street (Watersafe Swim School Staff Report Mr. Whittenberg stated that on September 22, 2005 the City of Seal Beach received a letter jointly signed by legal counsel for both the Diocese of Orange and the Watersafe Swim School requested a further continuance of this matter to a date in January of 2006. Their letter indicates that they are still working together to come to resolution of the matter of parking. He stated that should the Planning Commission (PC) grant this extension, public notice would again be circulated for the agreed upon date for the continued hearing. If no extension is granted, then the PC would proceed with consideration of the matter at the scheduled meeting of October 26, 2005. He then noted that representatives for both parties are present tonight, as well as members of the community. He noted that a public comment period might be appropriate. Public Comment Peter WIlson, representative for the legal counsel for the Diocese of Orange, indicated that he was present tonight to respond to any questions from the PC. He then noted that from the perspective of the church, pending the continued hearing, it is prepared to maintain the 12 parking spaces that are at issue. Page 3 of 6 . 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 i 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 Ii CIty of Seal Beach Plannmg CommIssIon Meetmg Mmutes of October 5, 2005 Eric Pederson, 343 Tenth Street, stated that he lives next door to the swim school and he opposes continuation of this hearing, as he cannot take any more of the noise emanating from the school. He stated that his former job required that he travel 3 weeks out of every month, which helped to minimize his exposure to the noise; however, he has recently changed employers and will now be home every evening, so he is concerned that he will have to be subjected to this noise on a daily basis. He added that he will soon be married and his future wife will be leaving her job as they plan to begin their family, which means that she will also be exposed to the noise throughout the day. He stated that if the continuation is approved he will have to sell his home and move, as he cannot deal with the noise any longer. Mr. Whittenberg clarified that the issue before the PC is the use of parking spaces within the church parking lot by employees and customers of the Watersafe Swim School. He noted that a continuance would not relate to any noise issue. He indicated that the noise issue would have to be addressed as a separate issue from the parking issue. He stated that he would be happy to meet with Mr. Pederson at another time to discuss how to begin to address the noise issue. Commissioner Comments Commissioner Deaton stated that although the current issue is related to parking, she has given a lot of thought to the fact that when Mr. Pederson purchased his home, the swim school was already in existence, and he has continued to own the home as long as he didn't have to live there. She noted that she believes there are mitigation measures that Mr. Pederson can investigate to help minimize his exposure to the noise. She assured Mr. Pederson that the PC has not overlooked his concerns, but she emphasized that there are other options available to him to help address the noise issue. Mr. Pederson added that the lack of parking spaces on the street is still an issue. He noted that were the swim school to attempt to open today it would never gain acceptance, as it has no parking, and is nonconforming in many other ways. He stated that the swim school should never have been allowed in the first place. Chairperson Shanks noted that if the City were to close down every house and business in Old Town that is nonconforming, the town would be half empty. He stated that the swim school was grandfathered, and many other homes purchased in Old Town were also grandfathered. Staff recommended that this item be continued to the PC meeting of February 8, 2005. MOTION by Deaton; SECOND by Roberts to continue the hearing for revocation of Conditional Use Permit 14-87 to the Planning Commission meeting of February 8, 2006. City of Seal Beach Plannmg CommIssIon Meetmg Mmutes of October 5, 2005 ABSENT: O'Malley Mr. Whittenberg stated that notice of the continuance date would be circulated to all residences within 300 feet of the Watersafe Swim School property. PUBLIC HEARINGS None. STAFF CONCERNS Mr. Whittenberg reminded the PC that they would be adjourned until October 26, 2005 rather than October 19, 2005. He also noted that traditionally, due to the holiday season, the PC does not conduct a second meeting during the months of November and December. He requested direction from the PC on these two meeting dates so that Staff might anticipate when new incoming applications will be scheduled for hearing before the PC in November, December, and January. The PC unanimously agreed that the second meetings for November and December should be canceled. COMMISSION CONCERNS Commissioner Roberts inquired about the status of the Rossmoor Center. Mr. Whittenberg reported the Rossmoor representatives did contact the City and have requested to meet with the City Manager and Planning Staff at the end of October. Commissioner Deaton requested a status on the Main Street Specific Plan sign ordinance. Mr. Whittenberg stated that this is scheduled for the meeting of November 9,2005.
