MINUTES OF THE PLANNING COMMISSION MEETING OF DECEMBER 21, 1966
The Seal Beach Planning Commission met in regular session on Wednesday, December
21, 1966, in the Council Chamber at City Hall.

The meeting was called to order by Chairman Boeger at 7:40 P.M.
Minutes of the meeting of December 7, 1966 were approved as presented.
I. Referral from City Council - Herbert L. Benedict, UV-5-66 (Resolution 95)
The City Council referred the action concerning Herbert L. Benedict request
for Use Variance (UV-5-66) back to the Commission for consideration of future
widening of the alley. A letter of addendum to the application was read by
Mr. Stevens, representative of Mr. Benedict. Revised plans were presented.

General discussion followed. The southeasterly side abutting an existing
commercial use has a balcony on the 2nd floor extending to the property line
as well as a portion of the structure towards the rear of the property. In
both cases access is available on the ground level. On the northwesterly side,
a three foot setback is shown in lieu of the residenfia1 requirement of 4 foot
in a limited area. Large inset area compensates for light and air.
The following conditions were established. Sideyards approved as requested
with the condition that the owner must maintain light and air as shown on plans
submitted dated December 20, 1966, and that walkways on gr~und level must he
maintained accessible. The balcony on the northwesterly side towards the
front of the building to be a minimum of two feet from the property line. The
above based on the exceptional condition of a residential use on property zoned
C-I and abutting an existing commercial use. In additioa7.to provide for future
widening of the alley to alleviate traffic problems in the area, this Use
Variance ~ould be conditional upon the dedication of five foot of the property
adjoining the alley to the City of Seal Beach by the property owners.
Mr. Stevens asked if compensation would be made for this dedicated property in
the future if the City found it necessary to compensate other property owners
to acquire the necessary right-of-way. He was advised to put this question
to the City Council and City Attorney.
Mr. Crowley moved to approve the application as revised subject to the
and conditions above and that this resolution supeTsede Resolution No.
Seconded by Mr. Murphy and passed unanimously by the members present.
