HomeMy WebLinkAboutPC Min 1969-02-05 e e MINUTES OF THE PLANNING COMMISSION MEETING OF FEBRUARY 5, 1969 ~ The Seal Beach Planning Commission met in regular session on Wednesday, February 5, 1969, in the Council Chambers at City Hall. Present: Absent: Lanning, Lescher, Peters, Crowley Barton The meeting was called to order by Chairman Crowley at 7:35 P.M. Mr. Barton's absence was excused. The minutes of the meetings held on January 15, 1969 and January 21, 1969 were approved as presented. 1. Sunset Beach Annexation Request A petition signed by 23 individuals from the Sunset Beach area was submitted to the Seal Beach City Council on February 3, 1969, and referred to the .Planning Commission as required by law. A report dated February 5, 1969 from the ~ity Manager was presented to the members of the Commission. The City Manager was present and gave a brief resume of the report. The members of the commission discussed the request and noted that this was in line with the General Plan which had been developed with the cooperation of a Citizen's Committee. The paragraph entitled "Annexation" in the section of the adopted General Plan entitled "Statement of Community Goals" was cited. ~ Mr. Peters moved to report the approval 'of the proposed annexation based on conformity with the General Plan as well as the similarity of. the area to the present beachfront oriented area of the City and recommend to the City Council to institute necessary proceedings. Seconded by Mrs. Lanning and passed unanimously by the members present. Resolution No. 277. 2. Unfinished Business Mr. Peters moved to set a five minutes limit for debates per applicant because of the number of hearings scheduled for the meeting. Seconded by Mrs. Lanning and passed unanimously by the members present. (a) Continued Public Hearing - Paul Miller and Mary Jo Hendrickson, V-23-68 Mr. Peters disqualified himself in this hearing because applicants are his clients. The request is for a five foot encroachment of the second story into the rear yard setback on Lots 30 and 32, Block 11, Bay City Tract (130-132 11th St.). Many similar variances have been granted and all other requirements of the Code have been met. Mr. Lescher moved to approve the variance as submitted. Resolution No. 278 e e (b) Continued Public Hearing - Mr. & Mrs. War~en W. Morton, V-27-68 App1ica~ts presented revised~ans and amended their application to request second story encroachment into the rear yard setback only on Lots'".51,and 53, Block 12, Bay City Tract. Many similar variances have been granted and all other requirements of the Code have been met. Mrs. Lanning moved to approve the request as amended. Seconded by Mr. Peters and passed unanimously by the members present. Resolution No. '279. . (c) Continued Public Hearing - Michael Comminos, UV-1-69' Request is to permit a restaurant with on-sale liquor at 1600 Pacific Coast Highw~y. Mr. Comminos presented more detai1ed'e1evation of the building and interior layout. Similar use had existed on this property for many years. Applicant stated that he primari1y'p1anned a restaurant operation with the on-sale liquor a secondary' use and no entertainment. Mrs. Lanning moved to approve the Use Variance with the conditions that the operation be primarily a restaurant, the apprDva1 be subject to review at the end of one year,t,.a1ibfina1 plans subject to Plan Review, Use Variance issued to applicant only and not transferable, and subject to affirmation by the City Council. Seconded by Mr. Peters and passed unanimously by the members present. Resolution No. 280. (d) Continued Plan Review - Mr. & Mrs. W. R. Greaves, PR-28-68 . Applicant submitted plans for a duplex on Lot 4, Block 14, Bay City Tract, which met all prov.isions of the Code with the exception of the second story encroachment into the rear yard setback. Mr. Peters moved to approve the plans with the exception of the second story encroachment. Upon application and approval of variance for second story encroachment, complete plans will be acceptable. Seconded by Mrs. Lanning and passed unanimously by the members present. Resolution No. 281. 3. Public Hearing - M. A. Sharon, V-2-69 M. A. Sharon, 142 10th St., Apt. A, Seal Beach, requ~sted a variance to permit second story encroachment into the rear yard setback on Lot 29, Block 11, Bay City Tract (129 12th St.). Subsequent plans showed that applicant actually was requesting variance for two identical buildings on adjacent lots. Legal notices did not include second lot (Lot 31). Mr. Peters moved to grant the variance for Lot 29 as submitted. Seconded by Mr. Lescher. After further discussion regarding the legal notices and affect upon the neighborhood, the motion and second were withdrawn. Hearing continued until the next regular meeting and applicant advised to amend him application so revised legal notices can be mailed. 4. Public Hearing - Henry M. Espoy, V-3-69 . Henry M. Espoy, 1629 Seal Way, Seal Beach, requested a variance to construct two apartment buildings on Lots 44, 46 and 48, Block 11, Bay Ci~y Tract. Both buildings would encroach into the rear yard setback on the upper story. Also requested was a 10% exterior side yard in lieu of the required 15%. It was noted that an arbitrary property line was shown which did not coincide with 10t.1ines of record. One letter of protest was received against granting a privilege. Mr. Strouse of 11th St. protested further density in the area creating. Others in the audience felt the proposed construction would be an improvement in the neighborhood. e e . Mr. Espoy was advised of the need for a lot split to be approved. By setting the new lot line at 28 foot; the minimum exterior sideyard could be met and no variance would be needed. Mr. Peters moved to approve the Variance permitting the second story to encroach four feet into the rear yard setback. A four foot exterior side yard acceptable subject to a lot split being approved and recorded by parcel map. Seconded by Mrs. Lanning and passed unanimously by the members present. Resolution No. 282.' Mr. Peters moved to recommend to the City Council approval of , a lot split of twenty eight feet. Seconded by Mrs. Lanning and passed unanimously by the 'members present. Resolution No. 283. Chairman Crowley declared a recess at 9:30 P.M. Meeting reconvened at 9:47 P.M. 5. Public Hearing - Ted Chuck, V-4-69 Ted Chuck, 21001 Barbados Circle, Huntington Beach, requested a variance to permit the second story to encroach into the rear yard setback on Lot 15, Block'l06, Bay City T~act. Similar varian~e have been granted. Mrs. Lanning moved to approve the Variance as submitted. Seconded by Mr. Lescher and passed unanimously by the members present. Resolution No. 284. 6. Public Hearing - William A. Money, V-S-69 ... Willaim A. Money, 5415 Daggett St., Long Beach, requested a variance to permit the second story to encroach into the rear yard setback on Lot 29, Block 6, Bay City Tract. This is an existing structure with a proposed new two story apartment being added. Discussion held on possibility of ease of.conversion to additional unit by location of entry. Mr. Peters moved to approve the Variance subject to the stairway being wholly enclosed within the unit. Outside 'entry to be relocated. Seconded by Mr. Lescher and passed unanimously by the members present. Resolution No. 285. 7. Public Hearing - Glen W. Morris, V-6-69 Glen W. Morris, 1319 Seal Way, requested a Variance for an addition on Lot 10, Block G, Tract No. 1009, to permit 6 units in lieu of allo~able 3.75; exterior stairways to encroach into the sideyards to property lines,; third floor to encroach 7 feet into the required rear setback; and, three' substandard off-street parking spaces. Six units would be a great departure from past allowances. Stairs to the property line would grant a privilege. Rear yard encroachment would overhang ultimate right-of-way line. Mrs. Lanning moved to deny the variance because lot area determines number of allowable units, not number of parking spaces on the property. Mr. Lescher seconded the motion and it passed unanimously by the members present. Resolution No. 286. 8. Public Hearing - Ron Jessner, V-7-69 . Ron Jessner, 253 17th St., Seal Beach, requests a Variance for Lot 22 and Nly 23' of Lot 20, Block 211, Bay View Tract to permit construction of apartment units encroaching five feet into the rear yard setback and a 5 foot exterior sideyard in lieu of required six foot. Mr. Robert Evans protested the sideyard variance concerned with vision clearance for school children in the immediate area. Applicant stated the one substandard lot created the need for the one foot variance to be able to build. Mr. Evans displayed chart diagraming reduction in vision for motorists. e e . Mr. Peters moved to grant the variance for the second story encroachment into the rear yard, and to grant a variance allowing-. a "four foot interior side yard. Applicant must maintain minimum required exterior sideyard. Seconded by Mr. Lescher and passed unanimously by the members present. Resolution No. 287. 9. Public Hearing - Willa~d W. Cummings, V-8-69 Willard W. Cummings, 1947 Manhattan Ave., Hermosa Beach, requested a".'Vatiance to permit the second story to encroach into the rear yard setback on Lot 54, Block 12, Bay City Tract. Many similar variances have been granted. Mr. Lescher moved to approve the Variance as submitted. Seconded by Mrs. Lanning and passed unanimously by the members present. Resolution No. 288. 10. Plan Review - Robert Kreuger, PR-1-69 Mr. Kreuger, 1210 Electric Ave., Seal Beach, presented plans for approval to construct a three unit building attached to an existing one unit structure. Plans meet all Code requirements'- Mrs. Lanning moved to approve the plans as presented. Seconded by Mr. Lescher and passed unanimously by the members present. Resolution No. 289. 11. Plan Review - Frank J. Curtis, PR-2-69 Frank Curtis, 1700 Bayou Way, Seal Beach, presented plans for construction of three additional units on Lots 37 and 39, Block 9, Bay City Tract. Applicant stated he had revised plans increasing the area of the unit. Plan Review continued until next regular meeting to allow applicant to furnish the revised plans. . 12. Plan Review - Lois Goran, PR-3-69 Lois and Roy Goran, 1006 N. Sunset Canyon Dr., Burbank, presented plans to construct an additional front unit on Lot 8, Block 4, Bay City Tract. Plans meet all Code requirements. Mrs. Lanning moved to approve the plans as submitted. Seconded by ~r. Peters and passed unanimously by the members present. Resolution No. 290. . 13. Discussion Commissioners discussed a proposed amandment to Section 1822 of the Zoning Code permitting second story to extend to four feet of the ultimate right-of-way line. Chairman directed the Secretary to set a public hearing at the first convenient' mee'tillg.
