HomeMy WebLinkAboutPC Min 1980-12-17 . e e MINUTES OF THE PLANNING COMMISSION MEETING OF DECEMBER 17 1980 THE PLANNING COMMISSION MET IN REGULAR SESSION ON WEDNESDAY DECEMBER 17 1980 IN THE COUNCIL CHAMBERS OF THE CITY ADMINIS TRATION BUILDING 211 8TH STREET THE MEETING WAS CALLED TO ORDER AT 7 30 P M BY CHAIRMAN COVINGTON THE PLEDGE TO THE FLAG WAS LED BY VICE CHAIRMAN GILKERSON PRESENT Knapp Rlpperdan Covlngton Gllkerson EXCUSED ABSENCE Lelbert The mlnutes of the October 1 1980 meetlng were approved as submltted The Secretary lntroduced Denls Thomas the Actlng Clty Manager to the members of the Plannlng Commlslon 1 PUBLIC HEARING A Seal Beach Pler CP 14 80 Secretary outllned the hlstory of the pler operatlon as lt related to the request for COln operated amusement machlnes and llve entertalnment In the Pler Restaurant Amusement Machlnes were placed In the Pler Restaurant wlthout Condltlonal Use Permlt approval and llve entertalnment (gultarlst) began plaYlng durlng afternoons and evenlngs In the restaurant In addltlon a loud speaker was lnstalled on the restaurant roof so mUS1C could be heard outslde the restaurant Based upon complalnts about both the ampllfled mUS1C and COln operated amusement machlnes the Clty notlfled the pler operator to cease the llve entertalnment and dlsconnect the machlnes untll all Clty approvals are recelved The operator dlscontlnued the two uses and made appllcatlon for Clty approvals PubllC Hearlng opened Hal Halldln 635 Sllver Shoals represented Frank Hale Pler Operator Mr Halldln stated that the Pler Restaurant has offered llve entertalnment Slnce 1971 and there has been only a chanoe In entertalners Complalnts to the Clty were dlrected at the exterlor loud speaker WhlCh has been removed The Clty s ordlnance on llve entertalnment became effectlve after llve entertalnment was establlshed on the pler The Pler Restaurant operatlon beneflts from llve entertalnment and there lS local support for entertalnment as eVldenced by a 600 + name petltlon presented to the Plannlng Commlsslon to be made part of the record Gllkerson asked about the presence of llve entertalnment and amusement machlnes for two consecutlve Sundays after the Clty s letter was sent Mr Halldln had no lnformatlon on why the actlvltles contlnued Gllkerson also asked about servlng Wlne after the restaurant closed Secretary noted that there are no Clty restrlctlons on servlng Wlne after the restaurant closes Frank Hale Seal Beach Pler Operator requested that the appllcatlon be amended to read llve entertalnment from 1 P M to sunset as hours of operatlon After dlScusslon the Plannlng Commlsslon lmposed no obJectlons to the proposed change In hours e Mlnutes of Plannlng Commlsslon December 17 1980 Page 2 Jlm Davls 6341 Glorla Drlve Huntlngton Beach read a statement lnto the record favorlng 11ve entertalnment on the pler John McMl11an Long Beach spoke In favor of the appllcatlon Dennls Stl11well Long Beach spoke In favor of the appllcatlon and lntroduced hlmself as the rellef s1nger for the pler Lee Cook Whlttler spoke In favor of both 11ve entertalnment and Juke box No one spoke In Opposltlon PubllC Hearlng closed The Plannlng Commlsslon dlscussed the varlOUS optlons on the appllcatlon The Commlsslon opposed COln operated amusement machlnes wlth the exceptlon of the Juke box Based upon the lnformatlon In the staff report the Commlsslon favored 11ve entertalnment wlth the change In hours of operatlon to 1 p m to sunset e Rlpperdan moved to recommend to Clty Councl1 approval of 11ve entertalnment hours 1 p m to sunset and to permlt the Juke box subJect to A The hours of operatlon be 11mlted to those hours lmposed by the Commlsslon 1 p m to sunset B The sounds produced by thlS actlvlty are not to be ampllfled nor played at a volume WhlCh could be heard outslde the restaurant facl1lty and C The lessee obtaln and malntaln a current and valld entertalnment 11cense Motlon seconded by Covlngton and unanlmously approved MINUTE ORDER ACTION Secretary announced that a letter would be prepared and forwarded to the pler operator WhlCh wl11 temporarl1y permlt 11ve entertalnment as approved by the Commlsslon untl1 a flnal declslon by Clty Councl1 on January 12 1981 2 ORAL COMMUNICATIONS e A Secretary announced the February 11 13 1981 League of Callfornla Cltles Plannlng Commlssloners Instltute In Sacramento The Commlssloners present wl11 not be able to attend however lf Ms Lelbert 1S able to attend the Commlsslon supports her attendance B The Commlsslon dlscussed the CUP procedure for handllng COln operated amusement machlnes versus the posslbl1lty of an outrlght ban of the use They concluded that the CUP 1S the best method for processlng the machlnes e Minutes of Planning Commisslon December 17, 1980 Page 3 3. WRITTEN COMMUNICATIONS A. Street Vendors Secretary presented a report on "street vendors. II City regulations do not permit this type of activity, but rather require commercial activities to be located in permanent facilities in the proper zone. Due to even-handed enforcement of these regulations, seasonal sales, such as Christmas Tree Lots, are not permitted. The City Council has directed staff to explore methods to permit Christmas Tree Lots while controlling street vending. The Commission discussed various methods that might be explored to permit the lots. Staff will contact other cities and recommend a procedure to the Planning Commission that will permit Christmas Tree Lo ts . 4. REPORT FROM SECRETARY A. DWP Si te e Denis Thomas reported that the City Council requested a 45-day extension (end of January, 1981) from DWP in order for the City Council to study their response to the offer to buy the site. B. State Lands Parcel Covington requested a copy of the lease between the State and developer. Staff will refer the question to the City attorney to determine if the lease is a public document at this time. Staff has been working with the developer to obtain a project acceptable to the Ci ty. C. Hellman Land Staff has been working wlth the developers on the preparatlon of: Fiscal Impact Statement, Draft EIR, Specific Plan and Area Plans. Formal application is 45-90 days from submission. D. Mobile Home Legislation Covington asked about recent legislation dealing with placing mobile homes on single lots. Secretary noted that such legislation is pending but requires further study in order to determine its impact on the City.
