ROLL CALL Present: Cha~rman Jessner Comm~ss~oners Cov~ngton, Goldenberg, Hunt, Perr~n Also Present: John Baucke, D~rector of Development Serv~ces APPROVAL OF MINUTES Cov~ngton moved, second by Perr~n, to approve the m~nutes of the September 19, 1984 regular meet~ng. AYES: NOES: ABSTAIN: Cov~ngton, Hunt, Perr~n None Goldenberg Mot~on Carr~ed PUBLIC HEARING - VARIANCE 3-84 - 1105 & 1107 OCEAN AVENUE - SZCERBAN The Comm~ss~on Secretary, Mr. Baucke, ~nd~cated appl~cant had subm~tted rev~sed plans d~scussed at last Comm~ss~on meet~ng. Appl~cant requests prov~s~on for tandem park~ng ~n conJunct~on w~th major add~t~ons to two legal non-conform~ng duplexes. The rev~sed plans ~nclude an 8-car garage w~th four standard spaces ~n the m~ddle, bounded on each s~de by two standard spaces ~n tandem. Above the garage ~s proposed to be a second story major add~t~on to each duplex to be accessed by an exter~or sta~r. Staff recommendat~on was to approve Var~ance 3-84 w~th: 1) the exter~or sta~rs to the second floor deleted, 2) work~ng draw~ngs to be mod~f~ed to show a 20 ft. ~nter~or length d~mens~on for standard garage spaces, and 3) that a deed restr~ct~on be placed on t~tles of the two propert~es wh~ch state that these two duplex propert~es are developed as a un~t and shall not be transferred, ass~gned or conveyance made ~n any separate manner. Cha~rman Jessner declared publ~c hear~ng opened. Comm~ss~on Perr~n ~nd~cated he understood concern over the exter~or sta~rwell be~ng used ~n the future as an ~llegal un~t, but asked about the poss~bl~l~ty of an annual ~nspect~on by staff wh~ch would allow sta~rwell to rema~n. Staff ~nd~cated that redes~gn~ng the sta~rwell was more appropr~ate, as an annual ~nspect~on would create more workload, w~th the poss~b~l~ty of ~nspect~on not occurr~ng. Mr. Charles Antos of 316 10th Street, appl~cant's agent, ~nd~cated he had read staff report and ~nd~cated that the work~ng draw~ngs would reflect corrected depth of garage, that the appl~cant was ~n full agreement w~th deed restr~ct~on. W~th regard to delet~ng exter~or sta~rwell, appl~cant would prefer annual ~nspect~on to occur, but would remove sta~rwell ~f Plann~ng Comm~ss~on des~red. . . . Staff also 1nd1cated that deed restr1ct10n would be placed on the t1tle pr10r to bU1ld1ng perm1t be1ng 1ssued, and that C1ty attorney would be 1nvolved 1n draft1ng exact word1ng. There were no other commun1cat10ns for or aga1nst the matter; Cha1rman Jessner declared the pub11c hear1ng closed. Perr1n moved to approve, second by Cov1ngton, Resolut10n #1318 w1th staff's three cond1t10ns, "A RESOLUTION OF THE SEAL BEACH PLANNING COMMISSION APPROVING VARIANCE APPLICATION 3- 84, A REQUEST FOR USE OF TANDEM PARKING IN CONJUNCTION WITH A MAJOR ADDITION TO TWO LEGAL NON-CONFORMING DUPLEXES (1105 & 1107 SEAL WAY)." AYES: NOES: Cov1ngton, Goldenberg, Hunt, Jessner, Perr1n None Mot10n Carr1ed Resolut10n #1337 - Den1al of 7-11 Request) Perr1n moved to adopt, second by Cov1ngton, Resolut10n No. 1337, "A RESOLUTION OF THE SEAL BEACH PLANNING COMMISSION DENYING CONDITIONAL USE PERMIT 14- 84 FOR OFF-SALE BEER and WINE AT 1200 PACIFIC COAST HIGHWAY." REPORT FROM SECRETARY Staff 1nd1cated that T1ny Naylor's had subm1tted plans for a complete remodel, w1th poss1ble l1ve enterta1nment, for the1r s1te 1n Safeway Center. He further 1nd1cated the restaurant had been before the Comm1ss10n for alcohol license recently and had never ment10ned poss1b1l1ty of enlarg1ng, and had stated that restaurant was encourag1ng fam1ly type bus1ness, not bar and enterta1nment type of c11entele. After much d1scuss10n by Comm1ss10ners, 1t was determ1ned that restaurant was be1ng used for a d1fferent purpose that what was or1g1nally stated when Comm1ss10n granted alcohol l1cense, therefore, Comm1ss10n should recons1der the matter. Mr. Baucke presented plans for State Lands parcel that had recently been rece1ved. ADJOURNMENT It was the order of the Cha1r, w1th consent of the Comm1ss10n, to adJourn the meet1ng at 8:25 p.m.
