PLANNING COMMISSION MEETING OF JANUARY 16, 1985 The Seal Beach Plann1ng Comm1ss10n met 1n regular seSS10n at 7:35 p.m. w1th Cha1rman Jessner call1ng the meet1ng to order. Comm1ss10ner R1pperdan lead the Salute to the Flag. ROLL CALL Present: Cha1rman Jessner Comm1ss10ners Hunt, Perr1n, R1pperdan Comm1ss10ner Cov1ngton Absent: Also Present: John Baucke, D1rector of Development Serv1ces Dana Ogdon, Adm1n1strat1ve A1de The m1nutes of January 2, 1985 regular Plann1ng Comm1ss10n meet1ng w1ll be presented at the February 6th meet1ng for the Comm1ss10n's cons1derat10n. . PUBLIC HEARING - CUP 19-84 - CUP 22-84, AND VARIANCE 15-84 - 143 ~la1n Street - Old Town W1ne & Gourmet Mr. Baucke, the Comm1ss10n Secretary, stated the app11cant was request1ng a take-out de11 restaurant w1th on-sale beer and W1ne to be consumed on the prem1ses, wh1le prov1d1ng less than the requ1red park1ng. The staff report deta1led 1n full the park1ng s1tuat10n for the Old Town W1ne & Gourmet. It was brought out that the then C1ty Manager Denn1s Courtemarche had reserved 1n wr1t1ng three park1ng spaces 1n the 8th Street Mun1c1pal Park1ng Lot for the store; however, those spaces had not been contracted for as of yet. Mr. Baucke p01nted out that Old Town W1ne & Gourmet and John's Food K1ng share 19 park1ng spaces adJacent to Old Town W1ne & Gourmet. He further noted that w1th the estab11shment of the de11, an add1t10nal 3 park1ng spaces would be requ1red and as 1t was not phys1cally poss1ble to construct 3 more spaces, a var1ance would be necessary. Recommendat10n by staff was to approve CUP 19-84, for on-sale beer and W1ne l1cense, to approve CUP 22-84 for a take-out de11 and to approve Var1ance 15-84 to dev1ate from requ1red park1ng by 3 spaces, all of these perm1ts subJect to cond1t10ns as noted 1n the staff report. Cha1rman Jessner declared the pub11c hear1ng open to cons1der th1s matter. Charles Antos, 316 10th Street, agent for the app11cant, deta1led the h1story of Old Town W1ne & Gourmet. He 1nd1cated that John's Food K1ng, the park1ng lot and Old Town W1ne & Gourmet were all owned by the same property owners. He stated that when the store opened, 1t was or1g1nally called Old Town W1ne & sp1r1ts w1th a cook1ng school 1n the back. At that t1me, the C1ty determ1ned a CUP for packaged l1quor sales was necessary. The matter wh1ch led to the determ1nat10n that a CUP was necessary was the request by 7-11 for l1quor sales. At that t1me, a regular general l1quor l1cense for packaged l1quor was obta1ned by Old Town W1ne & Sp1r1ts. Subsequently, the OTW&S . . Plann1ng Comm1ss1on Meet1ng of 1/16/85 Page 2 . dec1ded to spec1a11ze 1n sale of beer and W1ne only, and the cook1ng school owners dec1ded to w1thdraw the1r operat1on. OTW&S then requested a beer and W1ne tast1ng school be held 1n the back under the ausp1ces of Orange Coast commun1ty college. At th1s t1me, OTW&S app11ed for a CUP. The Plann1ng D1rector at that t1me felt the de11 should be class1f1ed as a restaurant due to the tables, and that a C1ty bus1Jless l1cense would be necessary. The Plann1ng D1rector at that t1me allowed the OTW&S w1th grandfathered park1ng r1ghts. All perm1ts were approved and Old Town W1ne & Gourmet (OTW&G) was sent a letter by th~eC1ty Mgr. approv1ng 3 park1ng spaces 1n the 8th St. park1ng lot. Mr. Antos 1nd1cated the app11cant w1shes to operate a take- out de11, w1th the ab1l1ty to serve W1ne & beer on the prem1ses, and to sell packaged W1ne and beer along w1th hold1ng beer and W1ne tast1ng classes 1n conJunct1on w1th a local college. Steve Dobb1ns, manager of the Old Town W1ne & Gourmet stated that the hours of operat1on are 10:00 a.m. to 8:00 p.m., Monday thru Thursday, and 10:00 a.m. to 9:00 on Fr1day thru Saturday and 11:00 a.m. to 8:00 on Sunday. The W1ne tast1ng classes are usually two n1ghts per week, 7:00 p.m. to 9:30 p.m., occas1onally break1ng up later (10:15 p.m.) ihere 1S an occas1onal Saturday W1ne tast1ng class. Mr. Perr1n asked the app11cant 1f the hours of operat1on were placed 1n the resolut1on, and chang1ng the Fr1day thru Saturday clos1ng to 10:00 p.m., would the app11cant be sat1sf1edj to wh1ch the app11cant responded 1n the aff1rmat1ve. As no other persons spoke 1n favor, nor 1n Oppos1t1on, Cha1rman Jessner declared the pub11c hear1ng closed. Mr. R1pperdan moved to approve Resolut1on #1355, A RESOLUTION OF THE SEAL BEACH PLANNING COMMISSION A~PROVING CONDITIONAL USE PERMIT CUP 19-84 FOR ON-SALE BEER AND WINE LICENSE FOR THE OLD TOWN WINE AND GOURNET AT 143 MAIN STREET, w1th the change 1n operat1ng hours to reflect 10:00 p.m. clos1ng hours for Fr1day thru Saturdayj Mr. Perr1n seconds. AYES: NOES: ABSENT: Hunt, Jessner, Perr1n, R1pperdan None Cov1ngton Mot1on Carr1ed After clar1f1cat1on to the Comm1ss1on regard1ng locat1on of dumpster and 10% landscap1ng requ1rement, Mr. Perr1Jl moved, second by R1pperdan, to approve Resolut1on #1356, A RESOLUTION OF THE SEAL BEACH PLANNING COMMISSION APPROVING CONDITIONAL USE PERMIT 22-84 FOR A TAKE-OUT RESTAURANT (DELI). AYES: NOES: ABSENT: Hunt, Jessner, Perr1n, R1pperdan None Cov1ngton Mot1on Carr1ed . It was the concensus of the Comm1ss1on to change the word "enclosure" to "conta1ner" 1n cond1t1on #4-oLResGlut:tQn #1357. Mr. R1pperdan noted that a contract for park1ng pr1v1leges would take place between the C1ty and the app11cant, subject to replacement by an "1n-11eu" . . .
