Mr. Ogdon lndlcated that thlS ltem was a resubmlttal of a plan that was attached to a preVlOUS appllcatlon for a Varlance that was before the Commlsslon on May 15, 1985. The appllcant has resubmltted plans whlch reflect the Commlsslon's comments on slde yard setbacks. Staff recommends approval of Varlance 5-85 wlth the condltlons noted In the staff report. . Mr. Baucke outllned the facts relatlng to thlS partlcular property. He also made speclal reference to the Task Force Recommendatlon on the parklng lssue and dlscussed staff's POllCY on the parklng requlrements In the Maln Street area. Mr. Baucke also presented to the Commlsslon the speclflcs of the restaurant (Dell) operatlon and stated that Stacey Plcascla, Chlef of Pollce, had researched eXlstlng records and dld not have any reservatlons regardlng the approval of thlS Condltlonal Use Permlt by the Plannlng Commlsslon. He also outllned the varlOUS code sectlons pertalnlng to these lssues. Staff recommended approval of Condltlonal Use Permlt 6- 85 wlth the condltlons noted In thestaff report.In addltlon, lt was staff's recommendatlon to approve Varlance 9-85 wlth the condltlons noted In the staff report. Chalrman Jessner declares the publlC hearlng open. Domlnlc Zamplno, 223 Maln St., owner of N1Ck's Dell and the appllcant, commented on Condltlon #3 of staff's recommendatlons for approval referenclng that all alcohollc beverages sold be served by hand over the counter. Mr. Zamplno lndlcated that the Alcohol Beverage Control had been to hlS restaurant three tlmes, and they felt there was no problem In the way that the alcohollc beverages were served. He felt that the ABC was the expert on thlS and requested Condltlon #3 be deleted. He also made reference to Condltlon #8 In that the record wlll show for ltself, and staff wlll reVlew thlS CUP after one year. Chuck Burroughs, owner of Old Town Gardens, stated that N1Ck Zamplno lS one of hlS tenants and that hlS Dell lS one of the cleanest restaurants In Seal Beach. He spoke In favor of thlS proJect and saw no problem wlth the parklng prlmarlly due to the fact that thlS lS a "take-out" restaurant. A great maJorlty of the customers are local merchants. Steve Frledman, 142 Maln St., spoke In favor of thlS proJect and felt that Mr. Zamplno deserved to have thlS permlt granted. Bruce Stark, 204 Ocean Ave., stated that he was In favor of thlS proJect. He lndlcated that he has heard about the parklng problem several tlmes and that other restaurants In town seem to have exceptlons made for them. He felt that the people In Seal Beach deserved equallty and all buslnesses should be treated allke. Mr. Stark also lndlcated that he was unable to make changes to hlS apartment due to the parklng requlrements. Mr. Baucke explalned that each buslness lS requlred to slgn a contract requlrlng a $100.00 annual fee, and slgn an agreement to partlclpate In any In-lleu . . . Mr. Stark lnqulred as to whether or not he could take a slmllar contrdct out wlth the Clty In order to change hlS property and recelve 2 parklng spaces In the Bank of Amerlca parklng lot. Mr. Baucke explalned that no such contract was offered and we were dlscusslng a buslness use here vs. a resldentlal use. Rlchard Elvldge, 1009t Seal Way, felt that parklng lS a real problem In thlS Clty and suggested that property behlnd N1Ck's Dell In the alley be torn down to provlde the requlred parklng. Charles Antos, 316 10th St., spoke In reference to the parklng lssue and Hennessey's Tavern. There was a condltlon added to the approval of Hennessey's Varlance statlng that a slgn be posted on the ne1ghbor1ng property: "For the exclus1ve use of Hennessey's". Mr. Antos stated that there was no slgn posted yet the tavern was open and operat1ng and quest10ned the ab1l1ty of thlS bus1ness to operate w1thout a Cert1f1cate of Occupancy. Mr. Baucke stated that a temporary cert1f1cate had been 1ssued and a permanent cert1f1cate would be 1ssued once all cond1t1ons of the var1ance had been complled w1th. Mr. Antos also spoke 1n reference to 1n-l1eu park1ng and concluded that he saw no reason not to approve th1S proJect. As no other members of the aud1ence spoke 1n favor of nor 1n Oppos1t1on to thlS 1ssue, Cha1rman Jessner closed the publ1c hear1ng. Mr. Hunt moved to delete Cond1t1on #3, "That all alcohol1c beverages sold be served by hand over the counter.", as recommended by staff for CUP 6-85. Cha1rman Jessner requested clar1f1cat1on from staff as to the reason for Cond1t1on #3. Mr. Baucke 1nd1cated that the pr1mary reason was due to superV1S1on of the alcohol. It was Mr. Hunt's op1n1on that Mr. Zamp1no would handle th1S matter well and 1t would be 1n everyone's best 1nterest to let h1m deal w1th th1S matter rather than have the C1ty make regulat1ons. Mr. Hunt moved to approve Cond1t1onal Use Perm1t 6-85 w1th the delet10n of Cond1t1on #3, "That all alcohol1c beverages sold be served by hand over the counter.". Mr. Ogdon outllned the facts relatlng to the subJect property for the Commlsslon's conslderatlon. It was brought to the attentlon of the Commlsslon that the appllcant, West Beach Llquor, currently dld not have a valld Clty Buslness Llcense whlch was due to the fact that they must obtaln a Condltonal Use Permlt approval prlor to the lssuance of a Clty Buslness Llcense. Staff recommended approval of CUP 10-85 wlth the condltlons noted In the staff report. Chalrman Jessner declares the publlC hearlng open. Mr. Baucke expla1ned the d1fferences 1n these 2 matters and stated that th1S appl1cat10n was not a proposal to phys1cally expand the res1dentlal use of the property, but merely a request to add garages. Such an appl1cat10n would requ1re only a consent calendar reV1ew under proposed Zon1ng Text Amendment 2-84. Nancy Kredell, 1615 Seal Way, requested clar1f1cat10n from staff 1n reference to tandem park1ng and the C1ty'S POllCY on th1S lssue. He presented a render1ng to the Comm1ss10n and aud1ence for the1r cons1derat10n of the proposed remodel. Mr. Kl1ne 1nd1cated that the appl1cant w1ll prov1de 1 2/3 park1ng Plann1ng Comm1ss1on Meet1ng of June 19, 1985 Page 6 . spaces per un1t Wh1Ch 1S more than requ1red by code. He stated that th1S proposal w1ll upgrade the eX1st1ng hotel and be an 1mprovement to the commun1ty. Mr. Kl1ne was 1n agreement w1th the cond1t10ns recommended by staff w1th the except10n of Cond1t10n #6. He requested that th1S cond1t10n be re-worded by staff.
