Commlssloner Rlpperdan led the Salute to the Flag. ROLL CALL Present: Chalrman Jessner Commlssloners: Covlngton, Hunt, Perrln, Rlpperdan Absent: None Also Present: John M. Baucke, Dlrector of Development Servlces REPORT FROM SECRETARY Mr. Baucke, Commlsslon Secretary, lndlcated that at the next Plannlng Commlsslon meetlng of August 21, 1985, nomlnatlons would be taken for Chalrman and Vlce-Chalrman to the Plannlng Commlsslon. These nomlnatlons wlll reflect the annual re-organlzatlon of the Plannlng Commlsslon. Mr. Baucke requested that each member of the Commlsslon be prepared to vote on thlS matter at the next meetlng. CONSENT CALENDAR There was one ltem on the consent calendar for the Commlsslon's conslderatlon: 1) The mlnutes of the August 7, 1985 Plannlng Commlsslon meetlng. SCHEDULED MATTERS Mr. Baucke presented a background of the scheduled matter ltem whlch was contlnued from the August 7, 1985 meetlng. ThlS ltem was Clty Councll's referral to the Plannlng Commlsslon for report pursuant to Sectlon 28- 2613 on Zonlng Text Amendment 4-85 - Speclflc Plan Procedures and Regulatlon Zone. Mr. Baucke referenced a memorandum dated July 15, 1985 notlng the Councll's proposed actlons and staff's comments and concerns. A brlef overVlew of the last Plannlng Commlsslon meetlng was presented for the beneflt of the Commlssloners who were not present at that meetlng. It was noted that there was a concensus of the Commlsslon concurrlng wlth Clty Councll's proposed modlflcatlons, Item #1 and #2, and that after extenslve dlScusslon, there was no concurrence on Item #3 and #4. Mr. Baucke then made hlmself avallable to the Commlsslon for any questlons. Chalrman Jessner requested clarlflcatlon from staff as to the handout recelved by Frank Cllft. Mr. Baucke lndlcated that thlS ltem was re-wordlng recommended by Mr. Cllft for the paragraph In Item #4 referenclng the memorandum dated July 15, 1985. Commlssloner Hunt asked lf staff's recommendatlon was the same for re-wordlng of Item #4 as lt was at the last meetlng. Mr. Baucke lndlcated that thlS was stlll staff's recommendatlon. Mr. Baucke and Commlssloner Covlngton dlscussed the past actlons of staff In reference to thlS matter. Mr. Covlngton was concerned that there seemed to be no base zone element In thlS concept and that thlS concept has been . Mr. Cov1ngton felt that th1S part1cular port1on of the ord1nance should be what the commun1ty feels 1S appropr1ate and cons1stent w1th local commun1ty standards. Mr. Baucke 1nd1cated that on a funct10nal bas1s, there are no real d1fferences. Staff's pos1t1on on th1S 1ssue was that th1S proposal would make the commun1ty aware of where Spec1f1c Plan Zones were g01ng to be used. It was Mr. Cov1ngton's op1n1on that the recommendat1on rece1ved by Mr. Cl1ft would be the best approach to take as 1t would prov1de for a dual publ1c hear1ng process and st1ll prov1de l1m1tat1ons w1thout spec1fY1ng a spec1f1c he1ght. Mr. R1pperdan agreed w1th Mr. Cl1ft's recommendat1on but suggested the delet10n of the f1rst port1on of the paragraph Wh1Ch would st1ll make the word1ng more spec1f1c, yet not too spec1f1c as 1n the 39 foot l1m1tat1on. Mr. Cov1ngton stated that th1S proposal was a br1dge between what 1S recommended by C1ty Counc1l and what 1S recommended by staff. It was Mr. Cov1ngton's recommendat1on to state the l1m1tat1on of 3 stor1es, and th1S was d1scussed between the Comm1ss1on members for the1r 1mput. Cha1rman Jessner requested a def1nlt1on of the word "story". Mr. Baucke 1nd1cated that there was no spec1f1c he1ght def1n1t1on for the word "story". Mr. R1pperdan recommended that ne1ther the 39 ft. or 3 stor1es be 1ncluded. Mr. Hunt concurred w1th Mr. R1pperdan. He felt that the opt1on should be left open. It was Comm1ss1oner Perr1n's op1n1on that the future could not be pred1cted and therefore, a he1ght l1m1tat1on should be spec1f1ed 1n the ord1nance. Mr. Cov1ngton felt that Mr. Cl1ft's proposed re-word1ng would allow a great deal of fleX1b1l1ty wh1le st1ll reta1n1ng for the future commun1ty standards. What staff proposed 1S too subJect1ve. - Cha1rman Jessner requested publ1c 1mput from the aud1ence. Robert Cook, 441 Central Ave., Seal Beach, was concerned that staff's fleX1b1l1ty was 1ncreas1ng Wh1Ch would enable them to work w1th developer's ult1mately result1ng 1n res1dent1al 1nsecur1ty 1n our commun1ty. He felt that the C1ty owed the property owners and the developers some def1n1t1ve gU1del1nes. W1thout gU1del1nes, a developer could ut1l1ze consultants to Just1fy the1r proJects to be approved. Mr. Cook felt that Mr. Cl1ft's proposed mod1f1cat1ons should be rev1ewed on a cause and effect bas1s and stated that he d1d not f1nd th1S proposal to be a good br1dge between C1ty Counc1l and staff's recommendat1ons. Mr. Baucke referenced Mr. Cook's statement regard1ng developer's proposals before the Comm1ss1on. He noted that th1S Spec1f1c Plan ord1nance spec1f1cally precludes a developer from 1n1t1at1ng a Spec1f1c Plan. The only bod1es that can 1n1t1ate a Spec1f1c Plan process are the C1ty Counc1l, Plann1ng Comm1ss1on, staff and the Redevelopment Agency. Mr. Cook and Mr. Baucke d1scussed the current Spec1f1c Plan adopted. Barbara Roundtree, 13300 TW1n H1lls, 46H, Seal Beach, spoke 1n reference to the Cal1forn1a Coastal Conservancy Wh1Ch brought forth the Department of Power and Water Plan. Ms. Roundtree also read a copy of the Resolut1on presented at the last meet1ng Wh1Ch was put forward by the Res1dent1al Homeowner's Assoc1at1on for the benef1t of the Comm1ss1oners who were not present at that meet1ng. A copy of the Resolut1on was also prov1ded for those Comm1ss1oners. M1tZ1 Morton, 153 13th St., Seal Beach, spoke 1n reference to the June Plann1ng Comm1ss1on meet1ng at Wh1Ch h.eet1ng the 39 ft. he1ght l1m1tat1on was d1scussed. She stated that th1S l1m1tat1on was agreed upon by the Comm1ss1on Qt that t1me, and the Seal 'Beach res1dents do not look favorably 1n com1ng before the Comm1ss1on to argue th1S 1ssue each t1me 1t comes up. Charles Antos, 316 10th St., Seal Beach, spoke 1n reference to Mr. Cov1ngtonls comments on the or1g1n of the 1983 Spec1f1c Plan draft ord1nance Wh1Ch used a base e . . . Plann1ng Comm1ss1on Meet1ng of August 14, 1985 Page 3 zon1ng concept and what has occurred S1nce th1S began. Mr. Antos prov1ded a background for the benef1t of the Comm1ss1on. He was concerned that the General Plan could be amended 1n any way that the C1ty wanted, and he felt that dev1at1ons from eX1st1ng base zon1ng should be clearly spec1f1ed 1n the Spec1f1c Plan. Mr. Antos recommended that the Plann1ng Comm1ss1on send a message to C1ty Counc1l to amend the ord1nance to reflect the 1nclus1on of word1ng referenc1ng base zone prOV1S1ons. Robert Cook requested a background of other Spec1f1c Plans used 1n the past. Charles Antos presented a br1ef background to Mr. Cook of past act1ons. Mr. Cook felt that what was be1ng proposed conta1ned a quest10n of uncerta1nty and was unfa1r to the c1t1zens of Seal Beach. It was Mr. Cov1ngtonls op1n1on that dev1at1ons be spec1f1ed and that he would rather have l1m1tat1ons Wh1Ch prove to be 1nadequate and amend them rather than no l1m1t at all. Mr. Jessner d1scussed w1th staff how a property 1S determ1ned for a Spec1f1c Plan and d1Scuss1on cont1nued between the Comm1ss1on and staff referenc1ng th1S matter and the def1n1t1on of a Prec1se Plan. Mr. R1pperdan 1nd1cated that due to the fact that th1S 1S a recommendat1on to C1ty Counc1l who w1ll make the ult1mate dec1s1on, the Plann1ng Comm1ss1on should present both approaches d1scussed ton1ght for the benef1t of the Counc1l. The recommended word1ng should sat1sfy both ph1losoph1es d1scussed. The Comm1ss1on and staff d1scussed the effect these mod1f1cat1ons may have and the1r relat1onsh1P to the General Plan. Mr. Hunt 1nd1cated that he was 1n Oppos1t1on to the use of number l1m1tat1ons. He felt that the publ1c test1mony rece1ved ton1ght was from a small group and not the maJor1ty of Seal Beach. Mr. Hunt was 1n agreement w1th staff's recommendat1on and felt that the use of a spec1f1c number 1n the ord1nance was presumptuous, the future was unpred1ctable. He stated that 1n h1S op1n1on, staff has a broad overV1ew of th1S matter and 1t should be taken 1nto cons1derat1on that staff's recommendat1on would be correct. People can become very emot1onal over an 1ssue of th1S type due to the1r spec1al 1nterests, and the real w1ll of the people must be cons1dered. Mr. Cov1ngton was not 1n agreement w1th th1S 1nd1cat1ng that the Comm1ss1on should not vote on th1S 1ssue based on how the vote may affect Just a part1cular group of people. D1Scuss1on cont1nued between the Comm1ss1on members and staff as to the C1ty Counc1l's ult1mate dec1s1on on th1S 1ssue, and 1t was agreed upon that the 1ntent1on ton1ght was for a report back to Counc1l after the Comm1ss1on's reV1ew and d1Scuss1on of the mod1f1cat1ons. It was the concensus of the Comm1ss1on and so d1rected by Cha1r to vote on each of the recommendat1ons rece1ved on th1S 1ssue separately. Mr. R1pperdan moves to amend Sect10n 28-2950 as follows: End of the f1rst sentence, add as the next sentence, "Such a Spec1f1c Plan shall be cons1stent w1th and 1mplement the General Plan.". Mr. Cov1ngton seconds. AYES: NOES: Cov1ngton, Perr1n Hunt, Jessner, R1pperdan Mot1on Den1ed Mr. Cov1ngton moves to amend Sect10n 28-1702 and re-word the paragraph mod1fY1ng the recommendat1on rece1ved by Mr. Cl1ft as follows: "Due to cont1nu1ng publ1c concern regard1ng bU1ld1ng he1ghts, part1cular care must be exerc1sed 1n the establ1shment of bU1ld1ng he1ght development standards for each Spec1f1c Plan under the prOV1S1ons of Sect10n 28-2900 (below). Factors to be carefully we1ghed shall 1nclude, but not be l1m1ted to, the Plann1ng D1str1ct 1n Wh1Ch the Spec1f1c Plan 1S to be located, the current zon1ng of the proposed s1te, he1ght of eX1st1ng bU1ld1ngs lmmed1ately surround1ng the Spec1f1c Plan s1te and the effect of the bU1ld1ng helght on the areas surround1ng the proposed s1te. Mr. Jessner suggested that all of the proposals presented thus far be comblned In a report to Clty Councll. Mr. Covlngton moved that the preVlOUS motlon he made regardlng the re-wordlng of Sectlon 28-1702 be amended as follows: "In addltlon, no bUlldlng wlthln any Speclflc Plan area can exceed 3 storles of space not lncludlng subterranean and/or roof level commerclal use unless the eXlstlng zonlng would permlt a greater helght WhlCh would then apply or the proposed use lS for a medlcal faclllty. The prOV1Slons of thlS sectlon shall not apply to any valld Preclse Speclflc Plan prevlously approved by the Clty.". Mr. Perrln seconds. -- After contlnued dlScusslon, Mr. Covlngton then made a motlon to lncorporate a recommendatlon made by Mr. Hunt for the re-wordlng of Sectlon 28-1702 to read as follows: "In addltlon, no bUlldlngs wlth any Speclflc Plan area can exceed 3 storles of space not lncludlng subterranean and/or roof level commerclal use unless the eXlstlng zonlng would permlt a greater helght whlch shall then apply or for planned retlrement communltles establlshed prlor to 1970.".
