The Seal Beach Planning Commission met in regular session
at 7:38 p.m. with Chairman Jessner calling the meeting
to order. Commissioner Perrin led the Salute to the Flag.

REPORT FROM SECRETARY
Mr. Baucke reported that an appeal of the approval of Variance
1-86, Condition Seven, requiring the disintensification
of the use of the property located at 1550 Pacific Coast
Highway, had been filed by Mr. David Stangeland, said appeal
to be considered by the City Council on June 9th.

PUBLIC HEARING - VARIANCE 7-86 - 211-15th STREET - DONALD
COX and DAVID HENRY
The Director presented the staff report relating to Variance
7-86, a request for the use of tandem parking and a uniform
three foot setback on the north side of the subject property.
The Director presented the staff's recommendation for approval
of Variance 7-86 for the following reasons: 1) the request
is consistent with limitations imposed upon other properties
in the same vicinity and zone; 2) the request is not a
special privilege since the Commission has approved previous
applications for tandem parking; and 3) the property has
affected a hardship upon the property owner due to its
size, shape and location.
Chairman Jessner declared the public hearing open. Mr.
Wilford Anderson addressed the Commission on behalf of
Mr. Cox and Mr. Henry, concurred with the facts reported
regarding the request for variance and with the recommendations
of staff. There were no other communications; Chairman
Jessner declared the public hearing closed. The Director
reported that the requested three foot setback is the standard
minimum in the R-3 zone, and acceptable to the Fire Department.

RESOLUTION NUMBER 1422 - APPROVING VARIANCE 7-86
Covington moved, second by Perrin, to adopt Resolution
Number 1422 entitled "A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF SEAL BEACH APPROVING VARIANCE 7-86, A REQUEST

PUBLIC HEARING - AMENDMENT TO VARIANCE 10-85 - 323 MAIN
STREET - JAMES HAGEL
The Director reported the applicant has requested an amendment
to Condtion One of Resolution Number 1389 as it pertains
to the required number and types of on-site and in-lieu
parking spaces relating to the structural addition to the
legal non-conforming building located at 323 Main Street.
He explained that the applicant proposes to increase the
number of on-site parking spaces to a total of eleven based
upon the dedication of forty percent of on-site spaces
to compact parking only for the specific use of employees,
therefore reducing the number of required in-lieu spaces
to two. The Director reported that six compact spaces
would be located to the rear of the building with five

standard spaces in the front. Mr. Baucke noted that prior
to construction on the site the applicant will be required
to submit revised drawings setting forth the amended parking
spaces.

Chairman Jessner declared the public hearing open. In
response to the Commission, Mr. James Hagel, applicant,
acknowledged that the northeasterly existing curb cut on
the property will be eliminated, the City then being able
to diagonally stripe that area for an additional two to
three on-street parking spaces. The Director stated that
it is felt that the dimension of the remaining curb cut
is of adequate width, however final dimensions will be
subject to a determination of the City Engineer, also confirmed
that the drawings before the Commission reflect the revised
parking plan only, the landscaping reflected on the original
variance plans, said landscaping having been a condition
of approval of Variance 10-85. Mr. Walt Miller, Seal Beach
Boulevard, inquired about handicapped spaces, and stated
elimination of one in-lieu space should be a consideration.
The Director clarified that the subject building was constructed
prior to the handicapped standards being adopted, the law
not requiring that handicapped spaces now be added, noting
also that there are handicapped spaces designated on each
block of Main Street, one believed to be across the street
from the subject property, and that the Improvement Plan
for Main Street proposes several twenty minute and handicapped
spaces near the crosswalk areas. There being no further
communications; Chairman Jessner declared the public hearing
closed.

AMENDED RESOLUTION NUMBER 1319 - VARIANCE 10-85 - 323 MAIN
STREET - HAGEL
Chairman Jessner requested that the proposed Resolution
be amended to include two additional conditions, number
10 to read "There shall be eleven (11) parking spaces provided,
six (6) compact spaces in the rear, and five (5) coventional
spaces in the front of the subject property", and number
11 to read "That striping for the parking spaces be maintained
as approved." Mr. Jessner suggested that when variances
to parking requirements are granted in the future, the
resolutions approving same be specific as to their conditions,
as a clarification for future enforcement. With regard
to a question posed regarding inclusion of a provision
that would automatically revoke a variance for noncompliance
with all provisions, the City Attorney advised that such
provision would not be appropriate, that specific procedures
for hearing would be required to be followed in any case
involving a revocation. Staff confirmed that a standard
size vehicle can be cited for parking in a compact space,

also that the subject request does not set a precedent
with regard to the percentage of compact spaces, a similar
approval having been granted for forty-six percent compact
spaces in the Shore Shop area.
Perrin moved, second by Covington, to approve Amended
Resolution Number 1369 "A RESOLUTION OF THE SEAL BEACH
PLANNING COMMISSION APPROVING AMENDED VARIANCE 10-85, A
REQUEST TO PERMIT A STRUCTURAL ADDITION TO A LEGAL NON-
CONFORMING BUILDING WITH DEVIATIONS FROM THE REQUIRED PARKING,
LANDSCAPING AND AMOUNT OF COMPACT PARKING (323 MAIN STREET)"

The Commission asked that the record reflect their desire
that the City Engineer take into consideration the potential
need for a designated handicapped space on the west side
of Main Street in the vicinity of the location previously
under discussion.

The Commission, by unanimous consent of those present,
declared a recess at 8:13 p.m. The Commission reconvened
at 8:20 p.m. with Chairman Jessner calling the meeting
to order.

SEAL BEACH BOULEVARD RIGHT-OF-WAY MASTER IMPROVEMENT PLAN
The Director of Development Services presented the staff
report, noting that subsequent to discussion at the March
5th Planning Commmission study session, the consultant
and staff reviewed the comments made and presented those
modifications to the Seal Beach Boulevard Task Force for
their review, the Master Plan now modified to reflect changes
made. The Director clarified that the comments made dealt
specifically with the location of the bike path, street
sweeping, ,the northbound left turn pocket into the alley,
a U-turn at Landing and/or Pacific Coast Highway, the turning
radius and width of the alley. Mr. Dave Bartlett, Van Dell
& Associates, stated his intent to review the points made
at the March 5th meeting. Mr. Bartlett noted that the
initial location of the bikelane was at grade level with
the sidewalk, approved by Caltrans and met all basic
transportation criteria, however based upon the concerns
expressed by residents, the bikelane location was reevaluated
and placed in the street adjacent to the travel lane.
Mr. Bartlett reported it has been determined that there
is no conflict with the General Plan Bicycle Element since

the bikelane will not be striped and will be designated
as a bike route, therefore a General Plan amendment is
not necessary. Mr. Bartlett described a cross section
of the improvement plan as: a six foot sidewalk, three
feet designated for landscaping and undergrounding of utilities,
eighteen feet for diagonal parking, a twenty foot travel
lane, eight foot landscaped median, a twelve foot travel
lane, a five foot bikelane as currently exists on the Boulevard,
and a five foot planting screen and utility easement to
the east. Mr. Bartlett noted that the westerly landscaped
easement accommodates encroachments into the right-of-way
by a number of the properties, that it is also proposed
that the existing easterly curb and gutter be removed and
placed five feet to the east to provide the five foot paved
bikelane. He reported work has been continuing with the
Navy to develop appropriate landscaping to the east in
conjunction with Navy landscaping and guidelines, the intent
being that the landscaping plans will compliment each other.
With regard to street sweeping, the Public Works Director
reported there are a variety of schedules that can be applied
to particular areas of the City, stating he could not foresee
a problem with Seal Beach Boulevard. Mr. Bartlett reported
that in order to accommodate the U-turn at Landing and
Seal Beach Boulevard, some of the landscape screening was
deleted to provide a twenty-four foot turning radius to
allow motorists traveling northbound to make a U-turn and
park in front of residences and businesses on the west
side of the street. He also reported the alley next to
the Bay motel is a standard size alley, the width in conformance
with other alleys in the City, and that the plan provides
for a left turn pocket into the alley in order to not jeopardize
the circulation network that currently exists in that area.
Mr. Bartlett noted that the turn into that alley is difficult
at present due to the location of an existing power pole,
and in discussions with the Edison Company and some of
the property owners, relocation of that pole does not appear
to pose a constraint. Mr. Baucke noted conversations with
the Edison representative who indicated that when undergrounding
takes place on Seal Beach Boulevard that pole would be
relocated in conformance with this Plan, also noting that
there is a steel pole existing on private property that
is a violation of City Code and presently hampers the turning
radius. Mr. Bartlett stated that the Master Improvement
Plan and design elements provide an entry statement to
the City, that brick paving is proposed throughout the
project, the theme paving designed to give the project
a sense of scale and continuity, landscaped islands added
at selected locations, the historical marker relocated
to the vicinity of the bike shop, with new bus shelters
of a wooden texture to compliment other improvements to

the area. He explained that the open channel area, partially
on Navy and City property is proposed for either screening
and maintenance of the channel, or as an alternative for
parking, an analysis showing that an additional twenty-
four spaces could be provided with the construction of
a box culvert over the channel. Mr. Bartlett again explained
that the left turn pocket into the alley is proposed to
maintain the circulation that presently exists, that removal
of the existing obstructions to the alleyway can be accomplished
by the Edison Company and the property owners, confirmed
that the landscaping has been planned to not visually obstruct
an exit from the alley, and responded that expense would
not constitute a major factor as to whether or not the
turning pocket was constructed. Mr. Bartlett confirmed
that no count was available of the alley usage in this
vicintiy, noting that if a study demonstrated that the
alley was over-utilized, widening of the alley throat would
be an appropriate mitigation measure, however added that
in his opinion, use of that alley would most likely decrease
with the possible introduction of new land use into the
area. With regard to a concern expressed regarding the
speed limit on Seal Beach Boulevard, the Director reported
there are specific limitations on the City's ability to
adjust speed limits based upon State statute, noting that
it has been reported that the visual affect upon a driver
with construction of the median will automatically tend
to slow vehicle speeds. The Public Works Director confirmed
Mr. Baucke's statement, adding that the current configuration
of Seal Beach Boulevard encourages higher speeds due to
the open nature of the street, particularly on the east
side where no development exists. Mr. Hemphill explained
that the median, landscaping, narrowing of the traffic
lane, and angled parking will greatly influence vehicle
speeds. He noted that whenever a physical change is made
on a street, sufficient rationale is created to implement
new speed limit studies and monitoring of driver habits,
such studies regulated by State law. With regard to access
to the alleyway, Mr. Hemphill stated that although specific
alley counts are not available, he would expect that the
actual movement over a twenty-four hour period would be
extremely light, possibly less than one hundred per day.
In response to the Commission, Mr. Hemphill stated he could
foresee no traffic flow problems with the additional parking
that could be provided over the drainage channel, the only
foreseeable conflict could be with bicycle traffic, noting
that the vehicle and bicycle traffic would be traveling
in the same direction with good visibility, however acknowledged
that the first parking space could be deleted so that a
car backing up would not have a conflict with a bicycle,
and also pointed out that the area could be striped for
.

further clarification. Mr. Baucke reported $100,000 is
the estimated cost of obtaining that property for parking,
and would be proposed as the last option to be constructed.
Mr. Bartlett added that the estimated cost would include
all amenities associated with such a structure as well
as negotiations with the Naval Weapons Station to obtain
a parking easement, to which the Navy has indicated their
agreement.

Chairman Jessner invited public comments at this time.
Walt Miller, 231 Seal Beach Boulevard property owner since
1977, stated he did not necessarily dislike the project,
however did have some specific concerns. Mr. Miller expressed
his feeling that his northbound traveling business would
be totally denied due to the median, that vehicles would
not or could not make the U-turn of twenty-four feet in
radius, a standard vehicle requiring a thirty-two foot
radius. Mr. Miller stated his northbound bicycle traffic
business would likewise be denied. Mr. Miller said that
Main Street and Seal Beach Boulevard are the same width,
however he had been informed that Main Street is narrower
therefore Main Street treatment is different, and inquired
how an emergency vehicle could proceed if a car, for example,
ran out of gas in the travel lane with the existance of
the median and diagonal parking. He noted that the bicycle
lane is undesignated, however he had been informed it was
required to be designated according to State mandate, and
expressed his feeling that there would be accidents involving
bicycles should diagonal parking spaces be approved. Mr.
Miller noted the Navy is presently landscaping, this Plan
would add more, and complained that he would be unable
to continue his second story view because of the trees,
also stated that the trees would interfere with bus traffic.
With regard to the proposal for an additional twenty-four
parking spaces over the channel, Mr. Miller expressed his
objection, again citing potential for bicycle/vehicle accidents.
Mr. Miller suggested reconsideration of the first proposal,
placing diagonal parking on both sides of the street,
landscaping on"the east side, and no median strip. The
staff noted several of the comments made by Mr. Miller
to be incorrect, and requested the Public Works Director
and consultant to respond. The Public Works Director pointed
out the difference between radius and diameter, explaining
that the twenty-four foot radius provided in this design
is actually a forty-eight foot diameter which would easily
accommodate a standard vehicle on a standard street. He
stated that as a Traffic Engineer he is familiar with standard
traffic engineering design criteria, the standard design
being a twenty foot turning radius or forty foot diameter,
this Plan having provided eight feet beyond those standards,

and reported he was very satisfied with the movement and
design as set forth in the Plan. Mr. Hemphill noted his
past experience with consulting firms specializing in bicycle
studies and engineering, offering that there remains an
unresolved issue among bicycle engineers as to whether
striping promotes safety or a hazard. He explained that
according to this Plan a twenty foot corridor is provided
to drive the bicycle, the normal aisle for forty-five degree
parking being twelve feet, this Plan providing twenty,
therefore there is an additional eight feet available to
the cyclist. He noted the responsibility of a cyclist
as well as a driver of a vehicle to be aware of potential
hazards. He pointed out that more than adequate area is
provided to the cyclist for maneuvering under the Plan,
that it is not any safer with or without bikelane striping,
in fact, he would view this Plan as safer than previously
proposed. With regard to the type of trees proposed, the
landscape architect reported that the type of tree being
planted on the military base is open in nature, the trees
proposed by the Plan for the east side of the street where
palm trees currently exist, is an in-fill where trees have
died, and in the median a tall tree is proposed, currently
designated as eucalyptus, which would not hamper view from
a second story, and that small trees are proposed for the
residential/commercial side of the Boulevard. The Director
clarified that this area of Seal Beach Boulevard is not
on the County's Master Plan of Bikeways, the County designated
bikeway ending at Pacific Coast Highway, however on the
City's Bicycle Plan Seal Beach Boulevard is designated,
thus the attempt to accommodate bicycle traffic on both
sides of the street. Mr. Hemphill clarified that most
passenger cars are six feet wide, the maximum vehicle width
in California being eight feet, those vehicles being campers
or trucks and requiring a special permit. With regard
to the adequacy of the street width in a worst case scenario
of a stalled car and the travel of an emergency vehicle,
Mr. Hemphill stated it would be unusual if a car could
not proceed to the side of the roadway, however it is also
quite feasible that the emergency vehicle could drive over
the curb if the roadway was blocked, as curbs are designed
to be mounted, and concluded that he felt the roadway width
proposed would be more than adequate for any vehicle no
matter its size. Greg Miller, Sandpiper Bike Shop, expressed
his concern for safety with vehicles stopping on the east
side of the street with an exiting passenger en route to
his shop, also stating he did not feel cars could maneuver
the u-turn proposed. Mr. Hemphill responded that violation
of bicycle lanes is a common, social problem, as well as
an enforcement problem, that the Police Department could
direct special attention to the area if a problem were
.

perceived to exist. Staff informed Mr. Miller that the
center line of the Boulevard had been revised on the Plan,
provides a twenty-four foot radious for a u-turn, and in
addition a vehicle is allowed, without violation, to make
a u-turn at Pacific Coast Highway. Ms. Fielding, 223 Seal
Beach Boulevard, Growing Tree Preschool, stated she was
an original member of the Task Force, had attended all
Task Force and Planning Commission meetings relating to
this Plan. She stated a great deal of time and personal
effort has been devoted to the Plan, the Plan as proposed
representing about eighty percent of the proposals and
concerns brought forth through those meetings, and expressed
her feeling that the Plan is an initial step towards
improvements to the Boulevard and requested it's approval.
Mr. Bruce Stark, 204 Ocean and 219 Seal Beach Boulevard,
spoke regarding the width of the southbound lane, suggesting
the additional eight feet could be used on the east side
of the street to accommodate additional parking, also suggesting
that the median could have additional openings for turns
while maintaining the majority of the median landscaping.
Mr. Stark expressed his opinion that the bicycle lanes
are not a critical issue, stating the cyclists would most
likely utilize the entire street whether or not the lanes
are striped. He also spoke to the left turn pocket into
the alley, stating he did not feel the alley would realize
a great deal of traffic due to it's narrow width and
encroachments into the alley. Mr. Stark asked that
consideration be given to a median cut to allow northbound
traffic access to the Shore Shop, also suggested that if
the additional parking is implemented to the east of the
Boulevard, the entrance to that area correspond with Landing
Avenue. He suggested dwarf Christmas trees be included
in the median that would allow decoration during the Christmas
season. Mr. Stark said he felt this was a good Plan with
only minor flaws in need of correction. Discussion continued.
The staff clarified that the twenty foot traffic lane was
determined by a study conducted by Van Del based upon the
traffic count of southbound vehicles, the additional eight
feet allowing a car to back up and merge into the travel
lane without an interface with the southbound driver, also
providing an adequate area for cyclists. It was noted
that the additional width and diagonal parking will be
sufficient for a future increase in commercial activity
along the west side of the Boulevard. Barbara Rountree,
316 - 13th Street, stated she frequents the businesses
on the Boulevard, always utilizing the westerly parking
due to its proximity and safety, and spoke in support of
the efforts of the Committee and in favor of the proposed
Plan. With regard to the alternative suggested for a turn
from southbound traffic to the proposed alternative parking

to the east, the Director stated that alternative could
be looked into by the traffic engineers. Brian Kyle, property
owner of 303 Seal Beach Boulevard, spoke in support of
the suggested access from Landing Avenue to the alternative
parking, as well as any landscaping that would provide
a screen of the Weapons Station property.
The Director advised that the action of the Commission
would be to make a recommendation to the Council as to
the design of the public improvement plan, the Council
then having the opportunity to consider funding of the
particular phases during their budgetary process, the total
project anticipated to be phased over a five year period.
Mr. Baucke clarified that one of the first phases of improvement
would be undergrounding, that $50,000 of funding has been
allocated to the project for the next fiscal year, with
additional improvements to be accomplished as funds become
available.

Perrin moved, second by Covington, to approve the Master
Improvement Plan for Seal Beach Boulevard with the following
modifications taken into consideration: 1) that an alternative
design be considered for the parking area on the east side
of the Boulevard, 2) that the utility pole at the intersection
of the north/south and east/west alleys be eliminated and
any other visual obstructions that exist on private property
be removed, and 3) that the throat of the alley adjacent
to Seal Beach Boulevard be reviewed for modification to
enhance accessibility, also taking into consideration the
landscaping at that location to insure adequate visibility.

REPORT - ALCOHOL PROVISIONS
The Director reported staff had prepared a summary of
Commission recommendations from the May 14th meeting for
review by the Commission and recommendation to the City
Council. After brief discussion, recommendation #5 was
amended to read "The Police Department is to implement
a new procedure whereby upon contact from ABC on one day
permits a form is to be completed..."; recommendation #8
amended to read "That the City Council establish a policy
and maintain adequate C~tr manpower for enforcement of
the Municipal Code provlslons and conditions of approval,
specifically in the case of alcohol outlets, and special
events", and recommendation #9 was amended to place a comma
after Development Services, delete the following word "that",

and correct the spelling of "thereof." The City Attorney
clarified that an amortization period for existing liquor
establishments would be established upon the conclusion
of discussions and at such time as an ordinance is prepared,
noting that the Commission will again have the opportunity
for input prior to final consideration by the Council.
Staff noted that this report, as requested by the City
Council, will have been forwarded to that body within the
forty-five day period as required by Code. It was the
request of the Commission that the Council be made aware
of the procedures followed to obtain public input which
resulted in the recommendations set forth. Covington moved,
second by Perrin, to adopt the report prepared by staff
setting forth the recommendations of the Commission as
amended, and that the report be forwarded to the City Council.

In response to the Commission, the City Attorney advised
it would not be possible to indicate Commissioner Ripperdan's
concurrance with the recommendations; staff advised that
an excerpt of the previous meeting could be transmitted
to the Council that would indicate Mr. Ripperdan's opinions.

ORAL COMMUNICATIONS
Chairman Jessner declared Oral Communications open. Mr.
Bruce Stark, 204 Ocean, requested a copy of the recommendations
being forwarded to Council, referred to a prior survey
of regulations imposed by other cities regarding control
of alcohol, and suggested that Seal Beach consider a requirement
that a certain percentage of revenue be derived from food
sales in order to retain a CUP for alcohol. Barbara Rountree,
316 - 13th Street, read a communication from the Seal Beach
Historical Society requesting that the Planning Commission
establish an historical inventory for the preservation
of homes and sites in the community, and that the inventory
be included in the City's General Plan. The Director noted
that some time in the past direction had been given for
the preparation of an historical inventory, and suggested
that the project be placed on the priority list for
consideration by the Commission. Mr. Charles Antos, 316 - lOth
Street, read his communication to the Commission proposing
a Zoning Text Amendment to permit construction above the
flood water line without the penalty of lowering the overall

building height, current Code providing for building height
measurement from the average finished grade, stating that
this matter is brought to attention as a result of the
1980 storms. The Director noted that the definition of
grade and definition of height measurement has changed
and does not necessarily address Mr. Antos' suggestion,
and inquired as to what degree of flood was being referenced.
Mr. Covington stated his understanding of the suggestion
was that the height limit remain, however calculated from
the flood line, noting that a determination of the degree
of flood would be pertinent, also pointing out that most
residences in the City, with the exception of the Marina
Hill, fall within the flood plain area, and that the proposal
would require significant staff research prior to Commission
consideration. Mr. Joe Ribal, 1215-1/2 Seal Way, spoke
in support of a ZTA as suggested, citing the potential
danger to properties along the ocean frontage, many of
which are constructed at ground level. Mr. Ribal suggested
this would be an opportunity to address the building regulations
to provide guidelines for construction in areas where potential
danger exists. Mr. Antos restated his intent was that
no penalty be imposed for elevating a property to the flood
water line with regard to building height and conformance
to Code requirements. There were no further communications;
Chairman Jessner declared Oral Communications closed.

COMMISSION COMMUNICATIONS
Mr. Baucke stated he would not be in attendance at the
next Commission meeting, however he would be present at
the June 11th adjourned meeting. In response to the Commission,
Mr. Baucke reported recruitment is in progress for the
Director of Development Services position, and that interviews
have been conducted for the position of Administrative
Aide. Commissioner Covington stated he felt the Council
should be made aware of the Commission's concern that adequate
staffing of the Planning and Building Departments should
be taken under consideration in order to cope with the
potential workload anticipated over the next five years,
and requested copies of the proposed budgets for those
Departments.
ADJOURNMENT
The Commission, by unanimous consent of those present,
adjourned the meeting at 10:50 p.m.

INTRODUCTION
Currently, the Zoning Ordinance provides for building height
aeaaurement from average finished grade. No proviaions sre
made for elevating the building above the flood water line.
A person may construct a building above the flood water line
with the penalty of lowering the overall height to keep the
building within the maxiaum permitted height aa aeasured from
the ground.
BACKGROUND
One of the maJor topics of concern to the residents of the
Old Town area is the protection of their hoaes from storm
damage. This was dramatically demonstrated during the stor.s
that destroyed the Seal Beach Pier and flooded homes along
Seal Way, Ocean Av., 12th. St. to Seal Beach Blvd. and in
Surfside Colony. The only structure. that escaped dsmage
were those constructed on elevated pads. For the last year,
a number of concerned residents have asked the City to deal
with thia issue and to make provisions to construct homes
above the flood water line without penalty of lowering their
permitted height. To date nothing has been proposed by City
staff.
PROPOSAL
After reviewing the Zoning Ordinance, I have determined that
two sections of the code need to be amended slightly to
implement the concept of construction above the flood water
line without penalty.
The following amendments are proposed:
Aaend Section 28-238 to read:
Sec. 28-238. Grade. IIGradell means the average elevation of
the finished surface of the ground at the center of all walla
of a building. and located above the flood water line.
